    In 1978 I built an ADU next to my mother’s house by converting the single-car garage into a bedroom, and building a hallway to another tiny bedroom, that I converted into a small kitchen. At the time it was not called an Acessory-Dwelling-Unit, it was called an “illegal rental.” But now I am guessing it has become legal? I spent $3,000 of my own money to build the ADU, and over the last 45 years it has brought in approximately $250,000 in rent.

      I am not a lawyer, but.... it is tech legal but there laws about it. From what I understand most anyone can put up an ADU without many stipulations. If you wanted to sell it there might be a bit of red tape. Maybe you need some kind of a permit for things? Just a thought

      @@susiefrades-white3088 It used to be that real-estate salesmen considered anything built without a building permit to have no value, and in addition, the buyer is required to demolish and haul away anything built without a permit.
      Nevertheless, that little illegal rental is still going, and still pulling in passive income after 45 years!

    It took four months to get my ADU approved in Chino, CA. It was built in five months but it took three months to find a credit-worthy tenant. The rental-income allows us to pay our current mortgage. It will take seven years to recoup our investment.

    I would NEVER buy a house that has a ADU owned by someone else, that I have no control over.

      A lot of people feel that way about condos too. It’s a very valid way to feel. But I’m still excited that we’re lifting this ban because my personal taste shouldn’t be the deciding factor on everybody else’s choices.

    Can politicians do anything to screw up housing? They could form some committees to investigate. After several years with no solutions, they arrive at the conclusion that they need more money and time to fix the problems. After more money and time, they realize, need more money. Politicians have been using these same games on taxpayers for years. Send more money or get rid of the politicians playing this con on taxpayers.😮😊

    A lot of ADU builds have the utilities tapped from the main dwelling. If your local jurisdiction adopted AB 1033, could you sell your ADU without having separate utilities?

    If an ADU sold, it will greatly impact the value of the main house and it’s desirability unless the lot it is on is big and the ADU is far away from the main house.

    Do lawmakers have a clue about the cost of turning a multi-family building into condos? The cost to do a condo conversion is prohibitively expensive unless one owns the property outright even there are no barriers such as shared water meters, gas meters, and electric service.

    This can be an expensive process doing a tentative parcel map, and your local city can require all kinds of extras to make it happen. For example, if you are on an alley, they may require you to add all new concrete for the alley touching your property line.

    This is overall getting better and better for California:
    Here's my take on all this living in an Jr. ADU (garage) myself for the past 7-years:
    1) The parking issues could be solved by doing what the City of Cerritos has done for years.... That's only allow 2- Overnight vehicles to be parked on the public street between the hours of roughly 10pm-5am each household having 2 overnight vehicle passes visible
    2) Being able to sell an ADU is awesome as many adult children who are married with one child can Not quality for a $700K home loan, however, \who they rent from, many times their Father or family member can sell then that ADU for $239K and both side win
    The key here is city zone codes MUST eventually allow these $69K 2-bed/2bath manufactured home to be placed in backyards and on private land.... That will truly open up things

    Would you assume that a SB9 can also be sold separately? I would assume this makes more sense than allowing to sell the ADU?
    What about utilities that are not on separate meters or situated in the main houses lot?
    Also shared pathways to the back ADU/SB9?

      You're right ! In fact, back in 2022, I made a video about how SB 9 units could theoretically be converted into condos and sold separately. But the truth is SB 9 adoption has been very slow (early days) compared to ADUs. So flipping a switch that makes ALL ADUs that are already built in California "condo-izable" is a very big shift.

      Im curious about your perspective. Do you want more government regulation of what counts as livable and what is sub standard? Bigger government, home inspections to rate how you’re living, and that kind of thing?

    The problem is while the state releases these new laws/mandates, the local municipalities don't follow them and still enforce their own laws. The state does not enforce these laws on local municipalities, so they're essentially useless depending the your city/county your property falls under.

      It’s A problem. But it’s not so hopeless. Big cities get sued and the lawsuits hurt. And a lot of places that originally fought ADUs ended up embracing them eventually because it’s a more seemly way to hit housing numbers in their eyes (once they saw a few thousand go up!)

    I built an attached ADU and a Detached ADU in Seattle, WA. We turned them into Condos. We have a Freddy Mac mortgage and we will not be able to sell the condos without first refinancing.. One plan is to use a bridge loan to pay off the Freddy Mac mortgage and then sell the ADU condos. This means giving up our low interest mortgage.

