It's too bad this video left out the most critical discussions about marriage between a foreigner and Viet with respect to assets. I know this topic well because I had to learn it on my own after trying to get help from both VN and USA attorneys. Unfortunately, I found no attorneys that understand the full picture. Let me help you all out. If you are a foreigner and you marry a Viet, whether you get a pre-nup and where you get one depends on where the marriage is registered and where the assets are or will be during a divorce. If you stay married in VN but never register the marriage in the USA and your assets are in the USA, you will be protected from VN divorce because your assets are in the USA and VN has no jurisdiction there (and vice versa). If you register the marriage to your state of residence in the USA and you get a divorce in VN, your assets are also safe from any judgment from VN courts as long as the divorce is not filed in the USA. Each state has different laws regarding requirements for divorce. For instance, some states require that you live in the state for at least 60 days prior to filing for the divorce. That would make it difficult (although doable) for your VN wife to file for divorce in the USA even though she would have no trouble getting in (since the marriage would have been registered in the USA so she would have a green card or similar). If you get a divorce in the USA, no pre-nup will save you. So, it's best to never register the marriage in the USA and stay in VN. And only bring as many assets or buy as much property in VN as you can afford to lose in divorce. You don't want to bring much to VN anyway because you can easily lose it all through fraud or bank failures since there is practically no depository bank insurance like FDIC (VN banks only insure depositors up to around $3000). You can also have a legal agreement written up for each property stating that it belongs to you in the event of a divorce if you brought the money from the USA (i.e. already had the money prior to marriage) to buy it. Pre-nups in VN are a waste of money because the attorneys are incompetent, but they charge crazy prices for anything related to foreigners. A basic pre-nup in VN will cost between $1200 and $3000, which is not a lot higher than in many places in the USA. But the USA has rule of law. VN really doesn't.

I'm Australian and 12 years ago I married a poor Vietnamese woman. When she fell pregnant I built a house just outside Saigon which was meant to be kept for the kids future. I brought her back to Australia where after 18 months she decided to divorce me and took the children. Last year she decided to try and sell the house and cut me out totally. I'm going through court in Vietnam now. I luckily have a lot of evidence of money showing I paid for everything and my lawyer seems fairly confident that things will work out OK. What a lot of people don't know is that the Vietnamese laws changed in 2014 regarding family law and particularly property ownership. Basically all assets acquired after the marriage is automatically 50/50 even if one is a foreigner. A prenuptial is definitely a good idea and would save a lot of headaches but the best idea if one wants to marry a Vietnamese is to marry one that doesn't need your money. I have a really good lawyer in Saigon. Michael

I agree with you that marriage is a terrible idea for most men especially in the west. I was able to meet an old fashioned Vietnamese woman 17 years younger than me from the countryside and we have 3 kids together. Rural Vietnam is how the US was in the 50's where you can still find old fashioned women that are feminine and traditional but all of that is changing very fast.
Community Property means in most countries that assets during marriage are divided equally between the 2 parties. However in California it means that the wife Gets the Property 😆and the husband May Live in the Community if he wants to.😢

Marriages in worldwide should have inbuilt prenuptial. Prenuptial should be not only for prior assets but also for post marriage assets. Men need those resources to move on.
In 2023, can't really blame anyone for not wanting to get married. Risks are everywhere, you might have to factor in the possibility of losing 50% of your assets if you get married. Even if you don't get married, watch out for "common law marriage" definition", if it applies or will it apply it. I've seen people considered married under the government's eyes just because they live together for a certain amount of years and/or have kids.
If the law doesn’t allow people to get married without a prenup then the problem is solved for everybody. No question asked, no embarrassment, no taboo! That way people will think twice to get married because they will find out that getting married is not that easy like getting a divorce.

Two important point, before you marry that women, 1. take a good look at her parents & silbings. 2. Does her family have non-working no income members? I had a few years my wife have been helping her family. To a point where my father in law asking us to sell our house to pay their gambling debts. He even brain wash her must help family get out of debt no matter what. Even she can divore to get $ to help family. The method I use is dragging time in infuse them i will help. Their debt ballon to a state that, selling two houses also cant pay their debt. Then my wife realised, she die also cant help. Thats when father in law family totally broke up.

I am married to VN national... we are living in VN... I bought an apartment before we married and put in her name.. as wedding gift, and for her security and our potential future children... unfortunately within a year of the marriage, showed herself to be one of the worst, most abusive materialists I have even encountered... or even heard about... so I guess the apartment I bought would be treated as pre-marital asset and the local courts would not include in the supposed 50/50 distribution.. however, during our marriage, my wife became the owner of another real estate property... so, being consistent, I assume the court WILL include that real estate as part of 50/50 distribution of assets.. would it be correct to assume that? and... we have two children... 6 and 4 years old... as I understand.. they are essentially marital "assets" and would also be divided 50/50... is that correct? My wife is Vietnamese now with US citizenship. We married legally in the US in CA first and then again with a big family and what seemed like half her town in Vietnam. I’m an American. For years I’ve asked her as to what my status is with the country. IDK if the marriage was even registered in any way there, I’ve never been able to get an answer, either she’s clueless and doesn’t know, or she’s been withholding info, I can’t quite tell. I do recall a friend of their family who wore local police or military uniform, and I think he only was an MC for the banquet, held at a local resort. We’ve lived in the US our whole marriage, and now have two children, US born. Does anyone know what my, and my kid’s status is in Vnm? I don’t have any Vnm marriage certificate record, just photos, but surely something would be searchable from the town we were married in? I suspect her family has very intentionally never recorded officially so as to ensure her inheritance assets are never in jeopardy

