One, he literally advertised it as something that was less unhealthy than other chocolates when in reality that's not the case. That's false advertising.
Two, they're still contributing towards that unhealthiness epidemic. Sure the customers could just, not buy their products but to me that argument is just victim blaming. It's like saying its the commuters' fault for using cars instead of the manufacturers/designers' fault for exploting loopholes in emission regulations and just promoting vehicles that are way too unsafe as "the perfect vehicle." It's their mess, they clean it up.
