The Okaloosa County Sheriff held a news conference Thursday and releasing body camera footage of the shooting that killed Roger Fortson, a 23-year-old U.S. airman. A Florida sheriff's deputy shot and killed Fortson in his home in Hurlburt Field last week.

There is protocol and trust the federal government is involved.
It’s a joint jurisdiction. So the feds may well review, but the state takes immediate action and will often work jointly. After the feds see the video, however, they likely will decline since it’s a lawful, but unfortunate shoot.

@@03Mills I did that for 30 years; put cops in jail too, and never regretted a second of it. This case is unfortunate, but officers are not required to wait for a suspect to show “intent.” If so, all cops would lose every time. Their actions are to be judged by experienced law enforcement officers applying the law. Most civilians have no idea how the process works, but it is never reasonable to bring a gun- in your hand- when responding to an officer at your door. Ever. If the airman had malicious intent, the officer would have never stood a chance. And that’s precisely why they are not required to wait for intent or some special rule like a drawn gun, pointing, let alone shooting.

that's what i am trying to understand also. i did not get the reason the police were called. it was not really audible. but it sounded like something trivial like someone heard an argument in that apartment. and by the looks of it the caller was afraid since a guy with dark skin lives there and that violence somehow is involved. even the cop has that impression because he asked at least twice if "they were fighting."

when you read the actual details, the woman was just one of several people reporting second hand info. This wasnt just some karen saying something, the issue is there was no specific person who actually heard anything, just people saying what they were told had been heard.

You may be a vet, but you’re not a cop. You don’t know the law, and that airman while justified to own and have a gun, exhibited horrible judgment bringing that gun to the door when he knew it was an officer at the door! Officers aren’t required to wait for a suspect to “raise the gun” or be shot at to defend themselves; if they were, officers would be getting killed at exponentially higher rates. I too am a veteran in the Army, a former special operator, and a retired career law enforcement officer. That airman’s actions were technically legal, but terribly foolish. He caused the shooting, terrible as it is. Being in the Air Force doesn’t qualify you to make the assessments you did.

@@sharker1935you're assuming that he knew that it was a police officer at the door. Although it's understandably for his protection, the officer knocked then stepped away from the peep hole multiple times preventing the person answering the door to get visible verification of who was actually knocking. Also I don't believe there was any assessment of the situation upon the door opening. Door opens, see gun shoot. The question is, was there an order given that the Airman had a chance to comply to? As far as the judgement of the Airman, it's Florida, being in possession of a firearm doesn't make you an automatic threat, the way you handle it does.

Anyways I am a trained LEO and you need intent, before you decide to fire your weapon, the Airman didn’t point the weapon at the officer and the officer didn’t even give him a chance to drop his firearm. He just said “step back” and as soon as he saw the weapon he fired on him.
Edit: I am also a veteran and we were also taught this in rules of engagement. You can’t just shoot someone walking up to you with an Ak47 pointed at the ground, they have to fire the weapon, point it at you or someone else before you can take action.
@@sharker1935how do you know he knew it was an officer? The airman was on a FaceTime call at the time and the person he was talking to said that the Airman didn’t know who was at the door and didn’t hear him say “Sheriff’s Department” just the loud knocking.
He didn’t cover the peep hole? He didn’t, but he moved to the side of the door. Thus, he did hide himself. Additionally, the airmen didn’t point the gun either. The cops just shot em without any real time to react. This is why you never open the door for cops, let them get a warrant smh

At that close range, it would be dumb for the cop to wait for the gun to be pointed towards him. Also cops move sideways to avoid being in path of fire... They call it the fatal funnel. The only mistake the officer made was that his first two knocks, he didn't announce himself. At that point the guy probably went to the peephole and doesn't see anyone... In the video you also hear the apartment owner say something (possibly asking who it was) and the officer doesn't reply. There's a pause, at this point, the guy probably goes into his apartment to get his gun and doesn't hear the officer announce himself on the last two knocks.
yea, while i do believe the cop did not have to shoot and just overreacted, i agree with the dynamics of what you wrote. i noticed the timing of knocks also. first, he knocked (twice) , no announcement, moved to the side (twice). on each occasion i am sure any reasonable person inside would not have seen who was knocking through the peephole in the interval of each set of knocks.
by the the 3rd knock (this time with an announcement), he (the tenant) must have already been suspicious and went to find his gun inside which meant he would not have heard the announcement with the third knock. "the rest is history."
on a personal note, this kind of police culture is just sloppy. too many americans are just dying prematurely in seconds of interacting with cops. we need more intelligent AND HUMAN cops out there. the cop could have been more patient, wait for backup, etc. anything to approach the situation more calmly. but this cop appears to just have been convinced that what he was told must have been 100% factual, which was not the case. and this is another issue in and of itself.
so (sigh), there has to be a better way. even if there was some argument in that apartment, that would have been a counseling issue, not a criminal justice issue. american cops are called on for way too many issues that they are NOT qualified to handle. not only that, many cops themselves come from unhealthy or dysfunctional familial situations, so many of them just do not have the appropriate temperament to walk around with a loaded gun all day.

