      @@AuditingBritain What I found interesting was the security guard's backtracking. You quite rightly picked up on the confident declaration that a suspect would be dragged back into the store for questioning and searching. Hence the lengthy conversation and tirade of BS that most suspects are subjected to. Only when it became apparent that you actually know your stuff did the guard start to quote the actual rules and requirements for detaining someone. The obvious conclusion - their default starting point is that nobody knows his rights. "I've been doing this for 10 years" and "Every other shop does the same thing" doesn't justify their behaviour; it just shows how they rely on the ignorance of the public and lack of education in civil rights. These videos are highly entertaining and provide valuable education at a time we need it more than ever.

      She's been doing it for ten years - and she's been doing it wrong - because nobody knows their rights, and "every other shop does the same thing". Eventually it becomes common practice that the public meekly accepts. Well done AB for the pushback.

    My friend brought a pair of shoes from supermarket and security tag still inside the shoe, he didn't see it,
    Alarm went off, He had his earphones in, listening to music so didn't hear nothing,
    Hundred yards from the Store,
    He was jumped from behind by two security guards, ended up in a fight, he was badly beaten up by 2 Nigerian security guards outside the shop in 2017,
    he claimed £39,000 compensation

    That security guard is a wannabe police officer for sure. I can Make citizens arrests. What an actual knob. Someone is just deluded and a high on power. You can only make citizens arrest if you're 100% certain a crime has been committed. And you also need to State which point of law exactly you're making a citizen's arrest for. If the person is not convicted of the same law you stated when making the citizens arrest. Is fundamentally unlawful. People think citizens arrest law is simple. It is not and 90% of citizens arrests are unlawful.
    I have no doubt he'll be applying to the police academy soon. Probably result in litigation on the first day of employment. Well done for exposing this.
    When I was 16 I went to a theme park. With two friends my one friend had a grinder on her. Nothing in it and nothing else on her. The security guard refused to let all three of us leave said we were all detained until police arrived. None of us could leave and accused us all of being drug dealers. They said they had the right to search me and my two friends despite them both being girls and both search by men. We explained to the security guard grinders aren't illegal. They just left and said shut up drug dealer. Police arrived, confiscated the grinder and went on their way.
    However, because they were bitter they won't let us into the park and said we breached the terms and conditions of bringing contraband items in. Subsequently took legal action and got a great deal of money. Ironically, got a lot of free tickets to other resorts owned by the same company.
    As much as the security guard may think they're untouchable. They are not. Great video. Very different to your usual content so quite refreshing to see. 😂😂😂❤

    I walked out of shop in Hobart and two security guys asked me to come back into the store. I knew I'd done nothing wrong so told them no bugger off. They followed me onto a bus while one talked to police. I got off at my stop and kept walking with them following me and soon the two cops ran up behind me asked me to get into their car. Now I was really pissed off, they took me and the two shop security guys back to the store. They searched my bag and found nothing from that store and eventually one of the cops apologised, but I got no apology from the store. Was pretty embarrassing and highly annoying.

Like what's your plan if you have something they stock and no receipt? I'm enough of a git I'd challenge them to prove the accusation with CCTV and/or description of exactly what they think they saw and what exactly they think I stole with store manager present.
      I had a run in with store security that were convinced CCTV had me lifting something. When police showed up I consented to them searching and they found nothing so security tried to claim I must have ditched it...where exactly I did that is anyone's guess. Police reviewed the CCTV they had and quickly figured out the muppets had been to keen scrubbing through footage. Person walking right in front of me was the thief and the idiots let them walk straight out the door. Similar experience for apologies too. PSNI were very apologetic, the store and idiot security not so much.

    They're not allowed to search; they have to hold you until the police arrive. If they hold you and the police come, search and find nothing on you, then you can charge them with false imprisonment.

      In Australia, the police are called regardless the price of the items and it's up to the discretion of the business.
      They're still not allowed to search you though.
      We also have these signs on entrances of shopping centres saying that "It is a condition of entry that staff are allowed to check your bags." This gives some of the staff a massive, big head, some staff really don't care.

