Sincere Condolences to those lost and impacted by this tragedy. I hope we can all learn from this. As a driver, you should be looking beyond the tracks before you even start to cross them. If there is an obstruction preventing you from clearing the tracks, do not pass the RR Crossing signal, even if the gates are not activated. It is also the law not to stop on railroad tracks (NY Vehicle & Traffic (VAT) CHAPTER 71, TITLE 7, ARTICLE 32, Section 1202 (h)). I know, in this case, that is a sharp right turn, but there is still a full car length prior to entering the crossing to make that quick assessment. This is the driver's responsibility. These accidents are totally preventable.
