Yep. Outside of reporting a crime yourself to the police, there is literally no time when talking to the police benefits you. Even as a third party witness, police are looking for someone to convict of the crime they are investigating. They don't care if that someone happens to be you.
The station has time to fill. The station gets an articulate guy that can keep viewers for five minutes, and the DUI guy gets free advertisement. Win-Win.
Drinking and then driving isn’t against the law itself as long as you haven’t reached the level of being impaired. BUT if you honesty tell the officer that you had 1 or 2 drinks, you will be arrested. 100%. They won’t believe that you only had 1 drink. So it’s better to be quiet than lie.

When I was a kid like 9 or 10 my dad said "dont fall in love with a car and never talk to the police." This was 30 yrs ago, he says he doesnt recall telling me that but I remember it like it was yesterday. He was right, like usual.
I have family that are police officers and even when they are at family events the tension in the room is tight with everyone. He is never off-duty, even when on vacation he is observing everything around him. His wife went through several weeks of de-escalation training for when he comes home and can not shut off - including a special safe word and other resources to protect herself from him. They are all trained and reprogrammed, it is like a gang or club that join. I've only known a couple officers that I really liked but that was because of their location and they were super down to earth but even then they had talked about they are trained to pull people over without cause to look for something that they could use against the 'suspect'. They are trained to question people in such a way that the person wills state the wrong thing and then BAM!!! Too late now, you're busted for something that you didn't even know about.

I learned my lesson when I was in my early 20's. I was pulled over for no reason by the Police in the middle of the night. I was respectful and told him I had not done anything wrong. He laughed and said do you really think that makes a difference! Really shocked me that he would say that to my face.

What if the cop asks you to submit a blood sample and you unknowingly live in an "non-refusal" county? I did refuse because I didn't know I lived in non-refusal county, he neglected to inform me of this important piece of information before I refused. So it resulted in getting blood taken from me, going to jail, a hearing at the DMV to keep my license (which I won), and everything else that goes along with a DUI. The shocker for me was when I learned from my hearing that I supposedly had made a confession to someone while in jail, to ingesting a drug that I've never heard of, I don't even know how to spell it so I can Google it. Even in the worst state of mind I would not be able to slip out that I've taken a drug that I hadn't even known existed until then. Court is coming up in probably a few months so discovery will show me what they have and intend to use against me. But yeah, don't let cops intimidate you to gather evidence to be used against you. Know your rights and exercise them, they have a job and that is to make arrests. DUI is a cash cow in my county.

I would have done things differently had I known that I was in a non-refusal county. The only sobriety test he did was checking my eyes. He then attempted to get me to admit to taking a prescription medication like Ambien. I'm not a fool. Brought the dogs out and subsequently searched my vehicle, found nothing. I don't think they had anything on me, hence the confession I supposedly made to someone in jail. That's the only reason I can think of for them to fabricate something like this.

I agree with helping folks who get caught up by an unscrupulous cop but IMHO if someone is legitimately drunk and a hazard to other motorists then they need the book thrown at them. Too many innocent people died when drunks crash into them.

In Connecticut, if u refuse any test, u automatically are found guilty in court. If a 2nd offense, u still go to prison even though u refused the breathalizer. I know someone who this happened to. She is now out on home arrest luckily.

I have this issue, I feel like if I were to not speak to them or allow them to search they automatically consider that evidence of guilt. I was recently pulled over and given a road sobriety test which the officer claims I failed (I've had 6 spinal surgeries and no feeling in lower half of left leg and both feet and couldn't pass being completely sober). They searched me and the vehicle and found no evidence saying that I was under the influence but they still arrested me for DUI. I then denied the blood test which is an automatic 12 month license suspension. But I feel that the cops and courts are going to look at that refusal as admittance of guilt. I have not been convicted for the DUI (which I am fighting) but it is in my record that I have a DUI suspension right now. I've always felt that if I don't talk to them at least some they look at it as being uncooperative and will find a way to arrest me whether I've done something wrong or not. It's not right
In Massachusetts, It's an automatic 6 month loss of license for refusing the breathalyzer and/or field sobriety tests on the scene. I believe the police can also get a warrant, after you've been arrested and refused originally, to take your blood sample against your will for testing as part of their investigation. I've known several people who've refused and appealed the automatic licensed suspension after the fact. I've also known a couple guys who got pulled over, consented to the tests and we're subsequently arrested for DUI. Both said that consenting was by far the worst mistake they made.. basically made the case against themselves open and shut after that.

