I do not think it matters in a community property State. My sister filed separate but spouse did not withhold enuf state income tax. Since my sis worked for the state they took part of her wages because it was easier than filing and taking from his wages.

In my case, in their infinite wisdom, the IRS made the check out to BOTH me (the injured spouse) AND my ex-husband. He managed to intercept it, forged my name, and cashed it. The IRS refused to do anything about it and told me to take it up in civil court.

What I don't understand is why the husband couldn't refund the wife the money every time it was deducted from her paycheck while she sorts out the issue with the relevant authorities? It's not like the husband was paying the child support, and at the same time, the wife was also getting her paycheck garnished. Child support was rightfully owed. There may be reason for the husband's arrears in child support (like an illness or past period of unemployment). Child support is still due to the custodial parent, but it should not be garnished from the non biological stepmother. It reflects to employer of the stepmother being irresponsible on his employees part. Not the stepmother's responsibility!

Marriage creates unity, so financial responsibility becomes 50/50 between the two. If one can afford to pay such liability, they would take the money from her (they did for 3yrs). They don't care who fathered who, after all they're paying joint taxes and presenting themselves as one.

The garnishment order wasnt issued by the defendant and so she shouldnt be liable to repay it. Whichever entity made the mistake, if its truly not legal, should be liable.

I would have made the husband pay his wife back. The ex had no way of knowing where the funds came from, it isn't her job to inquire. It's his job to pay and since it covered HIS debt, he should reimburse his wife AND the ex what he owes her.
Give her the money back, make child support update the record and then put him in jail for non payment. The wife will then have the money to bail him out.

I'm honestly not sure if JJ made the right decision on this one. The government decided that lady's funds/garnishment that was being paid to take care of the traffic violation would be better off taking care of her husband's child support instead. That was a decision that the government had already made. JJ actually overruled a government decision by forcing the defendant to return that child support money back.
There's a form she needs to fill out at her local child support enforcement called Innocent Partner, it just says that she has no responsibility for the child support and links her social security to a don't garnish order in this child support order
people in the comments are confused. the judgment was not about the child support (which would have been a lot more) but about the parking ticket that never got paid. the defendant received an overpayment that was to have gone for the ticket.
If you are married to a person who owes child support, they can take the money from you, because it's community property (the incomes of spouses are community property). Back in the 1980s, my friend was ordered to pay child support for her husband's children from a prior marriage, because he wouldn't work.

if a custodial parent is getting a payment thru a court order then they have no idea who it is coming from, all they know is that it is being fulfilled. ..the checks are issued thru the govt office . it is not like they garnish the paycheck , go to that person's house and send the custodial parent a check from the paying parent's checkbook laying on the desk there....the paying parent's money goes to the court, and the court issues the check under the govt name. And while the , yes the one responsible for contributing to the birth should be the one paying the court anyone (even the neighbor ) can send that amount in on their behalf . in this case , if the mom knew for a fact that the checks from the court were not coming from the dad , then yes she should pay it back or at least not accept them ....but the current wife should not be mad at the mom, blame the husband for not paying in the first place and go after him and the system that screwed up .

Back in 1983 a judge demanded my ex bring in his new spouses income info. He kept saying he couldn't pay support because he had to pay half of all the bills with her. Judge ordered if she was a part of the problem, she would be paying too. The children come with the spouse and she was stepmom now.

My ex paid even less than that for two kids, never saw them, and still ended up in arrears 🤦🏽♀️. Perhaps someday I'll get a surprise payment, but I'm not holding my breath. They claim it's based on income and time spent, but it's all a crapshoot in the end.

You can file an injured spouse claim and not have to worry about all the money being taken out when you file jointly.

What I don't understand is why the husband couldn't refund the wife the money every time it was deducted from her paycheck while she sorts out the issue with the relevant authorities? It's not like the husband was paying the child support, and at the same time, the wife was also getting her paycheck garnished. Child support was rightfully owed. If the wife never thought of suggesting this to the husband, it shows she was very comfortable with the idea of being married to someone who avoids the responsibility of taking care of the children he fathered

There may be reason for the husband's arrears in child support (like an illness or past period of unemployment). Child support is still due to the custodial parent, but it should not be garnished from the non biological stepmother. It reflects to employer of the stepmother being irresponsible on his employees part. Not the stepmother's responsibility!

Now the mom will pay the wife back and report to child support that she had to pay money back which will mean the dad will owe more in arrears so at the end of the day the stepmom isn't helping her husband and is mad at the wrong person. Marriage creates unity, so financial responsibility becomes 50/50 between the two. If one can afford to pay such liability, they would take the money from her (they did for 3yrs). They don't care who fathered who, after all they're paying joint taxes and presenting themselves as one.
It just keeps the father from putting things in the new wifes name to avoid legal obligations

The garnishment order wasnt issued by the defendant and so she shouldnt be liable to repay it. Whichever entity made the mistake, if its truly not legal, should be liable.

Personally I don’t think it matters who the defendant received the money from. If it wasn’t the kids father she has to pay it back because that’s not her bill. The defendant got the money by accident. And if the defendant is owed that money from her child’s father then it’s HER job to get that money from HIM. NOT anyone who can afford to cover his tab lol It’s not the new wife’s job either to figure out their situation and get her money back. It’s a shame she even had to take the woman to court.
I would have made the husband pay his wife back. The ex had no way of knowing where the funds came from, it isn't her job to inquire. It's his job to pay and since it covered HIS debt, he should reimburse his wife AND the ex what he owes her.
Give her the money back, make child support update the record and then put him in jail for non payment. The wife will then have the money to bail him out.

The government decided that lady's funds/garnishment that was being paid to take care of the traffic violation would be better off taking care of her husband's child support instead.

There's a form she needs to fill out at her local child support enforcement called Innocent Partner, it just says that she has no responsibility for the child support and links her social security to a don't garnish order in this child support order
people in the comments are confused. the judgment was not about the child support (which would have been a lot more) but about the parking ticket that never got paid. the defendant received an overpayment that was to have gone for the ticket.

If you are married to a person who owes child support, they can take the money from you, because it's community property (the incomes of spouses are community property).
Back in the 1980s, my friend was ordered to pay child support for her husband's children from a prior marriage, because he wouldn't work.
Whomever gave that order and whomever created the laws that allowed it were morons.... since the obvious way to put a stop to that idiocy is to divorce 'officially' and then remarry once the children grew up.

The only way Judge Judy would be able to make that happen is if the plaintiff sues her husband, which clearly isn't going to happen. I understand that they were probably frustrated at the inefficiencies with the government overseeing the child support case, but I don't think JJ's venue really brought anybody justice here.

if a custodial parent is getting a payment thru a court order then they have no idea who it is coming from, all they know is that it is being fulfilled. ..the checks are issued thru the govt office . it is not like they garnish the paycheck , go to that person's house and send the custodial parent a check from the paying parent's checkbook laying on the desk there....the paying parent's money goes to the court, and the court issues the check under the govt name. And while the , yes the one responsible for contributing to the birth should be the one paying the court anyone (even the neighbor ) can send that amount in on their behalf .
in this case , if the mom knew for a fact that the checks from the court were not coming from the dad , then yes she should pay it back or at least not accept them ....but the current wife should not be mad at the mom, blame the husband for not paying in the first place and go after him and the system that screwed up .

Back in 1983 a judge demanded my ex bring in his new spouses income info. He kept saying he couldn't pay support because he had to pay half of all the bills with her. Judge ordered if she was a part of the problem, she would be paying too. The children come with the spouse and she was stepmom now.
