If you are flat out using the tool in bad faith, and you can't show that you had a legitimate reason for submitting a claim, you get a Copyright Abuser strike. Three strikes and you are off the platform. That system should feel a bit more fair on both sides of the aisle.

UA-cam never knew how to handle copyright infringement cases. Instead of proper investigation I bet they just look the video upload date and glance over videos to see what looks the same. UA-camrs should be covering and fighting these cases to force UA-cam to do more research on each case they get.

How does UA-cam not have a system in place for this? How hard can it really be? I'll admit I don't know or understand how all the legal stuff here works, but why can't YT have a department of people that review these strikes and if it gets deemed as a false strike then the one that issued the original strike gets it reverted back to them as a consequence of the false strike? This, theoretically, would not only make it a much bigger decision whether you strike other creators but also shut down channels that abuse the system.
It is _extremely_ time consuming and expensive (wages.) Google does the _bare minimum_ by basically *avoiding the problem* instead of getting involved with he said, she said. Could Google do better? YES! 1. BOTH sides should be able to upload images & videos in a “rebuttal” section. 2. Assumed guilty needs to go. The current system that allows literally anyone to troll others with ZERO evidence, and the victim is ASSUMED to be guilty first and that they must prove their innocence is a HORRIBLE state because this allows for copyright trolls such as Alex to abuse the system by silencing critics. 3. Remove the 3 strikes. 4. Place penalties on those abusing the system. But thus would all take “work” so Google won’t do it.

If you look at the copyright that he filed for those videos, he literally states in the form that he filed that he claims copyright over everything, but the public domain images & any versions of them featured in his videos. He KNEW he couldn't claim copyright over those yet still acted like RT "stole" from him.

UA-cam never knew how to handle copyright infringement cases. Instead of proper investigation I bet they just look the video upload date and glance over videos to see what looks the same. UA-camrs should be covering and fighting these cases to force UA-cam to do more research on each case they get.
UA-cam isn't involved in the process at all. It's between the claimant and the person being claimed since there not allowed to give legal advice

It's unrealistic. UA-cam is *insanely* large now. It's thousands of videous each and every hour, you *never* will be able to afford proper amount of human reviewers for copyright claims.
And it's not about money! Every system that relies upon human resources in this scale unavoidably becomes corrupt. Look at some of twitch's moderation and how "fair" that is.
So you would need a veritable army of people, and smaller army to overwatch them, and some people to coordinate those.
You just won't get enough people for such positions, let alone make it all work and be affordable.
Oh, and considering INVOLVEMENT IN ANY LEGAL ACTIONS - this is basically a giant death flag for ANY corporation whos' product is a platform. It's like a suggestion to willingly cut your own finger with a kitchen knife because "well, that would be a right thing to do".

UA-cam needs to let us police ourselves a bit, but they need to do it the right way. UA-camrs like you and Charlie would be perfect for this because you're generally just calling out problems you see and trying to protect the platform for everyone. @@gadisprettydum they can do a ton about it. A lot of it- like the strikes are basically prior to an actual full legal charge. Essentially if it isn't a serious issue YT/google handles it in house.
@@gadisprettydum fraudulent claims are a huge issue. They have finally charged a few folks for me t- like a serious legal case, and iirc he ended up having to pay like 20k per false report. One issue though is that larger channels have done the same but they don't get taken down or get a strike for it, they just seem to slide by and keep dmcs trolling. Well sometimes they hit a point or the wrong person and end up taken down.
Filing a false report like that is a serious legal act, it points out on the page how serious it is, although YT/goog isn't great about it, it's another of the many issue with the system.

As someone who got this in the algorithm having never watched business casual, I can confirm he’s lying about suppression.
How does UA-cam not have a system in place for this? How hard can it really be? I'll admit I don't know or understand how all the legal stuff here works, but why can't YT have a department of people that review these strikes and if it gets deemed as a false strike then the one that issued the original strike gets it reverted back to them as a consequence of the false strike? This, theoretically, would not only make it a much bigger decision whether you strike other creators but also shut down channels that abuse the system.
It is _extremely_ time consuming and expensive (wages.) Google does the _bare minimum_ by basically *avoiding the problem* instead of getting involved with he said, she said.
Could Google do better? YES!
1. BOTH sides should be able to upload images & videos in a “rebuttal” section.
2. Assumed guilty needs to go.
The current system that allows literally anyone to troll others with ZERO evidence, and the victim is ASSUMED to be guilty first and that they must prove their innocence is a HORRIBLE state because this allows for copyright trolls such as Alex to abuse the system by silencing critics.
3. Remove the 3 strikes.
4. Place penalties on those abusing the system.
But thus would all take “work” so Google won’t do it.