Yes sir I learned my lesson in 1981 when a “friendly” Columbus Ohio policeman pulled my over for “crossing” the yellow line on a city street in Columbus at 2am and when he ran my license which were cleared he ask me if I’d been drinking and I said no but when he looked in my back floorboard there was 2 old beer bottles where my brother was in my car and left them in there unfortunately for me the cop didn’t believe me so I got arrested went thru the rigamarole got suspended for 6 months 3 days in jail and paid a ungodly amount of court cost and other monies I didn’t have...back then there was nobody cams or dashboard cameras so the state wins 99.9% of cases...my attorney was just about useless on this case...I sure could have used Mr Foreman then but I don’t think he was around back Then as a attorney...he’s a number one attorney in my book! 👍🏼👍🏼

If you refuse the road breath and field sobriety test they will arrest you anyway. If you take the road breath test and pass it they will let you go. One time I even had a cop take me to the station and do a test and he let me go after passing.
my grandfather was a state patrolman, he was the rare breed who didn’t like giving tickets, instead giving warnings….this was many years ago, he retired in the 60’s….he’d probably agree don’t incriminate yourself.

I got a DUI on New Year’s Day and got pulled over, he didn’t observe me for 20min which is by law to do so and he asked me to step out of my car and did sobriety tests and I got arrested. I refused to a blood test and they got a warrant for my blood and that’s it.
Before law school, I was a police officer for 12 years. Three of those years I worked homicide. During an interrogation of a person suspected of murder, one of our favorite techniques was tell the person "let us help you." This was done in an attempt to gain their trust and ultimately a confession.

Curious what happens if you're completely sober and blow 0 at the station? Are you automatically released? Will blood test also be required? Are you arrested anyway pending the blood test? What advice would you give to someone completely sober who is stopped for DUI?
I think he said you had to take the test at the station. But it was confusing. Never do the road side test because you can fail that without having consumed any alcohol.

Never volunteer information to the police officer, such as "I had one beer", never do road side sobriety test cuz they are so tricky, and then refuse the breath test or blood draw at the station or hospital! Also they can only request one or the other as far as breath or blood at station or hospital! If you even had one glass of wine at dinner or any chance you might fail a breath test then always refuse! Also need to be careful cuz there are certain foods that contain sugar alcohol that could give a false positive on the road side breath test!!! The only time you should submit is if you have a pilot license or a CDL license because refusal penalties are so stiff!!!

@@seaturtledog In CA, all roadside gymnastics AND the PAS test (PRIOR TO ARREST) should be refused. When someone finds themselves at the station then an arrest has occurred and refusal is no longer an option.
It seems totally unfair when police ask a number of questions; where are you coming from, where are you going, did you have anything to drink…and when they have enough info to arrest you, they then read you your rights after you have incriminated yourself.

I looked it up. We’re an implied consent state. If you refuse a breathalyzer, you get an automatic one year suspension. That being said, as much as I am all for NOT treating cops like they’re there to help you, driving intoxicated is some serious shit and has killed WAY too many innocent people.

If you refuse a PBT here in the State of Michigan, you automatically lose your license for 3 years, regardless of conviction. I've been without a license for years because of a dui charge where I refused the PBT, then the case was dismissed.

I'm a retired Air Traffic Controller. Like pilots who hold an FAA (Federal Aviation Administration) license, my off duty conduct (DUI, failing to take a breathalyzer at the station, drunk in public, drunk and disorderly, etc.) could have cost me my job. Where i could have won such a charge in a court of law it still, most likely, would have cost me my job.

I had a question hopefully this master of an attorney can answer. During the “ observation period” before a breathalyzer, the officer is suppose to stop you from raising ur bac. What if they weren’t able to stop you? Let’s say hypothetically you were to sneak a shooter of tequila into the observation room and drink it. What would happen? Would that be a huge fail for the officer? Would that help your case or make it worse? I heard of a case where an attorney got pulled over and took like 2 shots right in front of an officer and had his case thrown out because the officer failed to stop him from raising his bac. I got pulled over for speeding just over 7mph and cop believed I was drinking and driving and asked me to take the breathalyzer and I refused. Do I have a chance to beat it?
Why don't you challenge the fact that no law can make a person waive their right to remain silent, not provide evidence against ones self when the state attempts to suspend their license?
I love the different laws. In NYS if you refuse the test at the station you lose your license. In fact 1194(4) you are ineligible for any license. You cannot get a conditional license. If found guilty your license shall be revoked for no less than 6 months (1st offense) and DMV will not issue a conditional license. Add to it an IID for a minimum of 1 yr, up to 364 days in jail and fines up to 2k (1st offense).

