At the video’s approx. 0:40 mark, Rolf remarks that in the USA he could identify his law practice “services” with a superscript “TM” mark (common law & unregistered trade-mark): FREISCHEM TM. Alternatively, and perhaps more accurately, one could use a superscript “SM” mark (common law & unregistered service-mark) to identify FREISCHEM’s business, as it offers legal services rather than a tangible (TM) product: FREISCHEM SM. When marking products/services with TM, SM, or ®, it’s best to make sure the protected word mark is differentiated from its surrounding text: i.e., present it in all CAPITAL letters as Rolf did (FREISCHEM TM), ITALICIZED, BOLDED, in a different color, or underline the word.
Rolf wrote, “I did not want to make the video more complicated by also talking about SM. I guess I should have!” IP can be challenging/confusing, and keeping videos short in duration is a good plan that helps keep the viewers’ attention. It’s just not possible to include everything.
