    • @MrAndrewFarrow
      @MrAndrewFarrow 7 місяців тому +1

      Trespass is a civil matter under Common Law.
      The police are agents of the owner, the PCC.
      Under Common Law the agent of the owner may use reasonable force to remove you.
      We all know that by now.

    • @garethwood3474
      @garethwood3474 7 місяців тому +3

      Just a question , how does that work when the police technically cannot intervene in a civil trespass matter and reasonable force is a subjective matter. This from the police themselves"Trespass to land in most instances is a civil matter, and as such the police do not have the power to assist. Initially, the landowner should ask the trespasser to leave the land and if he/she does then all is well. If he/she refuses to leave the land then you will need to consider taking civil action. It could be dangerous for the landowner to try to remove the trespasser themselves.
      The owner of the land could commit several criminal offences if he forcibly removes the trespasser and his/her property from the land. The best and safest course of action is to obtain a court order, which, if breached, can then become a criminal matter.
      If the police do attend an incident such as this, they are merely there as observers for any possible criminal offences committed by either party. The police cannot assist in the removal of the trespassers or their property from the land in question" Again I'm just interested how it should really be done so all the possible legal problems are covered.

      @@ChristianAkacro You make my point for me... you might think you had implicit permission to cross my yard to knock on my front door, but if I answered my door and told you I wanted you off my property I'm pretty sure you'd comply, rather than stand there and tell me you've still got access.

    • @ChristianAkacro
      @ChristianAkacro 7 місяців тому +1

      @@Paul2377 No, legally speaking, I did have implicit permission. Also, right of access laws work differently in the UK than they do in North America. Public footpaths (in the UK) *cannot* be made into restricted access areas, regardless if the land they're on is privately owned. Publicly owned land is all implicitly open to the public unless there's a sign, barrier, or fence that indicates otherwise. That was ABs point in the video. It can't just be whimsically decreed as restricted by any random public servant that happens upon you while you're on public land in a publicly accessible area.

    standards of police training have changed a lot apparently over the years. at one point it used to be drilled in to recruits in training what public and public place was and the difference between the two, the reason being that the ordinary officer on the street would be unable to do the basics of his/her job if they didnt know fully the difference. it may well be worth asking some officers at some point if they can describe what the difference between the two actauly are...i bet the vast majority cant even tell you the difference...if they cant then why?