You can refuse the so-called field sobriety tests. You can refuse the field breathalyzer. You must submit to the breathalyzer they administer at the police station which is a more accurate machine.
I think it depends on your location. Also I believe you might have to make them aware that they are being recorded, which might also depend on your location. The laws vary from different counties n states. You should look up the laws for your specific location

Furthermore if you can see it with your eyes your good to record. First ruled 2011. Second confirmation case December 2018. Knowledge is power. Don't give up your rights. The PAS is a "field sobriety test" designed to "assist the officer" in developing probable cause for an arrest under CA VC 23612. Please read the specific details in CA VC 23612(h) and (i) which deals with the PAS prior to actual 'cause' for arrest where your refusal is not punishable. I must emphasize that AFTER cause for an arrest under CA VC 23612 the 'implied consent' kicks in and refusal for testing WILL be punishable.

My plan, if I was ever pulled for DUI was to demand a Blood Test. This is not true. In NC you can refuse the FST and the PBT (roadside) tests without penalty. You don’t answer question and don’t aid them in an investigation of yourself. If they manage to justify an arrest anyway (probable cause) you must take the breath test at the station or allow a blood test if requested. If you refuse those - one year suspension.

(Maybe in the morning as with drinking the night before. I also would not drive on drugs. I feel like I have nothing to fear but I also believe in our USA rights. Just be quiet and, if it comes to it - bodily fluids can do the talking.

Each Soldier that refused a roadside was marched inside to see the Judge who suspended their license on the spot, THEN order a Breathalyzer. Went down to the Fayetteville Jail for more than a few sober Soldiers. One or 2 is an anomaly. 4-5 a month is a pattern.

I agree with helping folks who get caught up by an unscrupulous cop but IMHO if someone is legitimately drunk and a hazard to other motorists then they need the book thrown at them. Too many innocent people died when drunks crash into them.

In Connecticut, if u refuse any test, u automatically are found guilty in court. If a 2nd offense, u still go to prison even though u refused the breathalizer. I know someone who this happened to. She is now out on home arrest luckily.

I have this issue, I feel like if I were to not speak to them or allow them to search they automatically consider that evidence of guilt. I was recently pulled over and given a road sobriety test which the officer claims I failed (I've had 6 spinal surgeries and no feeling in lower half of left leg and both feet and couldn't pass being completely sober). They searched me and the vehicle and found no evidence saying that I was under the influence but they still arrested me for DUI. I then denied the blood test which is an automatic 12 month license suspension. But I feel that the cops and courts are going to look at that refusal as admittance of guilt. I have not been convicted for the DUI (which I am fighting) but it is in my record that I have a DUI suspension right now. I've always felt that if I don't talk to them at least some they look at it as being uncooperative and will find a way to arrest me whether I've done something wrong or not. It's not right

In Massachusetts, It's an automatic 6 month loss of license for refusing the breathalyzer and/or field sobriety tests on the scene. I believe the police can also get a warrant, after you've been arrested and refused originally, to take your blood sample against your will for testing as part of their investigation. I've known several people who've refused and appealed the automatic licensed suspension after the fact. I've also known a couple guys who got pulled over, consented to the tests and we're subsequently arrested for DUI. Both said that consenting was by far the worst mistake they made.. basically made the case against themselves open and shut after that.

Yes sir I learned my lesson in 1981 when a “friendly” Columbus Ohio policeman pulled my over for “crossing” the yellow line on a city street in Columbus at 2am and when he ran my license which were cleared he ask me if I’d been drinking and I said no but when he looked in my back floorboard there was 2 old beer bottles where my brother was in my car and left them in there unfortunately for me the cop didn’t believe me so I got arrested went thru the rigamarole got suspended for 6 months 3 days in jail and paid a ungodly amount of court cost and other monies I didn’t have...back then there was nobody cams or dashboard cameras so the state wins 99.9% of cases...my attorney was just about useless on this case...I sure could have used Mr Foreman then but I don’t think he was around back Then as a attorney...he’s a number one attorney in my book! 👍🏼👍🏼

If you refuse the road breath and field sobriety test they will arrest you anyway. If you take the road breath test and pass it they will let you go. One time I even had a cop take me to the station and do a test and he let me go after passing.

I got a DUI on New Year’s Day and got pulled over, he didn’t observe me for 20min which is by law to do so and he asked me to step out of my car and did sobriety tests and I got arrested. I refused to a blood test and they got a warrant for my blood and that’s it.
They only have to do a 20 minute observation once at the breathalyzer testing location, prior to blowing.
I'm sorry that happened to you. In most states, you can refuse the the field sobriety test and the roadside breathalyzer too

Before law school, I was a police officer for 12 years. Three of those years I worked homicide. During an interrogation of a person suspected of murder, one of our favorite techniques was tell the person "let us help you." This was done in an attempt to gain their trust and ultimately a confession.

This seems like bad advice. In a lot of states refusing a breathe test is a 12 month license suspension.
I think he said you had to take the test at the station. But it was confusing. Never do the road side test because you can fail that without having consumed any alcohol.
Loosing your license for a year is better than a DUI on your record, along with hefty fine, community service, DUI school, and probation!!!

