Let's talk here for a second. I was just playing Spider-Man PS4 earlier today and thinking about the events of the game. Turns out, the plot about civilians protesting against a violent military force while there's a virus outbreak is pretty accurate to the current year.
As a lawyer who focuses in patents and trademarks, I got about a minute in before I knew this was headed to WFH contracts, lol. I'm glad it did. Many people don't know about how WFH works so I'm glad this shines a light on it.
@@Azure70 So it does get a little bit tricky without knowing if a WFH agreement was signed. In most cases, both parties will sign this beforehand to ensure everyone is on the same page. Even without that though, the law is in favor of JJJ because of one major oversight that MatPat did not mention (and I don't blame him because it's pretty complicated legal stuff, lol). Here is why: THE PICTURES OF SPIDERMAN ARE NOT THE FINISHED WORK. So yes, Peter is a freelancer who is being paid for his work, but technically, it could still be recognized as his work if no WFH agreement is signed. However, the pictures aren't the finished product, and this means everything in the eye of the law. Because JJJ is putting these pictures into his newspaper and writing stories surrounding them, Peter's contribution is considered to be a "collective work". And as MatPat accurately stated, he was paid for his contribution towards it so even though he didn't officially sign a WFH, once he took the money for a collective work, he unknowingly joined a WFH agreement. The finished newspapers are the completed work, and those (and everything inside of it) are owned by JJJ and The Daily Bugle. Therefore, JJJ legally owns those pictures of Spiderman.

I don't know if somebody else has already said this, but I'll say it anyway: Although it was proven that J. Jonah was in all his right to sell those pictures, we have to think on something: In Spider-Man 3, Spidey IS a public figure now. Look no further that the key ceremony when he lets not only a bunch of civilians but also a lot of publications take pictures of him and Gwen smooching. Maybe he was difficult to catch in the past, but, by that point it's really easy to believe that those pictures are not from Peter's camera. And also, with the Eddie Brock example, it was a personal problem against Eddie what made him break his camera. So, in conclusion: Even if it wasn't on J.J.'s right sell those photos, we have no explicit evidence he actually did it. But that's just a theory, A Comments Section Theory! Thanks for reading ;3
Good thought; however I see one major flaw to it. It's not that others can't get Spidey pictures at all; it's that they can't consistently get the same high-quality, most-current action shots that Jameson sells off after he buys them from Peter. That ceremony was a planned, singular event and Spidey was the guest of honor. It would be abjectly stupid for other media outlets not to have photographers present. Jameson also has no right to bar rivals from such a public event, so there was nothing he could do about that even if he wanted to. If people are willing to sell photos the others might be able to coast through buying those for a period if they find really good ones (maybe 3 days tops due to news cycles), however archive photos reach a point where they lose impact on the newsstand from a selling standpoint

There is room for both to be true. Any photos taken at a public appearance would be common. The ones Peter sells to the Bugle are all unique which could drive up the price should JJJ choose to try and resell them.
LegalEagle is convinced that MatPat stole from his fortnite video and never issued any corrections despite MatPat offering to refer him to his legal council for a record of his transcripts that predate LegalEagle's video, so I'm guessing LE won't be doing a colab anytime soon. Shane yeah, I'd like his channel if he didn't do that. It seems SUPER unprofessional. Like for a lawyer, he should admit when he was wrong ESPECIALLY when it is super public. Lost respect for him there tbh
Here's a thought experiment: What if J. Jonah is doing all of this with intent. Maybe secretly, he knows that Spidey and Parker are the same; but he [J] chooses to build Spidey's case as a "menace" to help avert any eyes that'd be pointed at Parker, should the secret get out. Sorta like an anti-hero. J does bad things to make everyone think that Spiderman is a wild-card that just causes collateral damage (Nothing like what "Peter Parker" would do). Also consider J's own capabilities as a photographer (or really anyone with two eyes and a brain)... It's doesn't really take a lot to piece together that your biggest cash-cow happens to be there at the exact same time as the hero in question... And just look at the quality and angling of those photos. Very~ well done.
@@ZMowlcher - Not really, because nearly the whole video is about proving wether or not the claims that inspired this theory (Jason is a thief) are actually true
The Amazing Spider-Man series is severely underrated. The acting was great, the only real problems I had with it was that both J. K. Simmons and J. J. Jameson were both absent and Harry was the Green Goblin instead of Norman. I would have loved to see Chris Cooper as Green Goblin.
In the comics, Peter actually does make a lot of money from the pictures. However he uses it to pay for his aunt's rent and new photo gear. And since he doesn't always have important fights all the time, the pictures are rarer than we think. Because people would get used to him cathcing common crooks, only his fights with super villains or big gangs actually make the real money.
In art commissions, I've seen a few artists that give full rights to the client. So that other people trying to use the art for fan projects can't ask them for permission, they have to ask the buyer instead.

