I had this happen when I first got denied for sleep apnea. A positive finding was listed from the C&P examiner, saying it was related to service,but the claim got denied. I was gonna try it as a secondary to sinusitis next. Within a month of getting the initial denial, it somehow got opened back up and then I got awarded the sleep apnea claim. Not sure what triggered that, maybe a random check on files and I happened to be one that got looked at.

Its a stressful process. I've been dealing with VA disability process since 1998. Im currently at 90% with 2 claims pending since November/December of last yr. I also hired a attorney back in 2021 thinking the process would b less stressful but it's not. U have to b patient with this process no matter what

great video, my lawyer said the same thing, they denied anxiety and depression even with prescribed medication for panic attacks, written on the label, but in the favorable findings and from my STRs vba conceded "nervousness". process is madness

They denied me for sleep apnea. In my favorable findings, they acknowledged that I had it and used a cpap. Also that I was in Iraq and had toxic exposure. In the description, they told me why they denied it but also stated that it would've been rewarded secondary to ptsd with nightmares. At the time, my ptsd claim hadn't gone through, but as soon as it did, I filed a supplemental claim for sleep apnea secondary to ptsd. I'm hoping it goes through this time. I believe this is an example of how you can use your favorable findings to your advantage. The process can be stressful because you know the things you're dealing with are from service but you have to go through multiple attempts to get it service connected even when you think you have the evidence to show it. Favorable findings is only saying that you have sleep apnea but where does it fall under the five ways of service connection and does it meet that criteria. Also, if you had a C & P exam, when you submitted a FOIA request to get the C & P exam why did the examiner say no. My favorable findings were different. I was diagnosed with migraines to include migraine variance by my examiner. Evidence shows that I perform service in Southwest Asia. Theater operations exposing me to environmental hazards to include burn pits. I'm going through the appeal process now. Which just blows my mind.

In the decision letter granting my osa claim it states in the “Reason For Decision” ( though not listed as “Favorable findings”) they did state that “OSA is an independent risk factor for cardiovascular and cerebrovascular diseases.”

Put in for increase for my lower back, legs and feet. My C&P exam did not go will I don't think. Totally different from the first one I had. From the start the doctor wouldn't answer any of my questions, got ether I can't answer that, or I don't know. He was using a computer and typing as he was doing the exam. I ask if the form he was using was a BDQ, he said he had no idea what a BDQ was. I ask how long he had been doing C&P for VA he said 4 year. He started checking my feet, wouldn't listen when I was telling him what he was doing was hurting me badly his commit was I'll get over it. Same when checking my knees. When doing my back keep telling me you can bend over more you need to do more, finely I said no more you're hurting me. At the end of the exam, I told him he had hurt me he turn around going out the door and said that he didn't do that. The exam took maybe 13 minutes and him working on the computer took up the other time about 25 minutes. What really got me was he didn't ask one question about any of my pain that I was having. I walk out in so much pain I had to stop 3 times before getting back to my truck. Should I report this to VA or wait until after the C&P finding comes out.
Im really sorry you had to go through that. Seems completely unacceptable. Was this through the VA or an outside source? Honestly I would recommend getting an accredited VA lawyer. They are going to take some of your back pay, but they will go to bat for you and can represent you in challenging this exam. I don’t know the full ins and outs so if anyone can add to this please!
My examiner lied for my ankle increase.. didn't do any ROM test.. I just went to my VA Podiatrist told them I was concerned about my Ankle Rom.. had them take a Rom a with a goniometer and i submitted thst as a supplemental

