Juror responds after Lori Vallow Daybell's attorneys ask for a new trial

    A man who served on the jury in Lori Vallow Daybell’s case is responding to a motion filed by her defense attorneys asking for a new trial.
    Saul Hernandez, Juror No. 8, spoke with EastIdahoNews.com five days after he and 11 other jurors found Daybell guilty of murdering two of her children, Joshua “JJ” Vallow and Tylee Ryan. Daybell was also found guilty of conspiracy to commit the murder of Tammy Daybell, the former wife of Lori Daybell’s husband, Chad Daybell.
    In the motion for new trial filed Friday, Jim Archibald and John Thomas, Daybell’s attorneys, claim Hernandez knew about evidence that wasn’t presented during the trial and that instructions given to the jurors were confusing.
    The lawyers cite a portion of Hernandez’s interview with EastIdahoNews.com where he was asked about the efforts of law enforcement. Hernandez responded that police in Arizona had some “significant red flags” before and after Charles Vallow, Lori’s fourth husband, was shot and killed by her brother Alex Cox.
    “We didn’t consider this during our deliberations because it was clear to us. The instructions were clear. Arizona evidence and testimony is only for demonstrative purposes,” Hernandez said.
    During the trial, Archibald and Thomas repeatedly objected to having evidence and testimony from the Arizona cases brought into Daybell’s Idaho case. In their motion, they argue evidence regarding Arizona was not admitted for demonstrative purposes, as Hernandez said, but was evidence to show “some other reason other than bad character.”
    “To confuse demonstrative evidence and character evidence is easy to do; hence, the defense objections should have been sustained,” the attorneys wrote.
    They also argue that Hernandez referenced evidence in Arizona that was not part of the Idaho trial.
    “We can only conclude that the juror relied on information not presented in court to reach his conclusion that Arizona dropped the ball and should have done more, even before Charles Vallow was shot and killed by Alex Cox,” the attorneys wrote in their motion.
    In a follow-up interview Tuesday, Hernandez said he was not aware of the Arizona video and information until he watched “Dateline NBC” on May 14, two days after the trial ended. Our original interview with him was conducted in Boise on May 17.
    “Once the verdict was final and we were released from court on Friday (May 12), as you can imagine, most people would have a bunch of questions in their mind,” Herandez says. “On Sunday, my wife said, ‘Do you want to watch a new episode (of ‘Dateline’)?’ and I said, ‘Cool. Let’s watch it.’ Obviously, I was intrigued, and that’s when I learned in Arizona there’s footage from an encounter with Charles where he is clearly telling the police that his wife has deemed him a zombie. To me, those were significant red flags about something that’s not normal.”
    Jurors were prohibited from consuming news coverage of the case during the trial but were allowed to watch and read whatever they want once a verdict had been reached, and the judge dismissed them. Hernandez says he “absolutely” followed the court rules and was respectful of the jury instructions presented by District Judge Steven Boyce.
    While Archibald and Thomas argue in their motion that those instructions were confusing, Hernandez says he and his fellow jurors understood them.
    “I thought the judge gave us instructions through the trial, throughout the process, multiple times, and those instructions never changed even up until the very last day before the moment we were released to go and deliberate,” he says. “Those instructions were clear … and we used that set of instructions a number of times throughout the process of deliberation to go back and forth to make sure we understood exactly what the judge and the law and court allowed us to consider and what we were not allowed to consider.”
    Hernandez says he was surprised his comments were mentioned in the defense’s motion, although he expected Daybell to appeal the verdict.

      Absolutely. The legal system and every man who's financed her lifestyle...minus Chad of course. Chad was going to give her access to 'power'. If it weren't for Larry and Kay, she would've continued getting their monthly benefits (I think those totaled somewhere between 4 - 6 thousand every month) and that million from Charles's life insurance. She's been locked up for 3? years, she sat through the entire trial (after being forced) and she saw what were surely sickening photos and after all that, she's still such an entitled lunatic she STILL hasn't learned a thing or has taken accountability for anything. I wonder how many millions of dollars have been spent so far on everything? Lori, nobody's interested in your games. We all just really want you to go away and never bother us again. You got your trial, you've been treated fairly and to even suggest ANOTHER trial just shows how selfish you truly are.

      This trial verdict being thrown out has nothing to do with Lori at all! It has to do with evidence absent and allowed and the jury instructions that may have prejudiced this jury and not given Lori a total fair trial. These procedure errors are serious issues!

That the instructions were 'unclear' for another. But instead of going into detail of what was wrong and how it could have affected the case he decides to drag this jurors character through the mud over nothing. It's unnecessary and it's nasty and mean.

    in the Lori Daybell trial.
    Lori’s lawyers should sit down & shut the ef up as no one believes Lori is innocent.

