  • On April 26, 1968 a 19 year old man called Paul Cohen walked into the Los Angeles County Courthouse to testify in a case for a friend. This, in and of itself, isn’t noteworthy. Why Mr. Cohen would have his name stenciled into the history books is because of something that was in turn stenciled on his jacket- the words “FUCK THE DRAFT. STOP THE WAR”. This would set off a chain of events that would change the face of Freedom of Speech in America forever.

      Freedom of speech of course only applies to the state and government. UA-cam, being a private entity, is not subject to extending the protection of the first amendment to its users or its creators, and they have every right to choose who they wish to do business with vis a vis demonetization and bans. Hooray for that. :\

      No, it isn't. There's the classic example of not having the right to yell "fire" in a crowded theater. You can't encourage another person to commit a crime. There are other restrictions. No right can be absolute, because life is not black and white, and the courts can set limits on those freedoms if they're deemed necessary.

      Fuck the "if they deem it necessary" bullshit. The exception should only be "if it doesn't overlap someone else's rights", like in the case of causing mass chaos, which leads to bodily harm. Integrity of feelings, though, isn't a right, because people's feelings can be in conflict, and it's impossible to prove.

    I do swear, from time to time, and do so to make a pronounced point. It is true that constant use of profanity dulls the sharpness of the word so when I do use colorful metaphors it REALLY makes an impression. Speaking to someone who swears several times a sentence versus someone who no one has ever heard swear cut loose the difference in reaction is, well, hilarious, and my point is made and remembered.

      I swear like a fucking sailor. Yet when I speak people listen. It is less the words you use, and more how you use them. The fact that you tend to judge people who do use swear words more often speaks highly to your intelligence. As it is proven that more intelligent people swear more often. Just saying.

      Beer Czarcofigus, Who said I didn't swear? I actually said the opposite of that. I just rarely use them. Most people see me as a grandpa so they are rather shocked when I cut loose. Now, in my early years, I cussed every other word. Age tends to give you time to think of the reactions of people a bit.

      You said it "dulls the sharpness of the word." Which is not true. Depends on the ear that hears it. Meaning you tend to judge those who curse often. As evident in how you compare those who do, with thise who don't. Or in your case "from time to time." An old man swearing at all is shocking to most. Myself not included. I don't ever hear them to be honest. They are words that carry emotion. No matter how often they are used. If you are giving the words less clout when used more often. It would be fair to say that it isn't the words you are hearing, it is your perception of the person using them.

    This is the precise reason that a bakers right to freedom of expression / speech to not make a cake for a gay couple's wedding must be protected. I say this as an atheist and I'm gay. Regardless of the Freedom of Religion aspect, this right is fundamental to us all no matter what your views are.

      just saying its a poor business model. news travels quicker and further than it ever has before, so excluding various parts of the community from your business is going to have a follow on effect. next we'll be hearing about struggling bakers dumbfounded by lack of business when their competitors are raking in the cash.

    I'm glad to see you used Oyez as a source, I was going to go right there after this for the oral arguments. I've been on a huge Supreme Court kick over the past months, ever since I first heard Radiolab's More Perfect podcast. A story from there that might make a good one for a short-form video would be the sad story of Justice Whittaker losing his mind over Baker v. Carr. Or a biographics, he seems to have led a fascinating life. Another neat one is Taft, who served not only as President, but also his dream job of Chief Justice on the Court.

    It's so sad that there are people nowadays who are willing to give up freedom of speech because their delicate feelings were hurt without any regard about what it actually means to have that freedom in the first place. This video is very befitting, especially given the circumstances we find ourselves in today. I wonder how many will learn from this video and actually rethink their position on this issue.

      Eisenhower was anti-war to. In fact a good many senior military are anti-war. They are very much in favor of being prepared though.

    On the topic of bleeping out profanities: It was in my early adulthood that I started watching t.v. and things on youtube in English. Which was the first time I heard a word being bleeped out. And the first few times I thought it was a complete joke. And I think it took me YEARS, maybe even a decade, to realise that this was some sort of actual (self-)censorship and not some half-joke that was supposed to bleep out part of an offensive word and at the same time let the bleeped out word be still recognisable. Because it's not the word "fuck" that is bleeped out. It's not for example "Who the bleep took my cake". It's "Who the f-bleep-ck took my cake."

      In America, we don't really find words offensive. It's just vowels in proximity to specific consonants that freak people out.
      You can say nAgger, even when talking about a black person.
      You can shUt the door, but don't shIt on the floor.
      You can talk to Us, but you shouldn't talk out your Ass.
      You can pAss on an opportunity, but don't pIss on anyone.
      Even pIssy is acceptable, so long as you're not talking about the keeper of your favorite pUssy.
      It's ok to kIck, just not in the cOck.
      And you can hang out on the dOck, but don't let your dIck hang out.
      For some reason, you cAn't say cUnt.
      Words such as fIx and fOx are quite popular, and fAx used to be.
      You can even say Puck, Buck, Tuck, Muck, and Yuck with no problem whatsoever. But never press your Luck and Suck and/or fuck a Duck or else the fuZZ will make a fuSS and CHuck you in a cell where they'll pack your fuDGE, and that's no fuN.
      As a whole (heh ass-a-hole), we can be pretty fucking stupid.

    This is right around the time gorge Carlin released his "seven words you can't say on TV" if not just before. I believe this may have encouraged him in his stand-up.     The end of the video had a tune similar to a ringtone. Similarly Simon was speeding up in his speech.... 🤣🤣😂

    I feel so sorry for those who live in countries without Freedom of Speech. So glad I don't live in Canada or the UK. Nothing, against either of those countries, I just like my free speech.

      +Vaughan Ware Where I live there is no free speech but this only means I can't denounce the Holocaust to have taken place (why should I?) and that I can't be overly racist in public (why would I want to?). Also I once worked in a place where all kinds of customers were served and there I wouldn't have been allowed to wear a "Fuck The Police" t-shirt. I can swear all I want in public, there are places where I could walk around literally naked and almost no-one would mind me snogging someone guy in public, lying on top of him, while there are children less than five metres away.

    I really dig the addition of "This day in history" please do not stop. That would truly be a WTF moment. I learned something that was very unexpected and somewhat surprised I had not run across this factual moment in American history. Plus I had to watch it twice just to hear Simon swear. Too funny.