I saw pictures of her and she was very attractive while he was a short and average looking Vietnamese guy so it seemed suspicious to me. He gave her a phone where he installed an app that could record her calls while she was still in Vietnam. Anyone who thinks this is not equally as big of an issue in the United States is deluded. You could replace An with John and Thuy with Madison and put both in any US state and Madison would clean John's clock, with the biggest difference being they were only married two years (and not ten, which is a common cliff in the US). That might impact the division of assets but not custody. An/John can say goodbye to the kids if Thuy/Madison wants to screw him in court. His mistake was thinking with the little head and not having a prenup.

Nobody knows all the details but in general, as the foreigner and by Vietnamese law, he can’t own properties. He could have owned properties before marriage under different names and transferred to her name after married and continued acquiring more properties after and they were all under her name. I believe the latest ruling from the Vietnamese court was to split everything in half.

Don't think an American pre-nup will be helpful for property and real estate in Vietnam. The Vietnamese authorities aren't going to care about an American pre-nup.

The Vietnamese Government has unilateral power to take away any property from anyone, foreigners even more powerless compared to locals and that isnt by much. Now getting married to a local Vietnamese is almost nearly as high-risk as buying property. If your local Vietnamese wife divorces you, you can be sure ALL of your holdings will go puff in smoke. Pre-nups in Vietnam are unenforceable. Local possession is more than 9/10ths of the law in Vietnam. You as an attorney should know that if married to a local Vietnamese in Vietnam she (or even he) can still hire an attorney if thinga go sour and pursue all her rights in U.S. courts as well, after all, you have married so she gains rights as a spouse. Better re-brush up on that legal info. 😊
That is inacurrate. To be valid and enforceable, prenuptial agreements have to be notarized in both Vietnam and foreign country. Then, the agreement supersedes traditional marital regime. And, as a law firm, we not only draft prenuptial agreements but also represent clients in divorce cases, as mentioned by our Attorney in the video. Hope it helps

The Vietnamese Courts won't enforce a U.S. prenuptial. The laws are different governing these instruments, and there is also an immigration status and rights issues. If you think you are safe in Vietnam just because you are an American citizen doing business in Vietnam and then divorcing a local Viet good luck, you will need it. And if she is in any way connected to the officials, God won't even be able to help you. I have personally known of horror stories from recent Vietnamese immigrants to California who have lived all their lives in Vietnam only to be so happy their number and family reunification sponsorship was approved by USCIS after decades! Yes, you guessed it, they gave up on the unfairness of the Vietnamese "legal system". Is there a Vietnam State Bar like that found in the States? The marriage certificate should have a clause explaining the risks and potential problems for getting a divorce. The plain declaration for “better and for worst” is not enough. Easy to say not easy to do.

If you are a foreigner and you marry a Viet, whether you get a pre-nup and where you get one depends on where the marriage is registered and where the assets are or will be during a divorce. If you stay married in VN but never register the marriage in the USA and your assets are in the USA, you will be protected from VN divorce because your assets are in the USA and VN has no jurisdiction there (and vice versa).
If you register the marriage to your state of residence in the USA and you get a divorce in VN, your assets are also safe from any judgment from VN courts as long as the divorce is not filed in the USA. Each state has different laws regarding requirements for divorce. For instance, some states require that you live in the state for at least 60 days prior to filing for the divorce. That would make it difficult (although doable) for your VN wife to file for divorce in the USA even though she would have no trouble getting in (since the marriage would have been registered in the USA so she would have a green card or similar).
If you get a divorce in the USA, no pre-nup will save you. So, it's best to never register the marriage in the USA and stay in VN. And only bring as many assets or buy as much property in VN as you can afford to lose in divorce. You don't want to bring much to VN anyway because you can easily lose it all through fraud or bank failures since there is practically no depository bank insurance like FDIC (VN banks only insure depositors up to around $3000).
You can also have a legal agreement written up for each property stating that it belongs to you in the event of a divorce if you brought the money from the USA (i.e. already had the money prior to marriage) to buy it. Pre-nups in VN are a waste of money because the attorneys are incompetent, but they charge crazy prices for anything related to foreigners. A basic pre-nup in VN will cost between $1200 and $3000, which is not a lot higher than in many places in the USA. But the USA has rule of law. VN really doesn't.