I saw the video. Did the air man actually raise the pistol or keep it at his side. It appears the deputy saw a pistol and just fired.

no warrant needed. cop was called for a DV call and that’s probable cause…plus, fortson opened the door on his own.

He had no justification even knocking on the guys door. Although that alone isn't a crime, courts have already ruled that the mere presence of gun isn't sufficient for the use deadly force. If this department isn't completely corrupt, the cop should be spending many years behind bars.

If this can happen to a servicemember of the military at his own residence and practicing his constitutional right to bear arms, this can happen to anyone. We the people means nothing if our constitutional rights are violated daily and goes unpunished. This was an innocent man serving his country and he was murdered by police and all they can say is it was a "mistake", how disgusting! End qualified immunity!
First off, nobody but the hack girlfriend attorney said there was a mistake. Second, the constitution allows you to keep and bear arms; not brandish them when confronted by law enforcement. Thirdly, Stand Your Ground applies to being robbed, not lawful encounters by police. In short, Don’t bring a gun in your hand when an officer knocks. His death, while unfortunate, is totally on him for using terrible judgment.

You can hear the airman right after the deputy knocks the first time something to the effect “… police…”. To me it sounded like “you called the police?” As if he was confronting his girlfriend as to why she called. But I don’t have the actual, and can’t say. I can say, “police” is definitely discernible. You will have to google it since I can’t access it in my phone, but Okaloosa Sheriff’s Office posted it.

So lets look at the limited facts,and i say facts meaning what we are being told, shown in this video, or lack of. The occupant didn't call the cops, someone else did and doesnt give a clear reason why they were called, so the cop was working off presumption and building a scenario as he walked to the victims door. Thats not facts for the cop to work on. So when he knocked on the door and lets say what we can hear is real, how does the victim know for certain that the person knocking on the door is a cop,could be someone messing about in the victims mind. So for all you say he shouldn't of answered the door with a firearm, if what we are being told is true, and that is his right to protect himself in his home, then tell me this why should this officer giving this conference infront of cameras and people he knows will be attending, who pose no threat, feel the need to have his side arm. Im from the Uk so it doesn't add up to me, i feel this poor man has lost his life for unjustified reasons.

The officer didn't need to block the peephole when he stepped out of way and prevented himself from being observed by a civilian. The officer stood outside the door for 20 seconds before knocking. He could hear, just like the rest of us, that there was no fight taking place. And, to be clear, a citizen is absolutely, 100% allowed to answer their door with a firearm, even with a police officer present. This is not a crime in any state, it is not a federal crime, it is enshrined in the 2nd Amendment, and in Florida it is explicitly protected by Florida law and the Castle Doctrine.

It's no defense to say the officer announced themselves, even if they shouted it. It is unreasonable to expect a person to hear clearly through a metal door. This is the acorn shooting department, where they hire jumpy cops and give them poor training. This officer deserves prison time.
The Former Sheriff Deputy is still Alive. That Young US Airman is Deceased.
This investigation should be conducted by military officers...
A couple issues with this case: 1 - there is an assumption that the Airman was at the front of the house and or didn’t have anything playing in the house, or earbuds in and heard the initial call out. 2- Due to the time between the second call out and the door opening, it’s safe to assume the second call out was heard but the officer moved out of the way of the peep hole so it actually being a sheriff couldn’t be confirmed via the peep hole. 3- if the officer felt safe enough to command him to step back he could have commanded him to drop the gun. You can’t argue that you felt fear for your life only after he stepped back on your command. There was no pointing or lifting of the gun that I can make out to justify then shooting. Cops have tough jobs, and it appears that the cop maybe didn’t see the gun initially and when he did he freaked out. So unfortunate and I feel sorry for that family.
Let's also remember that the cop lacked any type of warrant and the Airman was under no obligation to open his door for anyone.