      That’s so interesting. I participated in a Freddie max survey earlier this year because they’re studying ways to improve their policies in light of ADUs and other multi unit properties.

      @@HowToADU My lawyer was fairly optimistic about them approving what she called a "Partial Reconveyance." However, I think they have started getting more of these requests and their policy response is evolving. I get it - they have told their bond holders the polices surrounding these mortgages. I am in the stage of moving from a guy who got homeowner financing and built ADUs on the property to a developer who needs to figure out how to finance these projects without utilizing owner occupied financing. Thanks for your good work!

      I can’t give advice for your specific situation. Get a lawyer for legal advice. If you’ve got tenants in there, prioritize safety and security.

    If the property taxes are 10,000 a year and the adu is sold to a new owner, does the new owner get to split the old property taxes or are the new property taxes set on just the new property owner or both owners? The old owner might (or might not) want to have property taxes recalculated on the old property.

    When you said "ADU people have had to wait up to 90 days for approval I fell out of my chair. Try an SB9. Im still not permitted and its been 21 months.

    Cities and counties didn't have the option to remove owner occupancy requirements for JADUs, correct? My understanding is that just a few localities interpreted SB 13 to apply to JADUs. Does this legislation now give them the permission to remove owner occupancy requirements for JADUs? Thanks!

      That’s an interesting question. I guess I always thought cities and counties could remove the requirement if they wanted to / or remove the enforcement by not requiring a deed restriction

    I’ve lived in the same apartment since 2018. 4 of us got kicked out of our parking spots and garages so that the landlord can make ADU’s. We lost our paid storage space as well as our paid parking spots. We already have TERRIBLE street parking which the city of Long Beach tickets $79 on for street sweeping violations TWICE a week. We already can’t go anywhere on Tuesday or Wednesday evening because we will lose our spot. Coming home in the evening is not an option twice a week, not that you’d want to anymore because crime has skyrocketed here and the police don’t show up anymore (not an exaggeration). The owner of our property has two complexes on our street so this puts 8 (at minimum) more cars on the street. When these new tenants move in you can bump that up to 12. So, thanks but no thanks on the ADU’s. Sure it’s great for people who own properties but is it great for everyone else?

      @@HowToADU I’m not sure how parking can be alleviated when ADU’s are bringing in more tenants and removing off street parking. The police situation is a county/state wide concern. I’m sure you’re aware of how crime has skyrocketed in Los Angeles County. People vote democrat here for the policies/people that are responsible for what’s happening with crime here. I personally am not one of them so watching all of this happen leaves me with a bad taste and a serious concern for where we are heading. So can anything be done about the law enforcement? Not until people wake up and start voting differently. That’s just my opinion.

    Awesome thank you for always being on top of things! I am planning to build my 2nd ADU next year and want to try this. I think 1 issue is that if you have a loan the bank has to approve it. My loan is at 2.87% interest rate I don't think the bank will approve anything without making us refinance as these low interest rates as costing them right now. Do you have a RE lawyer to recommend for this process Ryan?

    What a despicably sneaky way to automatically rezone all qualifying single family zoned lots into multifamily duplex/triplex. This will only benefit the service industry who builds, installs, and fights the legal battles. The owners who do this are going crush the total value of their property. Anyone who does this will have to create a condo association for their condo and then manage it. Who's going to manage a condo association that has only one or two units - how can the cost be profitably amortized over just one unit? This cost along with the reduction in the value of the primary residence is going to reduce the properties total property value and that of the neighborhood. The political hacks who wrote these laws very likely live in neighborhoods that will not allow ADUs,.

      I don’t think it’s particularly sneaky running for public office, spending years legislating, and rolling out laws across hundreds of cities and counties, and then making UA-cam videos about it. It’s how our constitutional democracy works. What part do you find sneaky?

    Tbh I think the ADU as a condo seems just too complicated to be worth it, I doubt they will be that much cheaper than regular condos anyways.

      I agree that most homeowners won’t condo their ADUs. But developers will love this. And Id assume that it will make cheaper primary homes and more condos at similar condo prices.

    My buddy has a 20 acre ranch would he be able to sell me a small piece of land so that I can make an ADU with this new law? Would I own the land under the ADU?

      You can own the ADU would need to do a lot split for that piece of the land. Definitely do the lot split first then build the ADU.