Decision under 38 CFR at 3.104 subsection C. The DRO has the authority to overturn an initial denial of benefits, but can’t overrule any favorable decisions that were previously made on your case. 38 CFR 3.104 Just reading this CFR does it mean the favorable find is more powerful than decision because it cannot be changed unless an error? This is literally what happened to me… I filed for chest pain due to my open burn pit exposure and other toxins in Kuwait and Iraq. I’ve done every c&p and ekg and still denied but favorable findings was herniated collapsed wall. Second denial is my low back strain from ruck marching and un even terrain. Denied but favorable findings is low back strain. Says it does not relate to service but this was a secondary to my buckling knees… It has me frustrated.
For the back, if it's not documented, the VA looks at it like it didn't happen. I discuss favorable findings in the video and how it can be misleading to veterans. This was what I got "The issue of flatfoot, bilateral was returned for correction of a duty to assist error in the prior decision. We failed to get private medical records. We will develop for private medical records... Favorable Findings identified in this decision: You have been diagnosed with a disability. Private treatment records,Metropolitan Podiatry Center, dated October 5, 2023, shows a diagnosis of flat feet and posterior tibial tendonitis in both feet"
If you said you obtained treatment somewhere, you just added months on your claim when you could have went out and obtained those records. You didn't mention where this condition falls under the 5 ways of service connection. I am a gulf war veteran (1995-2008) and was denied service connection for cervical spine condition but in favorable findings I was diagnosed for cervical strain and designated TERA while I was deployed in Bahrain. Does the Pact Act under the Gulf War Illness in Southeast Asia apply for muscle and joint pain presumptive Dx? I submitted a supplemental claim to my denial for that reason Pact Act presumptive dx due to a muscle and joint pain dx and have been ill for over six months
Where does that condition fall under the five ways of service connection. Also, you can find all the new conditions under the PACT Act on the VA's website. Also, the VA has a list of conditions for Gulf War in their 38CFR.
Dewayne, Please address the following. I just saw a video from a well known law firm that specializes in VA Disability claims state that new increase claim filers must use the 520 EZ and if an increase claim was filed previously (for the condition) that filers must use the supplemental form, but what if a veteran is in a situation like my situation? In 2010, I was VA Disability rated at 80%. In 2023, a 30-year VA rater, at my regional office recommended that I allow them to submit for increases (on my behalf) considering that I never filed for an increases in 13 years. I agreed, but later contacted the VA and requested that VA withdraw the increase claim. Why? Because I saw several of your videos mentioning that veteran's should never submit for increases without current medical evidence. (Fast forward to today)...I now have current medical evidence, etc, and I'm ready to properly submit an increase claim; however, the law firm's statement induced concerns. Question: Considering the above scenrio, do I submit for an increases on a 520 EZ or supplemental form? Technically, I previously submitted an increase claim; however, techically, I didn't because I withdrew the claim and didn't fully go through the claims process. Note 1: I received notifications for C&P exams but quickly canceled them, properly notified VA, and submitted a form for VA to withdraw the claim. Note 2: After VA withdrew the claim, the VA listed the withdrawn claim (under my VA claim's history area) as a decided claim with a decision letter; however, there is/was no decision letter attached. I am so confused and this challenge is holding me up from submitting the claim. Do you have any videos that addresse situations like this situation? Thank you in advance for responding.

I have a question, pertaining to Agent Orange while on "Patrol in 1971 with the Marines (I was a Corpsma n) we got sprayed with the Orange and at the time didn't think too much about it but I have developed a heart condition in the middle valve and VA has been thinking of surgery.. If "any findings favorable to the claimant...is binding on all subsequent agency of original jurisdiction," and I have a favorable finding from an HLR that says, "The claimed primary disability is service-connected," does this mean the denial will be overturned?

@@DewayneKimble I filed for GERD and was denied. The denial letter said “The evidence does not show an event, disease or injury in service. (38 CFR 3.303, 38 CFR 3.304). Your service treatment records do not contain complaints, treatment, or diagnosis for this condition. There is no basis in the available evidence of record to establish service connection for GERD.” I file for a HLR w/informal conference where I pointed out in my STR that there were complaints and treatment for GERD. After the HLR I received a decision letter that says, “A duty to assist error has been identified during the higher-level review for GERD…We failed to get an examination(s) and/or medical opinion(s). We will develop for a VA opinion.” Under favorable findings it says, You have been diagnosed with a disability; evidence shows a diagnosis of GERD. The claimed primary disability is service-connected.” My question is, does this mean the original denial will be overturned and I will be service connected for GERD?

After the conference I received a decision letter that said “A duty to assist error has been identified during the higher level review for GERD.” And “The issue of GERD was returned for correction of a duty to assist error in the prior decision. We failed to get an examination(s) and/or medical opinion(s). We will develop for a VA opinion Examination. Under Favorable Findings it says “the claimed primary disability is service-connected. You reported symptoms of acid reflux while on active duty.” Does this mean the original denial has been overturned?
Applied for tdiu and was denied x2. Favorable Findings listed were all of my SC disabilities x2. I don't know how "correct" the claim and I haven't heard back from claims officer. I'm at 90% on SSD, can't work because of my SCD. I went out on dbl for mastectomy, was cleared to go back to work with restrictions that I could not do in MY job or any job in the hospital or basically anywhere else.The restrictions were because of my SCD

