Gender-Based Sexual Harassment in Public Utility Vehicles. -In addition to the penalties in this Act, the Land Transportation Office (LTO) may cancel the license of perpetrators found to have committed acts constituting sexual harassment in public utility vehicles, and the Land Transportation Franchising and Regulatory Board (LTFRB) may suspend or revoke the franchise of transportation operators who commit gender-based streets and public spaces sexual harassment act.

Thank you for sharing your knowledge Public spaces cover the public utility vehicle and also the private cars like grab, the penalty of person who work at the said occupation can penalised, in LTO the cancellation of license, in LTFRB suspension or revocation of their franchise, but this is not automatic this is passed to their administrative procedure of LTO and LFTRB their is still due process. Where we can we file the case? - We can file the case to their Administrative LTO/LFTRB and we can also file the case in our police station agains the perpetrator. Where we can Blotter the case ? - We can blotter the case in our Barangay but the ultimately is the Police Station to launch the complainant. What evidence we can bring ? -We can get the CCTV footage or Witnesses to prove harassment, this is evidence that can use as backup.

In this video it talks about Republic Act 11313 or Safe Spaces Act with Atty. Lesli Apostol. This bill is also called Anti Bastos Law. This bill talks about gender-based sexual harrasment in street, public places, online, workplaces and education/training institution. In year 1995, we have the law called Anti Sexual Harassment of 1995, we only have two sexual harassment covered, it is only in workplaces and on education/training institution. While in this new law of Safe Spaces Act, it widens and elaborated scope. In this Safe Spaces Act it recognizes the offender who can commit this harassment is not only those who have moral ascendancy but also those who have peers. In Anti Sexual Harassment Act, the definition of this is only limited, it is in the demand, requires, requests sexual favor. Therefore I have learned that the Republic Act 11313 of Safe Spaces Act is much more wider and much broader than the Anti Sexual Harassment of 1995. Thank you for explaining this to us Atty.