    He is in the wrong job 🤷🏻‍♂️ security can technically do a citizen arrest as long as they are 100% sure a theft has occurred BUT security need consent to search the bag, they have no power to search a bag using force.

      The Police and CPS usually hate anyone doing a Citizen's Arrest because there are parts of the law that are so vague, ie what is reasonable force. It has meant that several prosecutions when a Citizen's Arrest was used have been dismissed.
      The official advice from the SIA themselves is to observe and report.

    In the UK, store staff can detain someone if they reasonably suspect shoplifting, but they cannot search them. If the alarm goes off when someone exits, staff can:
    1. Politely ask the person to return to the store
    2. Explain the reason for the detention (alarm activation)
    3. Ask to see their bag or purchases
    4. Check receipts or proof of purchase
    However, staff:
    1. Cannot search the person or their belongings without consent
    2. Cannot use force or threats to detain someone
    3. Must call the police if they suspect theft or if the person refuses to cooperate

    I walked out of Tesco a while ago and the alarm went off, a security guard stood in front of me and said he needs to see in my bag, I said you absolutely don't and stepped around him and carried on walking, they have no powers of detention or search. After i've paid and walked past the tils, it's my property.
    I researched all this a while ago, it didn't take long to find the information, and i'm not even a security guard, how can an entire staff of security be so completely ignorant of the law?

      @@the_honeybadgers unfortunately you are wrong. Outside (in a public street) no problem. But inside a private premises then prior permission should be obtained for various reasons. Employees may not want to be filmed and certainly customers of the business, particularly children, have a right to privacy in such an enviroment.

      @@neilhartland8694 No, you are wrong. The property is private but with the expectation that any member of the public can enter the commercial premises. As soon as you enter the private premises you must adhere to any signage or employee requests. If you disagree with their requests, you don't enter or can just leave. If there is no specific signage, it is reasonable to assume it is allowed. As a street photographer of 10 years, i'm well versed in these aspects.

I also work in media (all be it tourism) and I can assure you that you have to obtain permission to film (in these types of scenarios) in or on private premises whether there's signage or not. The main reason is the privacy of employees in their place of work and the privacy of customers, particularly children especially if the footage is intended to be put out in the public domain.

      @Heyok-vx7yf not according to Google. Its stated that the person making the citizens arrest needs to have reasonable grounds to suspect an indictable offence has taken place. They do not need to have witnessed the crime

      @@nocommentukthey cannot search but they can arrest and wait for the police to search them. As long as they have a good reason to suspect that somebody has committed an offence and is likely to leave before a constable can intervene.
      It’s in the police and criminal evidence act, section 24A.

    I’m a security guard in Tesco and u gotta c the person conceal item and they have to leave the store,then you ask to come in back room while phone police for them to search them.if they don’t see you conceal the item they have no legal right or power to search ur bag 💯👍

If a member of the public or an employee gets injured, the Company is liable for that injury so although a Citizens arrest can be made should a crime be witnessed, the risk lies with the Company employing the staff member.

      @@AuditingBritain Doesn't 'detaining' constitute an assault? I've been in this situation, I was grabbed when the alarm went off when I left a shop - I wasn't the only person leaving. I had nothing at all, no bags or anything and I told the security guard he was assaulting me and I would defend myself if he didn't let go. He did.

    100% they are NOT legally allowed to search anyone without their consent. All they are allowed to do is if they suspect you're shoplifting is hold you there until the police arrive who are the only people who have the 'power' to search. SPORTS DIRECT staff are misinformed. And that security guards is as thick as two short planks stuck together with stupid glue !
    The security tag door alarms DO NOT give a shop the power to search you, its only there to indicate to them that a tag has possibly left the store and nothing more.

That is the point he is making. Without witnessing the person placing the items in their bag, they do not have reasonable grounds. It’s the law, it’s quite straightforward.

    The alarms alerting to theft has nothing to do with being able to grab people lmao, the alarms help deter theft, and also alert staff that something may have been stolen and to check CCTV and make a report.

    I have spent thousands of pounds in my local sports direct store over the years but I will not go there ever again as I bought a pair of trainers but they squeaked when I walked in them so I took them back after a week and the manager said he wasn’t prepared to take them back