I was not even able to find a US attorney who understood the full picture with regards to US law and VN law and jurisdictional issues. You will be wasting your money with Viet attorneys. I'm Australian and 12 years ago I married a poor Vietnamese woman. When she fell pregnant I built a house just outside Saigon which was meant to be kept for the kids future. I brought her back to Australia where after 18 months she decided to divorce me and took the children. Last year she decided to try and sell the house and cut me out totally. I'm going through court in Vietnam now. I luckily have a lot of evidence of money showing I paid for everything and my lawyer seems fairly confident that things will work out OK. What a lot of people don't know is that the Vietnamese laws changed in 2014 regarding family law and particularly property ownership. Basically all assets acquired after the marriage is automatically 50/50 even if one is a foreigner. A prenuptial is definitely a good idea and would save a lot of headaches but the best idea if one wants to marry a Vietnamese is to marry one that doesn't need your money. I was able to meet an old fashioned Vietnamese woman 17 years younger than me from the countryside and we have 3 kids together. Rural Vietnam is how the US was in the 50's where you can still find old fashioned women that are feminine and traditional but all of that is changing very fast.

In 2023, can't really blame anyone for not wanting to get married. Risks are everywhere, you might have to factor in the possibility of losing 50% of your assets if you get married. Even if you don't get married, watch out for "common law marriage" definition", if it applies or will it apply it. I've seen people considered married under the government's eyes just because they live together for a certain amount of years and/or have kids.
If the law doesn’t allow people to get married without a prenup then the problem is solved for everybody. No question asked, no embarrassment, no taboo! That way people will think twice to get married because they will find out that getting married is not that easy like getting a divorce.

I bought an apartment before we married and put in her name.. as wedding gift, and for her security and our potential future children... unfortunately within a year of the marriage, showed herself to be one of the worst, most abusive materialists I have even encountered... or even heard about... so I guess the apartment I bought would be treated as pre-marital asset and the local courts would not include in the supposed 50/50 distribution.. however, during our marriage, my wife became the owner of another real estate property... so, being consistent, I assume the court WILL include that real estate as part of 50/50 distribution of assets.. would it be correct to assume that? and... we have two children... 6 and 4 years old... as I understand.. they are essentially marital "assets" and would also be divided 50/50... is that correct? My wife is Vietnamese now with US citizenship. We married legally in the US in CA first and then again with a big family and what seemed like half her town in Vietnam. I’m an American. For years I’ve asked her as to what my status is with the country. IDK if the marriage was even registered in any way there, I’ve never been able to get an answer, either she’s clueless and doesn’t know, or she’s been withholding info, I can’t quite tell. I do recall a friend of their family who wore local police or military uniform, and I think he only was an MC for the banquet, held at a local resort.
We’ve lived in the US our whole marriage, and now have two children, US born.
Does anyone know what my, and my kid’s status is in Vnm? I don’t have any Vnm marriage certificate record, just photos, but surely something would be searchable from the town we were married in?

my Vietnamese wife's cousin lived in the US and went back to marry a Vietnamese woman. I saw pictures of her and she was very attractive while he was a short and average looking Vietnamese guy so it seemed suspicious to me. He gave her a phone where he installed an app that could record her calls while she was still in Vietnam. Found out she was still talking to her old boyfriend and her plan was divorce him after she got residency. Thankfully he caught that trainwreck in time.

Anyone who thinks this is not equally as big of an issue in the United States is deluded. You could replace An with John and Thuy with Madison and put both in any US state and Madison would clean John's clock, with the biggest difference being they were only married two years (and not ten, which is a common cliff in the US). That might impact the division of assets but not custody. An/John can say goodbye to the kids if Thuy/Madison wants to screw him in court. His mistake was thinking with the little head and not having a prenup.

Nobody knows all the details but in general, as the foreigner and by Vietnamese law, he can’t own properties. He could have owned properties before marriage under different names and transferred to her name after married and continued acquiring more properties after and they were all under her name. I believe the latest ruling from the Vietnamese court was to split everything in half.

Now getting married to a local Vietnamese is almost nearly as high-risk as buying property. If your local Vietnamese wife divorces you, you can be sure ALL of your holdings will go puff in smoke. Pre-nups in Vietnam are unenforceable. Local possession is more than 9/10ths of the law in Vietnam. You as an attorney should know that if married to a local Vietnamese in Vietnam she (or even he) can still hire an attorney if thinga go sour and pursue all her rights in U.S. courts as well, after all, you have married so she gains rights as a spouse.

That is inacurrate. To be valid and enforceable, prenuptial agreements have to be notarized in both Vietnam and foreign country. Then, the agreement supersedes traditional marital regime. The Vietnamese Courts won't enforce a U.S. prenuptial. The laws are different governing these instruments, and there is also an immigration status and rights issues. If you think you are safe in Vietnam just because you are an American citizen doing business in Vietnam and then divorcing a local Viet good luck, you will need it. And if she is in any way connected to the officials, God won't even be able to help you. I have personally known of horror stories from recent Vietnamese immigrants to California who have lived all their lives in Vietnam only to be so happy their number and family reunification sponsorship was approved by USCIS after decades! Yes, you guessed it, they gave up on the unfairness of the Vietnamese "legal system". Is there a Vietnam State Bar like that found in the States? If yes, are you included Ken Duong in that Vietnamese Bar Association?
The marriage certificate should have a clause explaining the risks and potential problems for getting a divorce. The plain declaration for “better and for worst” is not enough. Easy to say not easy to do.