      @@Good-luck-Jonathan If it is a ranch it might be in an agricultural area. That brings in limits quite often. My mother owns two 20 acre farms than are adjacent to each other. If they hadn't already been 20 acre lots, only one house could be built on the 40 acres.

      Hey I’m CA, the ADU has to piggy back off the main house for things like land and utilities. So it’s pretty rare to split a lot and build an adu on the newly created empty lot. You’d generally see people use underlying zoning code to build a regular primary home. Rural land as pointed out by another commenter might have very specific needs in terms of zoning and also utilities/sewer. Talk to your local planning department and building department for more information. This is general information only and not advice for your specific situation.

      @@HowToADU It's not the single family usage per se that's the problem. It's the lack of dynamism and how it shapes social dynamics. Based on personal experience, it prevents a lot of kids from growing up into healthy adults, because it somehow sends the signal to people that living at home forever is a good thing, that the family is the only unit that matters.

    I want to build an ADU in my family's backyard and grow shrooms in it. Sounds rather appealing to me. Pretend I'm living in the woods like an outlaw and pretending to live off the land. I also like the idea that I can choose the entire floor plan and have the whole building to myself. Much cheaper than a real house, and psychologically empowering.

      Ask your lender about it. I've done 2 unit condo (duplexes) conversions in CA and the lender did not care.

      I don’t like to use the word illegal. Broadly speaking, most things can be brought up to code - but there are exceptions and there ca. be prohibitive costs

    You are great in bring us up to date on ADU & JADU laws. You went quickly on the JADU owner occupancy. I heard that JADU in 2024 the owner occupancy restriction is removed in California. In fact, certain cities do not require owner occupancy till 2025. I went to that city and confirmed that. Can you explain which are the cities or counties still have that JADU owner occupancy requirement or all counties are required to remove and comply with the CA laws? Thank you.

      What is being said is that the state is saying to cities and counties, "No, you can't ban this..." For example they are allowing duplexes on sufficiently large lots in areas zoned single family homes only.

      Broadly speaking, people build ADUs on Ag land as long as they have a primary existing home. Having said that, there can be many things that impede specific projects (septic upgrades, fire hazard zones, and Williamson act to name a few)

    I stumbled across your UA-cam channel found it to be very informative. Great work. I completed a detached ADU in Ventura County in February. It rented the first day. I'd like to build a second detached ADU but state law currently limits this. Any chance the legislature will move to allow more than one? Not interested in a JADU.

      homeless are ruining residential neighborhoods and not ADU's. You can always move out of state if it a burden but there are so many people without housing and ADUs allow people to find a place to live

    It really makes no sense to sell an ADU, it is an inflation proof source of income, that grows in value each year, and unlike an investment property across town, or in another city, it is right next to you where you can keep an eye on it. Selling it means you lose control over a property in your back or side yard, with no guarantees as to what the new owner will do with it, and you are reducing the size of your real property for a one time payment for which you will have to pay capital gains taxes, plus all of the associated costs of the sell. Better to think of that ADU as a built in retirement fund that is inflation proof, and grows in value as long as you hold it, while throwing off a nice extra monthly income.

      Good points. You usually see developers doing this in other states that allow it. Here’s an example of a Texas GC who did it: He sold this ADU for $800,000

      Santa Barbara County (and Coastal Zone) is challenging as well. No matter what the state claims, California is NOT streamlined and NOT affordable. Took 14 months to get permits, and spent approximately $22,000 in fees and assessments before even beginning a simple 800-square foot manufactured home . . .

    AB976 Does Not Remove Previous Owner Occupancy Deed Restrictions. If you built an ADU during the period of owner occupancy deed restrictions cities will not remove a deed restriction. So you're stuck w/ it!

      We have a housing shortage and too many towns have zoned everything single family home only. Heck, you can't have a corner grocery in many suburbs so you are FORCED to drive to buy a loaf of bread.

      @@HowToADU The average home owner doesn't have money to build ADU. Construction and loan cost are at an all time high and are going higher. People who have money to develop will not develop own home property. Only people who will benefit from this are people that have money to buy cash and develop with cash. Go try and get a bank loan and construction loan right now the numbers don't add up.

      @@danielcarroll3358 How will this get rid of the housing shortage? The best thing you can do is move near a store. Most of your neighbor moved there because they don't want grocery stores and commercial properties. They want a neighbor hood with yards and family's.

      I haven’t seen that work in California personally. ADUs piggyback on the infrastructure of the primary house in some ways like utilities that could require a lot of work to separate.