Never volunteer information to the police officer, such as "I had one beer", never do road side sobriety test cuz they are so tricky, and then refuse the breath test or blood draw at the station or hospital! Also they can only request one or the other as far as breath or blood at station or hospital! If you even had one glass of wine at dinner or any chance you might fail a breath test then always refuse! Also need to be careful cuz there are certain foods that contain sugar alcohol that could give a false positive on the road side breath test!!! The only time you should submit is if you have a pilot license or a CDL license because refusal penalties are so stiff!!!

@@seaturtledog In CA, all roadside gymnastics AND the PAS test (PRIOR TO ARREST) should be refused. When someone finds themselves at the station then an arrest has occurred and refusal is no longer an option.
It seems totally unfair when police ask a number of questions; where are you coming from, where are you going, did you have anything to drink…and when they have enough info to arrest you, they then read you your rights after you have incriminated yourself.
That’s why you need to know your rights. “I don’t answer discovery questions without an attorney present “. Cops absolutely bank on the fact that people don’t know they don’t have to answer a single question.

I looked it up. We’re an implied consent state. If you refuse a breathalyzer, you get an automatic one year suspension.

They call a pre-selected judge on the phone, give him your name, he "authorizes" the draw and a cop allegedly certified to draw blood needles you. I'm a retired Air Traffic Controller. Like pilots who hold an FAA (Federal Aviation Administration) license, my off duty conduct (DUI, failing to take a breathalyzer at the station, drunk in public, drunk and disorderly, etc.) could have cost me my job. Where i could have won such a charge in a court of law it still, most likely, would have cost me my job.

During the “ observation period” before a breathalyzer, the officer is suppose to stop you from raising ur bac. What if they weren’t able to stop you?
Let’s say hypothetically you were to sneak a shooter of tequila into the observation room and drink it. What would happen? Would that be a huge fail for the officer? Would that help your case or make it worse?
I heard of a case where an attorney got pulled over and took like 2 shots right in front of an officer and had his case thrown out because the officer failed to stop him from raising his bac. I love the different laws. In NYS if you refuse the test at the station you lose your license. In fact 1194(4) you are ineligible for any license. You cannot get a conditional license. If found guilty your license shall be revoked for no less than 6 months (1st offense) and DMV will not issue a conditional license. Add to it an IID for a minimum of 1 yr, up to 364 days in jail and fines up to 2k (1st offense).

You can refuse the so-called field sobriety tests. You can refuse the field breathalyzer. You must submit to the breathalyzer they administer at the police station which is a more accurate machine.

I think it depends on your location. Also I believe you might have to make them aware that they are being recorded, which might also depend on your location. The laws vary from different counties n states. You should look up the laws for your specific location

Furthermore if you can see it with your eyes your good to record. First ruled 2011. Second confirmation case December 2018. Knowledge is power. Don't give up your rights. The PAS is a "field sobriety test" designed to "assist the officer" in developing probable cause for an arrest under CA VC 23612. Please read the specific details in CA VC 23612(h) and (i) which deals with the PAS prior to actual 'cause' for arrest where your refusal is not punishable. I must emphasize that AFTER cause for an arrest under CA VC 23612 the 'implied consent' kicks in and refusal for testing WILL be punishable.

🤔 back home, NC, it was an Automatic suspension if you refused any Field Test. I have Medical reasons as to why I cannot pass a Field Sobriety Test. My plan, if I was ever pulled for DUI was to demand a Blood Test. I don't drink and drive anyway but I've seen way to many Videos of Dishonorable Cops just trying everything in the book to screw somebody's life up.
This is not true. In NC you can refuse the FST and the PBT (roadside) tests without penalty. You don’t answer question and don’t aid them in an investigation of yourself. If they manage to justify an arrest anyway (probable cause) you must take the breath test at the station or allow a blood test if requested. If you refuse those - one year suspension.
@@jvc8947 that may be the LETTER of the Law but I saw more than one Soldier have his license cut up on the side of the road for refusing to do a roadside. That's even exactly what our Driver's Ed. instructor taught us.

I feel like I would refuse and just say bring on the portable breath test… which would be zero. I have a personal rule to Not drive within 12 hours of alcohol. (Maybe in the morning as with drinking the night before. I also would not drive on drugs. I feel like I have nothing to fear but I also believe in our USA rights. Just be quiet and, if it comes to it - bodily fluids can do the talking.
@@jvc8947 ever see "The Buses"? State Troopers used to park one on each end of Bragg BLVD. Each Soldier that refused a roadside was marched inside to see the Judge who suspended their license on the spot, THEN order a Breathalyzer. Went down to the Fayetteville Jail for more than a few sober Soldiers. One or 2 is an anomaly. 4-5 a month is a pattern.