@@EH-ro8dn None whatsoever. He didn't threaten the cop or point the gun at him. Courts have already established that the mere presence of a gun is insufficient justification to use deadly force. If a citizen had done what the cop did, would there be any question about his guilt?
You can’t just shoot someone for holding a gun
Questions for the lying sheriff, why did you let Deputy Barney Fife carry a loaded weapon? Why more than one bullet in his pocket?
The deputy failed to follow protocol answers departmental procedures. He's toast, on his merry way to jail.

Step back is not the same as drop your gun. You can't be shooting then telling a guy afterwards to drop his gun. He didn't point the gun at the cops.

he should have never answered the door. that officer shot first without thinking. there was just no reason for police to be called on the first place. by the way, why was the camera turned away from the screen ??

(A.) The Airman's finger was "off" the trigger as he holds his hand up as to not seek any confrontation
(B.) Upon the officer arriving, there were no sounds of any disturbance.

Again, the Airman’s finger was “off” the trigger with his hand up. Additional video will corroborate the Airman’s stance.
The audio log would be a key to this incident as we’re sure the defense will subpoena the log
During the entire time there were not any sounds from the unit and entire complex.
* As a side note, there appears to be a movement whereby people are calling the police stating that there is a commotion and/or argument; disturbance to entrap the person they dislike. The people know how to get the police to arrive somewhat quickly. There should be prior communication with those adjoined to the problem area before moving in with weapons drawn.

The officer Did Not announce himself when he first banged on the door.
Yelling and demanding that the door be opened is not the best way to approach a situation like this.
Remember, he was still on the phone with his girlfriend, her phone captured some of the conversation and Roger stating he didn't have the gun to put it down, which shows. In the video as he falls to the floor, saying he couldn't breathe and an officer saying the Ems is on the way man😢

Ok I have saw the body camera. The cop didn't even say put down the gun before started shooting. This needs to be forwarded to a federal court reviewing not just the cop but the police chief too. Something ain't right here

The man was on the phone saying what sounded something like "banging on the door, like the damn police" when the deputy knocked again, he probably walked into his room to grab his pistol and didnt hear sherrifs office. The gun was pointed at the ground when the door was opened and the cop was standing at the rail, which left him zero cover. There are several different things that were wrong with this whole situation

Yes he did. He clearly stated the Deputy announced he was the police, he did not covet the peep hole and the Deputy did not burst through the guy’s apartment door. All of that is also backed up by the bodycam footage.
@@SavedByTheBloodOfJesus777 The deputy also swayed from side to side, avoiding the peep hole. The deputy, for some strange reason, waited before firing, asking him to "back up" first. The reaction to shoot must have come from not noticing the firearm at first, and then after noticing it, he fired. If that is true, then why immediately fire after such a long pause. It's not like the airmen was pointing the handgun directly at the officer. Is it standard operating procedure to avoid being seen by the peep hole and is it also standard operating procedure to immediately draw on someone with a weapon and mag dump them without first giving demand to drop that weapon. I am also curious what took place during the cut segments of the video. Was the original police call placed because he was simply playing video games too loud. I can give the deputy the benefit of the doubt, but I can do the same for the airmen. I would say it was at the very least negligent to knock and then hide out of view of the peep hole. I can also say that after multiple break ins in both Florida and Texas where armed robbers would knock and pretend to be police it would be wise to be leary of someone knocking and hiding claiming to be police. Strange.
@@doomguy8447At that close range, it would be dumb for the cop to wait for the gun to be pointed towards him. Also cops move off doorways to avoid being in path of fire... They call it the fatal funnel. Lots of videos of cops being killed by standing directly in front of the door. The only mistake the officer made was that his first two knocks, he didn't announce himself. At that point the guy probably went to the peephole and doesn't see anyone... In the video you also hear the apartment owner say something (possibly asking who it was) and the officer doesn't reply. There's a pause, at this point, the guy probably goes into his apartment to get his gun and doesn't hear the officer announce himself on the last two knocks. Also it looks like there was a pause before the officer shoots (most likely officer didn't notice the gun and upon seeing the gun, draws and shoots).

When police training gets people killed that training needs to be revised. I don't believe the officer had any ill intent but this whole thing reeks of incompetence at best and negligence at wors
