    I would like to know, if I had an evaluation done by medical professionals (NP) and my case has been remanded to get another C&P exam that should be done by an MD according to the courts request. Should the NP do my C&P exam for the second time?

    Never, ever, have surgery at the Department of Veterans Affairs.

      Why? I have had multiple surgeries at different V.A. locations and have never had any problems. Just because you might have had a bad experience does not mean you have to come on social media and trash them....j/s 🤘🙏✌️

    I will... if they denied me!!! Still waiting, but have questions on 2 cases. One was denied in 1976 just a little over a year after discharge for "Nervous Conditio" before PTSD was acknowledged. The other, for hearing loss, was never denied nor rated. I was just diagnosed for it us tinnitus 2 months ago. What do you think?

      You need 3 things to get service connected.
      1) something that happened in service
      2) a current diagnosed disability
      3) a medical nexus opinion with a good rationale
      Get those 3 and you will be successful. See a good VSO for assistance. Don’t just say, “it’s in my records” ever. Point out everything.

    I was denied post-traumatic stress in 1998 but was awarded post-traumatic stress and injury on my ligament left thumb in 2019. I appealed to the board for past compensation and was denied based on the fact that I did not appeal their first decision back in 1998.

    When you have it, would you please provide the citation for this case. I have not filed an 1151 yet, because I have a new claim in for my back that I am waiting to see what the VA does with it, but my situation is so very close to the one you cited, except for me it was a pedicle screw sticking into my spinal cord and "only" 2 weeks before they went back in for a 2nd surgery to try to fix the problem versus 2 months for your client. But there have been residual issues. I will definitely consult with your firm once I get to the 1151 point if I am denied. Thank you

      You have to listen carefully. The vet that was granted had medical opinions. You will need at least one medical opinion. Having one, you will get granted at the BVA level.

      Failure to Assist and provide a diagnosis if caused worsen, and developed a medical condition from the wrong DO and or omitted actions. In this case medical assessment, diagnosis and further treatment.
      It's happened to me that's why I know.

    Rough stats on success rates at CAVC?
    Because one of my Appeals should cost VA over $300K, I will probably need to hire you whenever the Board finishes their screw-up.
    Does VA force CAVC to clean up a lot of messes, or is there any reason to trust that the Board is above such abuse?

    Hello, I've been going against the VA for nearly 40 years. I have not had any attorney help me but I do have my law degree. I have not taken the bar but I am very familiar with the procedure of getting a claim paid as well as filing an appeal. I do have an open claim that is in appeal it's been an appeal since 2017 and I'm waiting for to be reconsidered as the VA has denied it for some reason. Please let me know if there's any avenue that I may take to get this appeal expedited. Thank you, John

      To get an appeal expedited you have to be homeless, over 75, or have a fatal issue pending like late stage cancer. Forgive me if I am missing something. I suggest getting with a good VSO for assistance. American Legion VSOs are very good. If in Florida, get with FDVA. No one is better and it’s free.

    Can I send you evidence of my 1151 claim from my va medical record so you can analyze them? I have a lot including error in diagnosing atrial fibrillation, not doing a 12lead ekg, plus admission of inadequate anticoagulation and inadequate rate control from their own VA cardiologist. I don’t know where to start.

    Hey, look here! I need a lawyer. I have the VA for a clear cut malpractice & negligence but can't get a lawyer to take the case! I have my C-file & my medical records already! No one will touch it. I have a honorable discharge & multiple injuries while active duty. Please help me!

      If a lawyer won’t touch it you most likely don’t have a case. Contact a VSO they can take a look for free. America Legion VSOs are pretty good. Google one in your area.

    Have documentation of military surgery for "deviated septum" that indicates a "perforated eardrum."

      You can only be service connected for one mental condition. Name really doesn’t matter unless you want to show off. Believe some vets do.

    The VA sent me a letter last June on the 18th, saying that they were reviewing my husband's claims. I haven't heard anything from them since. It's has been almost a year now.

      You have to stay on top of it. don't wait for them to contact you. After what you feel is an acceptable amount of time has came and went, start contacting them. Keep calling until you get an answer.

      They will tell you that they have 4 months to even Start reviewing a Vets case..keep calling them!!

      Actually until a decision is made your claim is still active. You can call every other month if you would like but the answer will be the same. The bed thing to do is get a VSO that can look into your VA account and give you real honest information. I can tell you though, claims can take a long time depending on the complexity and how many vets have filed. You want a good decision not a rushed decision.

      @@MrGchild14 . . . Just as the VA is busy with those claims, those same claims are represented by overworked and understaffed VSO's. Which is why I decided to do the leg work on my last claim and it took a lot less time to go through and for me to to receive correspondence from the VA. It depends on more than just claims and number of claims. If you don't have all your evidence in order they will contact you and a hold will be put on your claim until it they receive what they need. As far contacting them, if you or a VSO waits on an overworked system to make contact, more than likely you'll be waiting a while. Everyone's claim is different and will take different amounts of time. It's definitely worth making contact with them. The worst they'll say to you is your claim is still pending and more than likely notes would have been added to your file and you'd be able to find that out. Not always the case but its worth noting.

      Just file for the condition with evidence.
      1) something happened in service
      2) diagnosed condition
      3) medical nexus with rational
      The VA will assign the closest condition to match your issue.

      @@MrGchild14 I have HH and I have seen them assign Anemia. Thats like assigning anorexia to an obese person

    The only problem i see is the board is filled with people who care about what you did for them and not what it did to you. I say to them, put the shoes on and walk in them. I bet their family members and friends didn't have those denial issues. They don't care.

      Just the opposite. The BVA or Board is made up of judges hired to grant claims under the law. They will even bend the law to help vets.
