    Should your LLC match the name your trying to get trademarked? And which should you do first; LLC or Trademark?

      Unfortunately I can’t really give you that sort of advice as I’m not an expert in trademarking.
      An intellectual property specialist will be able to let you know what the best process would be for you as a lot of these things depend on many different factors.

    Thanks for this video. Does the WIPO account for all global trademarks? In other words, if red squirrel doesn't appear in the search does that mean that there is no such trademark in the whole world or does WIPO search only in certian territories? Furthermore, if you wanted to register red squirrel as a trademark is there one global registration you could complete or do you need to complete a new trademark registration for each territory? Thanks.

      Hey Walshy,
      I don't know if the WIPO would give you comprehensive global results. If you know which country you are looking to trademark in, then I would also run a search on that countries specific database. For example if it was a UK trademark, I'd also check at www.gov.uk/search-for-trademark or if I was looking to trademark in the USA I'd look on www.uspto.gov/
      There is something known as the Madrid protocol that allows you to file a trademark in multiple countries on one filing. You can find out more information about that here: www.wipo.int/madrid/en/

      @@RockYourBrand Thanks. I subsequently discovered that the Madrid Protocol is done through the WIPO so I'd assume that a WIPO search would be fairly comprehensive.

      @@RockYourBrand Also, does a name for a band/recording artist require a trade mark or a service mark? We are selling goods (recordings etc) but we are also providing services (performing live etc) so I'm unsure which one we need. Thank you.

      If you go to the WIPO website, that I mention in the video, you can do an image search. Upload the logo design that you have and you can search to see if there are any registered logos that look similar.
      This is not a foolproof method though, you should always check with an Intellectual Property professional for advice.

    thanks for the video. so, again your search was red squirrel, if the in the result there is no expression that show the exact search you did "red squirrel" that mean there is no copyright or trademark ?

      As the WIPO website doesn’t cover all regions and databases, if a search doesn’t show any results, that doesn’t mean the term isn’t still registered somewhere.
      WIPO is a good starting point, but you should always speak to a trademark expert as they can do a full search for you.

    If the name i want to use is example "WORLD ACTIVEWEAR" , and "WORLD" is already registered in the apparel business would that be legal ?

      In this instance, I'd definitely speak to an IP specialist to make sure. I honestly am not sure on where you would stand with that.

    If I want to use a brandname example 'Xyz' for 'cosmetic' products but the search results shows that a company in a nearby country is using that name for 'food supplements', should I avoid using that name, especially if I want to keep options open for exporting in the future.

      If the other company is in a completely different industry and you won't be trading in their industry then you can have the same name.
      You would have to check as well that the other business doesn't have that name already trademarked in your industry sector.
      However, if you were my client, I would suggest trying to find an original name that didn't exists elsewhere.

    Hi! your video was so helpful! I am starting an online business and am lost. lol
    However, when looking up the trademark names what if someone has the same name but in a different industry? So say my business name is Purple Penguin and my service is the food industry but someone else is trademarked the same name under design? Does that mean it's not available or can you still use it since you are in different industries? Hope you see this lol thanks for all the help!

      Hey Sydney,
      If the other business does not have the name trademarked in the classifications that you want (food), then you can file for the trademark.
      However, anyone who already has that trademark name can file a notice if they feel there may be an issue.
      I had that happen to me recently when I filed to trademark 'PI'. Another business that was using PI in another industry sector tried to block my registration as they said I was intruding on their trademark.
      Thankfully, I used an expert company to register my trademark and their lawyers dealt with everything and it was all sorted out and I now have the PI trademark.
      So in short: If nobody else has the name you want to be registered as a trademark, it should be okay. However, you should also be prepared for companies who have that name in another sector to potentially raise a complaint/objection. This is why I always recommend using a company that specialises in trademarking, rather than doing it yourself.

      Hey André, in the 'SEARCH BY' box you will see some tabs along the top. Click on the one that says 'Class'.
      In the first box put the subject you are looking for 'red squirrel', and in the box below put in the number of the class you want to search (01 - 45). When you put in a number, for example, 09, it will display a tooltip box showing you what is covered by that class.
      I hope that helps.

      The WIPO site includes results from the USPTO trademark database.
      Using WIPO is good for a surface level search. I always recommend using the services of a trademark expert.

      If you are in a different industry sector then yes, you should be able to register the same name as someone who is serving a different industry.
      I would definitely check with an intellectual property expert though before starting any registration process :)

      Hi Alex, that is very strange. I just jumped onto the WIPO site and did the Red Squirrel search, along with a few other random name searches and it gave me results for everything I searched for.
      I'm not sure why your not getting any results? 🤔

      This site won’t give you 100% coverage of all trademarks. You should use it as a rough guide.
      For a full and complete search you are best to use a trademark/ip company who can do full searches for you.

      The default 'Text' section will search for the exact word or phrase you enter.

    Man It took me hours and I mean hours of non stop research for a name and I finally got one and I checked and it wasn't used and then I made all of the accounts for it then I found this small restaurant with the same name but I have two words but the have one of the words
    So I want to see If I can get in trouble for this

      If your business isn't in the same industry, then it really shouldn't be a problem.
      If your business is also a restaurant, then you may still be able to register the name as a trademark if the other business hasn't done so.
      But I'd always recommend speaking to a trademark specialist in these instances :)

      Hi,
      If you do a search for a trademark, when the results come back, you will see a column called 'Source'. If you see the same trademark name/logo in multiple rows, check the source column and if it shows different country codes, then you will know that it is an international trademark, and you can see all of the countries where they have trademarked.