@@DewayneKimble the C&P examiner for TDIU evaluated my SCD and there apparently was no change. Going to file FOIA for report because VAMC says they do not have the C&P in my records. They get a copy, but didn't want to give it to me even though I filled out a record release. I was told by 3 different ppl they don't get those reports. I will have to call to get the form that tou speak of

Just got my letter today for lower back and right side reliopathy and sleep apnea all denied for SC because I have nothing in my records. The c&p diagnose with the back problems and my sleep study shows I have severe sleep apnea

Your message is a great message that got my attention; however, it's also a little confusing😊. You stated, "....all denied for SC because I have nothing in my service records", then later stated that the C&P diagnosed with back problems. Are you saying that you were denied because radiculopathy wasn't in your service records due to the type of claim filed? It's not clear if you filed a direct radiculopathy claim or secondary claim. Also I assume that your statement that the C&P diagnosed with back problems was the favorable findings in your denial letter. Is that correct?
Direct needs STR proof. So if there are no complaints OR treatment in service, the connection is not established, hence your favorable finding but denial. The letter should tell you what prevented the grant.

@@DewayneKimble Dewayne you've provided a plethora of products (free, paid-for, and a hybrid mixture of both) for veterans to get educated. Great people like youself provide the plan/roadmap, but at the end day, veterans must DESIRE to learn and EXECUTE the plan. You Sir are like a Walmart because you fill the shelves with product variety, advertise the products, and open the doors for people/veterans to purchase the products; however, what occurs after product purchase is COMPLETELY determined by the purchaser/veteran. I don't how many more ways that you can plead with veterans to "Get Educated", (which begins with the plan, products, and product-availabilty that you've provided), and purchasing the products by veterans. However, product-purchase without self-motivation and strategic execution is akin to purchasing a new TV from Walmart and never removing it from to box🤔. Keep doing what you do! It does make a difference. While it's desirable for all to optimally benefit, some simply won't.

I am a gulf war veteran (1995-2008) and was denied service connection for cervical spine condition but in favorable findings I was diagnosed for cervical strain and designated TERA while I was deployed in Bahrain. Does the Pact Act under the Gulf War Illness in Southeast Asia apply for muscle and joint pain presumptive Dx? I submitted a supplemental claim to my denial for that reason Pact Act presumptive dx due to a muscle and joint pain dx and have been ill for over six months
Where does that condition fall under the five ways of service connection. Also, you can find all the new conditions under the PACT Act on the VA's website. Also, the VA has a list of conditions for Gulf War in their 38CFR.

I had this happen when I first got denied for sleep apnea. A positive finding was listed from the C&P examiner, saying it was related to service,but the claim got denied. I was gonna try it as a secondary to sinusitis next. Within a month of getting the initial denial, it somehow got opened back up and then I got awarded the sleep apnea claim. Not sure what triggered that, maybe a random check on files and I happened to be one that got looked at.
The QRT could have pulled it for a random quality review. Stay in the fight.

Its a stressful process. I've been dealing with VA disability process since 1998. Im currently at 90% with 2 claims pending since November/December of last yr. I also hired a attorney back in 2021 thinking the process would b less stressful but it's not. U have to b patient with this process no matter what

They denied me for sleep apnea. In my favorable findings, they acknowledged that I had it and used a cpap. Also that I was in Iraq and had toxic exposure. In the description, they told me why they denied it but also stated that it would've been rewarded secondary to ptsd with nightmares. At the time, my ptsd claim hadn't gone through, but as soon as it did, I filed a supplemental claim for sleep apnea secondary to ptsd. I'm hoping it goes through this time. I believe this is an example of how you can use your favorable findings to your advantage. The process can be stressful because you know the things you're dealing with are from service but you have to go through multiple attempts to get it service connected even when you think you have the evidence to show it. Hang in there, Vets and keep trying!
Favorable findings is only saying that you have sleep apnea but where does it fall under the five ways of service connection and does it meet that criteria. Also, if you had a C & P exam, when you submitted a FOIA request to get the C & P exam why did the examiner say no. My favorable findings were different. I was diagnosed with migraines to include migraine variance by my examiner.
Evidence shows that I perform service in Southwest Asia. Theater operations exposing me to environmental hazards to include burn pits. I'm going through the appeal process now.

In the decision letter granting my osa claim it states in the “Reason For Decision” ( though not listed as “Favorable findings”) they did state that “OSA is an independent risk factor for cardiovascular and cerebrovascular diseases.”

