When I said Passing off is trademark exclusive provision, I was only considering the 3 main IPR's i.e. Copyright Patent and Trademark.

According to section 21, a person can give notice of opposition to registration in writing to the registrar within 4 months from the date of advertisement.

I have old company but not doing trademark registration now one person is done trademark , his trademark have image+Wordmark and mine is also image+Wordmark but look is different , just similarity is word , now he is telling me that you can't use word is it possible ? , And our class & field is same , but i feel passing off . What should i do ?
What you should do is that you should go to a lawyer, this is not an academic question, and if it is, the details are not enough, depends a lot on how actually your and his trademark look.

Sir I'm your subscriber but I'm really not at all satisfied with your ipr playlist as you've taught way too fastt!! Which was flying over my head !! Your other playlists such as torta,ipc,etc are good detailed explanations which i really liked and understand... But here you're also skipping so many things ex:- in the video of patent where you just told us to read so many points after pausing the video but sir!WE ALREADY HAVE NOTES we're here only to understand those notes but you skipped so many things
13:18 is it necessary to be written or printed only as section 29(9) says it can be through oral or visual representation. Please Clarify!
you got confused in between two things, and its my fault, i was not very clear about it.
Understand like this:
Imagine you make soaps, and your brand name is devyani soaps, now devyani soaps is your trademark. you have printed the trademark on the packet of the soap, on the soap bar itself, on banners on top of shops etc.
if someone copies your trademark and prints/writes your trademark 'devyani soaps' on the soaps or for marketing he will be infringing your trademark.
But if he doesn't writes/prints it anywhere and just sells normal soap bars with no branding and orally tells the buyer that the soap he is selling is devyani soaps, he cant be held liable for infringing your trademark because he hasn't printed it anywhere and you wont be able to prove what he said orally.
This is what i was trying to say at 13:18
now about 29(9) saying that 'the trade mark may be infringed by the spoken use of those words as well as by their visual representation'
that is in context of someone copying an oral or visual element of your trademark. Like if someone copies the startup tone of nokia phones, or the animation style of any company logo and things like that.
But in that case also their should be evidence of the trademark infringement, like a video or an audio recording.
So basically the trademark infringement can only occur if the party writes/prints (printing will also include digital media and not only paper printing) but someone can infringe your trademark by copying the oral or visual aspect of your trademark too.

A trademark can infringe "orally" when someone verbally uses a name, phrase, or sound that is so similar to a registered trademark that it could confuse consumers into believing the product or service is associated with the trademark holder, even if the visual representation of the two marks is different
Eg: "Addidas" has Registered Trademark. The other person starts a buisness with the trademark name "Abidas". Here visual representation of letters is different but When you pronounce these names "orally" the tone resembles the same which is also an Infringement to TradeMark.
