    Lesson 14: WHAT IS ARREST?
    RULE 113
    Section 1.
    ✓TAKING A PERSON INTO CUSTODY in order that he may be BOUND TO ANSWER for commission of an offense.
    ✓ DEPRIVING A PERSON OF HIS/HER LIBERTY

    What is arrest?
    It is when the authority act of taking the person to the custody. The subject that matter to this, is a person and not a thing or evidence. This happened if there is a possible case against the person and he may be bound to answers the questions related to his case.
    If someone got arrested, his liberty will be affected as he will submit to the custody due to the possible investigation process and to prevent crime; Anglo Norman in origin and it is related to the French word arret, meaning "stop"
    How is Arrest Made?
    According to Section 2. These are the two way to Arrest
    Actual Restraint - the person isn't cooperative that he resist from the authority actions. Even if this happens, the authority must continue to arrest him to fulfill his duty.
    Submission - a person surrendering on his own will.
    In arresting, no violence or unnecessary force shall be used. Basically speaking, the authority has right to give force if it is NECESSARY and REASONABLE. But when the authority use violence even an individual is submitting himself, this is when the Police Brutality involves.

    Section 1. DEFINITION OF ARREST-
    Arrest is the taking of a person into custody in order that he may be bound to answer for the commission of an offense. I've learn that it have the other term and it is the act of depriving a person of his or her liberty usually in relation to the investigation and prevention of crime. And the term anglo norman in origin and is related to the french word of arrêt, meaning stop.

After being taken into custody, the person can be questioned further and/or charged. An arrest is a procedure in a criminal justice system.

    In this video, I understand the definition of arrest that is to take a person into custody to give him a chance to answer for the commission of an offense. Explained here also the origin of the word arrest that came from the term Anglo Norman that is related to the french word arrêt which means “stop”. Arresting is depriving a person from his liberty to prevent future crime or to protect the person from harm in the process of investigation. Arrest come in two ways: actual restraint and by submission. When a person is being arrested and he is resisting, the use of necessary force can be present.

    Two ways on how Arrest is made:
    Under Section 2 of Rule 113 of Criminal Procedure, it is made by an ACTUAL RESTRAINT of a person to be arrested and by his voluntary SUBMISSION to the custody of the person making an arrest.
    It is prohibited to use violence or unnecessary force in making an arrest, unless the person to be arrested is resisting.

    :No violence or unnecessary force shall be used in making an arrest. Necessary force is enough to arrest a person. Arresting a person who submits himself/herself willingly shall not be subjected to force. Use of force must be reasonable.
    :Test of reasonability and necessary will be judged based on the totality of the incidence. An arresting officer must think carefully and act carefully when facing danger caused by the person to be arrested.