Put in for increase for my lower back, legs and feet.
My C&P exam did not go will I don't think. Totally different from the first one I had. From the start the doctor wouldn't answer any of my questions, got ether I can't answer that, or I don't know. He was using a computer and typing as he was doing the exam. I ask if the form he was using was a BDQ, he said he had no idea what a BDQ was. I ask how long he had been doing C&P for VA he said 4 year.
He started checking my feet, wouldn't listen when I was telling him what he was doing was hurting me badly his commit was I'll get over it. Same when checking my knees. When doing my back keep telling me you can bend over more you need to do more, finely I said no more you're hurting me. At the end of the exam, I told him he had hurt me he turn around going out the door and said that he didn't do that.
The exam took maybe 13 minutes and him working on the computer took up the other time about 25 minutes. What really got me was he didn't ask one question about any of my pain that I was having. I walk out in so much pain I had to stop 3 times before getting back to my truck.
Should I report this to VA or wait until after the C&P finding comes out.
Im really sorry you had to go through that. Seems completely unacceptable. Was this through the VA or an outside source? Honestly I would recommend getting an accredited VA lawyer. They are going to take some of your back pay, but they will go to bat for you and can represent you in challenging this exam. I don’t know the full ins and outs so if anyone can add to this please!
My examiner lied for my ankle increase.. didn't do any ROM test.. I just went to my VA Podiatrist told them I was concerned about my Ankle Rom.. had them take a Rom a with a goniometer and i submitted thst as a supplemental
Report him immediately, ask for another review! Don’t wait too long, make a voice recording in your words what you experience and how low the doctor made you feel!
If a doctor purposely causes a patient pain, it could constitute medical malpractice or professional misconduct. Additionally, the doctor could face disciplinary action from their licensing board, if you report it, which could result in penalties ranging from fines to suspension or revocation of their medical license.

This is literally what happened to me… I filed for chest pain due to my open burn pit exposure and other toxins in Kuwait and Iraq. I’ve done every c&p and ekg and still denied but favorable findings was herniated collapsed wall.
Second denial is my low back strain from ruck marching and un even terrain. Denied but favorable findings is low back strain. Says it does not relate to service but this was a secondary to my buckling knees… It has me frustrated.
For the back, if it's not documented, the VA looks at it like it didn't happen. I discuss favorable findings in the video and how it can be misleading to veterans. "The issue of flatfoot, bilateral was returned for correction of a duty to assist error in the prior decision. We failed to get private medical records. We will develop for private medical records... Favorable Findings identified in this decision: You have been diagnosed with a disability. Private treatment records,Metropolitan Podiatry Center, dated October 5, 2023, shows a diagnosis of flat feet and posterior tibial tendonitis in both feet"
If you said you obtained treatment somewhere, you just added months on your claim when you could have went out and obtained those records. You didn't mention where this condition falls under the 5 ways of service connection. I am a gulf war veteran (1995-2008) and was denied service connection for cervical spine condition but in favorable findings I was diagnosed for cervical strain and designated TERA while I was deployed in Bahrain. Does the Pact Act under the Gulf War Illness in Southeast Asia apply for muscle and joint pain presumptive Dx? I submitted a supplemental claim to my denial for that reason Pact Act presumptive dx due to a muscle and joint pain dx and have been ill for over six months
Where does that condition fall under the five ways of service connection. Also, you can find all the new conditions under the PACT Act on the VA's website. Also, the VA has a list of conditions for Gulf War in their 38CFR.

Please address the following. I just saw a video from a well known law firm that specializes in VA Disability claims state that new increase claim filers must use the 520 EZ and if an increase claim was filed previously (for the condition) that filers must use the supplemental form, but what if a veteran is in a situation like my situation?
In 2010, I was VA Disability rated at 80%. In 2023, a 30-year VA rater, at my regional office recommended that I allow them to submit for increases (on my behalf) considering that I never filed for an increases in 13 years. I agreed, but later contacted the VA and requested that VA withdraw the increase claim. Why? Because I saw several of your videos mentioning that veteran's should never submit for increases without current medical evidence.
(Fast forward to today)...I now have current medical evidence, etc, and I'm ready to properly submit an increase claim; however, the law firm's statement induced concerns.
Question:
Considering the above scenrio, do I submit for an increases on a 520 EZ or supplemental form? Technically, I previously submitted an increase claim; however, techically, I didn't because I withdrew the claim and didn't fully go through the claims process.
Note 1: I received notifications for C&P exams but quickly canceled them, properly notified VA, and submitted a form for VA to withdraw the claim.
Note 2: After VA withdrew the claim, the VA listed the withdrawn claim (under my VA claim's history area) as a decided claim with a decision letter; however, there is/was no decision letter attached.
I am so confused and this challenge is holding me up from submitting the claim. Do you have any videos that addresse situations like this situation? Thank you in advance for responding.
I will take the 1st part. If you file an increase, the prescribed claim form is VA Form 21-526EZ, if you are denied, you will need a VA Form 20-0995 with new and relevant evidence. I have a question, pertaining to Agent Orange while on "Patrol in 1971 with the Marines (I was a Corpsma n) we got sprayed with the Orange and at the time didn't think too much about it but I have developed a heart condition in the middle valve and VA has been thinking of surgery.. If "any findings favorable to the claimant...is binding on all subsequent agency of original jurisdiction," and I have a favorable finding from an HLR that says, "The claimed primary disability is service-connected," does this mean the denial will be overturned?

