My wife has been driving an '08 Dodge Charger SXT 3.5L V6 just like the one in this case since we got married (2013), it's been an awesome car, all maintenance done according the owners manual (which I do with both our cars, and which most owners don't do at all)... 170-ish thousand miles to this date, no major complaints, and no fires lol.

He just went after the wrong person. If it was a manufacturer defect, then Dodge needs to pay! If the owner did some aftermarket modifications or something, then the owner is responsible. Never ever follow what insurance agencies say if you have full cavrage they should pay for the lost of both cars. Just take the deffendant insurance agency to the court. but if you have (I forgot what they call the other insurance), they will pay for the plaintiff but they won't pay for the defandant car. I have worked for an insurance company for 13+ years. I feel horribly for the plaintiff but JM is 100% correct. Your insurance policy can be broken down to when we pay for others and when we pay for your damages. In order for All-State to have paid for the plaintiff's damages, the plaintiff would have to prove negligence on the defendant for improperly maintaining his car. The burden is always on the plaintiff. He should have waited until the fire investigation was clear or paid for an independent investigation to be completed. That way he could pursue whom ever is legally liable. Trying to sue the insurance agency will get you no where but in debt.

Why did the Plaintiff not file a claim with his own insurance company? The fire was of no fault of his own...Unless he didn't have insurance or full coverage. If that's the case, lesson learned. Carry proper insurance on your vehicle and avoid problems such as this.
When you put in a claim, both insurance companies discuss as not to overpay. Ergo, the denial of his claim was, in part, by his own insurance. However, he could claim an "act of God" or faultiness from Dodge manufacturing (if he can grab a brain and gather causation and not corelation evidence), though even a claim without fault ups the insurance premiums.
There are definitely a set of keys in his hand when he gets out and the lights stay on on that car for like 30-60 seconds after you cut the car off and get out of the car. That argument is ridiculous

Plaintiff could’ve paid for additional coverage on his own insurance that would’ve potentially covered him in these situations where no one is at fault, but he didn’t.

But you can’t sue somebody for negligence if he’s done nothing negligent. If a tree branch from a seemingly healthy tree falls onto your parked car, who you gonna sue? As a mechanic a lot of people will hook up lights or sound systems on their car and run them directly to the battery. Which is an amateur thing to do because it can cause fires. This is why we have relays and fuse

You know what's crazy..... Is that the people in court watching, in the back, get paid to be Extra's. I think it's anywhere from $50-100. Some I see and noticed them in a few episodes. No hate, love it, I would even do this. Some of these people is like their job, wait in line (I'm sure they do other shows as well) and get paid just to sit and listen and chill. One of my friends uncle also told me all this information, and he lived off this "job" for years.. he's retired now. I believe he said he made anywhere from $250-500 a day, sometimes even more, on how fast/slow some shows go on... I'm sure there's some people that do this still to this day. Thankfully I have not been in many accidents, but I believe one should always file with own insurance and let them fight the battle. I was rear-ended by a satellite TV installer years ago. I got the necessary info, no police involved, provided the info immediately to my insurance company and they went after the other insurance company. I was glad to make use of my insurance company since I have paid a "ton" of money to them and fortunately have not had to have them work for it. The process was smooth!!

If it's an aftermarket alarm system that could be the reason of the fire anything that was hooked up to that battery or installed incorrectly could be the reason of the fire
Plaintiff should have pursued this with defendants insurance. The liability is his car. If my brakes fail and I hit another car, I am liable. Or the fire department should have checked this further.
Come on, he had to pay 3900 out of pocket to repair a 2004 Camry? Yeah if your damages were that much on an 04 Camry, the car must be destroyed, so something is not right in the equation. Second, if that's somehow true, he should of just bought another Camry. Second, if the defendant is responsible, the only way I can think of is he put in headlights that were not for that Dodge Charger, because it looks like the fire started at the left headlight. It cannot be a battery that went on fire, because a battery in an 2006 Dodge Charger is located in the trunk under the mat.

That's what confused me as well. The plaintiff does not have the charger so they have an uphill battle trying to get Dodge to pay, but the defendant has all the reports needed to get Dodge to pay for the fault.

I'd argue that it was negligent to not move the car away from the other car. He got out pretty calmly, not in any obvious panic. It's an extension of his not giving a crap about others, just like the guy that was waiting for the parking spot.

It’s not fair that his car got damaged, but just because something isn’t fair, that doesn’t mean someone else is responsible for the paying. Plaintiff could’ve paid for additional coverage on his own insurance that would’ve potentially covered him in these situations where no one is at fault, but he didn’t.