If I post the picture of the pumpkin, I always mention who made the original art since I liked their art enough to use it for my own project.

Interesting note Jonah did have to pay Spidy once and to pay him wrote a check to Spider-Man which ment that to cash it the person had to have valid id which of course Parker would not have for his identity so the check never got cashed :)

4:18 that' "Pulitzer Prize-wininng photo" you're citing here was just a daydream of Peter's. i know because i have that issue: Jameson daydreams he beats-up Spider-Man and wins Publisher of the Year; Felicia Hardy daydreams Spider-Man was actually Cary Grant, and Peter, while hanging upside-down, daydreams of humiliating Jameson, and becoming a full-time member of both the Avengers & the Fantastic Four. it's a tale narrated by Uatu... alas, Peter's hard luck even affects his daydream as both Avengers & FF reject him for being a 'scrawny kid...'
Well, if superheros existed, how much would you pay for a photo. Wouldn’t it be easier to print on the holy grail called the internet? You don’t ‘own’ a photo even if you buy a physical copy. Plus: Jonah was lowballing Peter for all photos. Plus plus: It’s not probable that with all those people, only Spider-Man can get a decent photo.
If Peter had some nerve (more like he did in Spider-Man 3) he could’ve told Jameson to raise his payment, (since he’s the ONLY guy who can get pictures of Spider-Man,) or else he’d take his business elsewhere, to like the New York Times or something.

There is room for both to be true. Any photos taken at a public appearance would be common. The ones Peter sells to the Bugle are all unique which could drive up the price should JJJ choose to try and resell them.
That situation is the exception most of the time he's usually not caught in the high quality only peter can get because he's taking them himself

MatPat: "I'm not a lawyer"
Me: Oooh. Can we have a collab with LegalEagle on this one?
Don't think so. Didn't Eagle hate him, or at the very least dislike MatPat since the Fornite vs PUBG episode?
LegalEagle is convinced that MatPat stole from his fortnite video and never issued any corrections despite MatPat offering to refer him to his legal council for a record of his transcripts that predate LegalEagle's video, so I'm guessing LE won't be doing a colab anytime soon. Even if he wanted to, I'd be insulted if I were Mat.
Not dissing LE completely, I like his content overall. I think his reaction towards Game Theory was unfounded though.
Shane yeah, I'd like his channel if he didn't do that. It seems SUPER unprofessional. Like for a lawyer, he should admit when he was wrong ESPECIALLY when it is super public. Lost respect for him there tbh
They actually have some beef in the past. I don't know if there is still some spark between them.
As much as I'd love that I dont think itll happen, they had some beef in the past and I think LE is still very sour about it

Here's a thought experiment:
What if J.

"Writing your memoirs? Don't forget the hyphen between 'Spider' and 'Man.'"
- Spider-Man
The fact that mat is giving credit to the reddit users is a nice touch
This really doesn’t make any sense. If peter was the only person that could provide spider photos you’d think he’d be a millionaire
That's why the DB is a multimillion dollar company...
Peter is the only person who can provide photos of that quality. Like from when he is climbing the wall.