@@DewayneKimble I filed for GERD and was denied. The denial letter said “The evidence does not show an event, disease or injury in service. (38 CFR 3.303, 38 CFR
3.304). Your service treatment records do not contain complaints, treatment, or diagnosis for this condition. There is no basis in the available evidence of record to establish service connection for GERD.” I file for a HLR w/informal conference where I pointed out in my STR that there were complaints and treatment for GERD.
After the HLR I received a decision letter that says, “A duty to assist error has been identified during the higher-level review for GERD…We failed to get an examination(s) and/or medical opinion(s). We will develop for a VA opinion.” Under favorable findings it says, You have been diagnosed with a disability; evidence shows a diagnosis of GERD. The claimed primary disability is service-connected.”
My question is, does this mean the original denial will be overturned and I will be service connected for GERD?

Applied for tdiu and was denied x2. Favorable Findings listed were all of my SC disabilities x2. I don't know how "correct" the claim and I haven't heard back from claims officer. I'm at 90% on SSD, can't work because of my SCD. I went out on dbl for mastectomy, was cleared to go back to work with restrictions that I could not do in MY job or any job in the hospital or basically anywhere else.The restrictions were because of my SCD
Mam I was in the same situation you are in and I called the Friedman Law Firm in Birmingham Alabama and I am 100% TDIU P&T. Don’t be afraid to pay 33% of your back pay to an Attorney to get a lifetime of benefits.

@@DewayneKimble the C&P examiner for TDIU evaluated my SCD and there apparently was no change. Going to file FOIA for report because VAMC says they do not have the C&P in my records. They get a copy, but didn't want to give it to me even though I filled out a record release. I was told by 3 different ppl they don't get those reports. I will have to call to get the form that tou speak of

Just got my letter today for lower back and right side reliopathy and sleep apnea all denied for SC because I have nothing in my records.

You stated, "....all denied for SC because I have nothing in my service records", then later stated that the C&P diagnosed with back problems. Are you saying that you were denied because radiculopathy wasn't in your service records due to the type of claim filed? It's not clear if you filed a direct radiculopathy claim or secondary claim. Also I assume that your statement that the C&P diagnosed with back problems was the favorable findings in your denial letter. Is that correct?
Direct needs STR proof. So if there are no complaints OR treatment in service, the connection is not established, hence your favorable finding but denial. The letter should tell you what prevented the grant.

@@DewayneKimble Dewayne you've provided a plethora of products (free, paid-for, and a hybrid mixture of both) for veterans to get educated. Great people like youself provide the plan/roadmap, but at the end day, veterans must DESIRE to learn and EXECUTE the plan.
You Sir are like a Walmart because you fill the shelves with product variety, advertise the products, and open the doors for people/veterans to purchase the products; however, what occurs after product purchase is COMPLETELY determined by the purchaser/veteran.
I don't how many more ways that you can plead with veterans to "Get Educated", (which begins with the plan, products, and product-availabilty that you've provided), and purchasing the products by veterans. However, product-purchase without self-motivation and strategic execution is akin to purchasing a new TV from Walmart and never removing it from to box🤔.
Keep doing what you do! It does make a difference. While it's desirable for all to optimally benefit, some simply won't.

I am a gulf war veteran (1995-2008) and was denied service connection for cervical spine condition but in favorable findings I was diagnosed for cervical strain and designated TERA while I was deployed in Bahrain. Does the Pact Act under the Gulf War Illness in Southeast Asia apply for muscle and joint pain presumptive Dx? I submitted a supplemental claim to my denial for that reason Pact Act presumptive dx due to a muscle and joint pain dx and have been ill for over six months