    Thank you for revisiting this. Lori’s attorneys are clearly reaching for excuses that are not there. Any confusion the jurors have now is based in the defense objections during trial…objections THEY raised and were granted. Once again Lori is blaming others for her poor choices and behavior.

      ​​​@@Juke582 I listened to Mr Hernández' original interview on the 17th and again just now where Nick replayed it and it is VERY CLEAR his opinion came AFTER they were released of their jury duty and was told they were free to watch and read anything! As I am typing, Nick asks him, AGAIN!, to make sure it was clear to "YOU"!! Lori had a FAIR trial! Just because they/she/you, didn't like it, is TOO bad!!

      That’s what objections are for - appellate record. That way the attorneys can say, “we objected to X and the judge allowed it.” But usually the defense makes a motion to vacate or overrule the jury’s verdict before sentencing. Saw it with Murdaugh.

    I really feel for this juror! You can tell he took his duty to the court very seriously and followed all the instructions. His comments in the last interview have been twisted for her legal benefit and that is just appalling. Regardless, I feel confident the judge will see through this nonsense and the conviction will be upheld. Integrity and honesty always prevail!

    As a Narcissist, Lori will do anything to save face. Even if she loses, she will inflict maximum damage to those she sees as threats. She literally enjoys seeing Kay and Larry Woodcock suffer! She wants them and the people of Idaho and Arizona to pay both financially and emotionally.

    Such a respectful honest clear juror thank you Nate for sharing and clarifying. When I heard the request for a new trial and why, I knew exactly what the juror just said was what had happened. Not rocket science they are grasping at straws to create doubt! Lori is guilty as charged and will be sentenced as such

      As much as I hate the idea of her being granted a new trial because she is guilty and deserves the most strict punishment allowed by law, I have questions. Specifically 3:20. This is what the defense is referring to. My concern is that he seems pretty clear that they heard (or he heard) this info while the trial was going (or before), but now he is saying it was only after that verdict on Friday was when he heard this info. I worry that a valid argument can be made actually.

    In that infamous video Charles was practically begging the cops for help, as he was some in the Cox family. Meanwhile those cops were gushing all over little Lori trying to be white knights.     His interview was clear and precise. His reference was not about the outcome of the verdict nor being confused about the instructions. After watching the dateline episode and AFTER the trial what he meant was had they looked into Charles report and then after his murder maybe the children and Tammy would still be alive. This man shows NO display of dishonesty, moral corruption, or anything that would say he didnt do exactly as he was supposed to do!     The attorneys stated this request for a new trial is a normal process. They had a limited number of days to submit it, but I feel mentioning the interview was a dig at the juror.

      She’s probably not safe outside of jail. Richard Ramirez was recognized in the streets of Los Angeles while he was wanted for the Night Stalker murders, and he was almost murdered by everyday citizens.

    The defense is nuts. This man was very clear in his first interview with you. This is kind of along the lines of the multiple times they claimed they didn’t get some documents. “Your honor, we didn’t receive that document from prosecution. Well, whatever.” The number of times he said that got me to laugh each time. I’m thinking, of course you didn’t. You probably lost it, whatever

    The defense and prosecution were presented with the jury instructions and had to agree to the final instructions. In my opinion the lawyer was setting up for appeal during the entire trial.

    Lori’s lawyers are ridiculous! They barely defend her and then pick on this well-spoken juror. When I heard his original interview, I thought I hope everyone is lucky enough to have such a fair, intelligent person deciding the case.

Dragging this juror through the mud over nothing is just nasty and spiteful. Archibald should have just stuck with the facts and left the media out of it.

The thing is that Archibald has tipped his hand and the other jurors know what they might be in for and to mind what they say. I'm glad Saul and Nate are pushing back on this... it's also a clue to the other jurors on how to handle lawyers like that.

    They always reach in the appeals. Doesnt surprise me that they try using your interview, Nate was the thornin their side and even followed them to Hawaii, because he isgood at what he does!!!!!     UGH, I hate how this new trial motion is trying to twist words and split (nonexistent) hairs. With new trials or appeals, the key question is "Would this have actually affected the case outcome?" NO, obviously not. Why? Saul *clearly* said, even in the original interview, that the jury DID NOT CONSIDER Arizona information in their deliberations. Did the defense actually hear the jury's discussions? NO, obviously, not. (Hearsay!) Finally, let's just say it -- THIS IS INSULTING. There was no defense *during* the trial, but now let's talk smack about the jury after the fact? I feel like this motion actually deserves a reprimand from the judge.

    I was on a jury a year ago regarding a hit and run. We were asked if we’d heard anything about it on news outlets, true crime podcasts.
    Of course I looked up the case after my job as a juror was complete!

      But I still don’t see any issue with a juror doing an interview- his job was done, the jury doesn’t come back for sentencing

      It isn't a conflict but yes defense will always try to skew juror comments if they can. So yes it might be expected, but doesn't mean they will win or that there is anything wrong with a juror speaking out.
