Magkakaron na sila ng donation ng ancestral house, pero napagkasunduan nila na kay kuya na mapupunta. Yung bunso hindi na niya kukunin ang parte niya. Gagawa po siya ng general renunciation of inheritance. Q1. Mapupunta na po ba sa kuya ang buong property na walang donnors tax sa part ni bunso? Q2. Hindi po ba mapupunta sa mga anak ni bunso or sa lolo kung buhay pa?

Hi Atty. Since we are in the topic of real property taxes, may I suggest a topic which you may want to discuss which are Sections 194 and 270 of the Local Government Code (RA 7160). Section 194 states that “Local taxes, fees, or charges shall be assessed within five (5) years from the date they became due. No action for the collection of such taxes, fees, or charges, whether administrative or judicial, shall be instituted after the expiration of such period:”. However, from my experience, a lot of LGUs disregard this provision of the local government code and assesses the taxpayer who has more than 5 years delinquency to pay the actual number of years that he is delinquent. And when I pointed out this particular provision of the local govt code, I was told to pay in full the assessed tax but under protest. If I apply for a tax amnesty under RA 12001 and the assessor insists on assessing the total number of years in excess of the 5 years that is delinquent, what would be my best course of action? Sana makapagbigay din ng annesty o di kaya diskwento sa capital gains tax.
Dapat kasi pag retired na ang may ari ng bahay na nag babayad ng tax sa buong buhay nya dapat wala na sya amilyar na babayaran yang magandang batas.

June 13, 2024 daw pinirmahan ang batas ibig sabihin before June 13, 2024 kung meron kang delinquent covered po siya.