@@thecheshirecat299 the defendant’s insurance would pay if the defendant is at fault for the accident. But there was no indication that the defendant was at fault. The plaintiff could have had extended coverage on his own insurance that would’ve covered a situation like this, but he didn’t. So he should do as the judge advised and research whether it’s a potential manufacturing defect and then take action against the manufacturer. But you can’t sue somebody for negligence if he’s done nothing negligent. If a tree branch from a seemingly healthy tree falls onto your parked car, who you gonna sue? If a moose that lives in the woods runs into your parked car, who you gonna sue?
That’s why he needs to sue dodge. Odds are they’d settle out of court for more than $5000

Yikes. Strange case. I hate when plaintiffs go to court, present their case to a judge with legal training and years of experience, and say “so you’re telling me blah blah blah.” As a gesture of good will, the defendant should give him a third of his settlement.
That's what people get for not having proper insurance coverage, even on an older car. If something happens, be prepared to eat it.🤷🏾♀️

I felt bad for the plaintiff until his last sentence to the judge about the defendant not doing anything to put out the fire. I lost all sympathy for that guy from that moment
He lost me when he was making the claim about the car being on because of the lights. And when he was pressed on the issue, all he could say was that he's "pretty sure" the car's lights don't stay on and that he's "sure" the defendant only had a basic model car.

The plaintiff kills me the insurance company was only going to give him$3900 but then he comes to court he tries to get an additional $1100

As a mechanic a lot of people will hook up lights or sound systems on their car and run them directly to the battery. Which is an amateur thing to do because it can cause fires. This is why we have relays and fuse
Looks like he had a v6 charger. Notorious for electrical and overheating issues. Car is a fire hazard to begin with

This seems so unfair, neither one did anything wrong. I feel like the insurance company should pay. I wonder if there's any way to appeal the claim decision? If not, they should split the cost just as a good measure. Also, I don't think he could go after dodge. A car from 06 probably has no original parts.

I don’t have a Dodge Charger, but the lights on my SUV stay on for a short time after I exit the vehicle, and then they go off.
You know what's crazy..... Is that the people in court watching, in the back, get paid to be Extra's. I think it's anywhere from $50-100. Some I see and noticed them in a few episodes. No hate, love it, I would even do this. Some of these people is like their job, wait in line (I'm sure they do other shows as well) and get paid just to sit and listen and chill. One of my friends uncle also told me all this information, and he lived off this "job" for years.. he's retired now. I believe he said he made anywhere from $250-500 a day, sometimes even more, on how fast/slow some shows go on... I'm sure there's some people that do this still to this day. I’d show up at work in the afternoon and every single time, someone would say, “You left your lights on!” I’d have to thank them and tell them they shut off on their own. Morning, afternoon, night. All the time!

Insurance are snakes. You pay them so much money and when you need them they will fight tooth and nail not to pay up. They should cover it and take their band of lawyers and sue car manufacturers. My dad was right they are like a legal mafia.

I feel bad for the Plaintiff, yet again the lecherous insurance companies and their repugnant loopholes have ensured no one gets a fair payout. I don't blame the defendant nor the plaintiff in this, they're both not at fault. The insurance companies are allowed to get away with far too much.
this was unfair for both parties but more unfair for the plaintiff .. like who wouldn’t be mad about that ? the plaintiff had literally nothing to do with the fire , at least the defendant had his car covered so this is just unfortunate for the plaintiff.

I could have been poor maintenance on the defendants part. The plaintiff got screwed on this deal. And insurance companies absolutely suck it was their customers car that caused the damage. Wrong verdict!

Thankfully I have not been in many accidents, but I believe one should always file with own insurance and let them fight the battle. I was rear-ended by a satellite TV installer years ago. I got the necessary info, no police involved, provided the info immediately to my insurance company and they went after the other insurance company.
I was glad to make use of my insurance company since I have paid a "ton" of money to them and fortunately have not had to have them work for it.
The process was smooth!!

My wife has been driving an '08 Dodge Charger SXT 3.5L V6 just like the one in this case since we got married, it's been an awesome car, all maintenance done by the owners manual though (which I do with both our cars)... 170-ish thousand miles to this date, no major complaints, and no fires lol. Probably wont get a newer one since she wants an SUV now, but will definitely miss it when it's gone.

If it's an aftermarket alarm system that could be the reason of the fire anything that was hooked up to that battery or installed incorrectly could be the reason of the fire
Plaintiff should have pursued this with defendants insurance. The liability is his car. If my brakes fail and I hit another car, I am liable. Or the fire department should have checked this further.

Come on, he had to pay 3900 out of pocket to repair a 2004 Camry? Yeah if your damages were that much on an 04 Camry, the car must be destroyed, so something is not right in the equation. Second, if that's somehow true, he should of just bought another Camry.
Second, if the defendant is responsible, the only way I can think of is he put in headlights that were not for that Dodge Charger, because it looks like the fire started at the left headlight. It cannot be a battery that went on fire, because a battery in an 2006 Dodge Charger is located in the trunk under the mat.

How is this fair! It doesn’t matter what caused the fire! It came from his car/property and that’s it. The plaintiff should of won this case and the defendant should be the one to take this up with the manufacturer and prove his own case! Feel bad for the guy
That's what confused me as well. The plaintiff does not have the charger so they have an uphill battle trying to get Dodge to pay, but the defendant has all the reports needed to get Dodge to pay for the fault.

I'd argue that it was negligent to not move the car away from the other car. He got out pretty calmly, not in any obvious panic. It's an extension of his not giving a crap about others, just like the guy that was waiting for the parking spot.
