The lockbox was inexcusable. Deserved the half month rent back. Painting and dirty carpet CAN be normal wear, depends how long a tenant was in the unit. I didn't hear about this couple, how long they were there. Another way to think of it: to a homeowner, is it necessary to have to paint ones own home "top to bottom" every year? Every two years? People in their own home don't have to paint that often, and similarly a LL shouldn't have to repaint every year. Every year painting isn't normal wear, but every 3 or 4 could be.
Painting is normal wear and tear until there's scuff marks on the wall. You must be another negligent tenant. Landlords do not need to accept stained up carpets especially if they handed the apartment with clean carpets. I use to be a tenant before becoming a landlord and I never left any of the apartments I lease in disgusting conditions. If you were given a clean apartment then do the right thing and return it in the same condition. I don't know why that is so hard for people to understand.
I've heard on a number of these court shows that if a tenant stays even one day past their move-out day, they owe for the entire next month. Why isn't it the same for the landlord, that if they lock the tenant out before the move-out day they owe the tenant for that whole month?
That is called constructive eviction or self-help eviction and there are stiff legal penalties for that. The two biggest no-no's for landlords are 1) changing locks and 2) shutting off utilities.
I think it has to do with the landlord not being able to rent it for the month. Because if it can be proved that there’s another tenant in there, the landlord can’t charge for the month they can only charge to where they got the place re-rented… a tenant isn’t losing income.
Handy hint... If you want to get stickers off a surface, first use a warm hairdryer over the surface from around a 30cm distance. It makes a huge difference in lifting them. Then use goo remover on any leftover residue. 😁
LOL I went through this once, moved out, returned most days after work to clean everything. Still had a couple weeks paid for, showed up one day, and the owners were painting and moving furniture in. This guy comes out when he sees me and starts screaming at me in his little Mickey Mouse voice "You destroyed my house!!!". I had never met him, had no idea who he was. Called the sheriff, they gave me a "call report" that showed that "Mickey" was in my house on (date). I filed against "Mickey" and his wife with that report and the proof that I still had legal occupancy, the judge awarded me my full deposit, the return of the last month, and the state law allowed me to double the judgment. "Mickey" was furious..... the snively little weasel.

this may be different, but it amazes me how many plaintiffs come into court saying that they left the place in a pristine condition, and when you see the pix they've just trashed the place....cut up the floors, the kids have written on the walls, screens and blinds broken, etc.
those pictures were not of a "trashed" apartment. a trashed apartment is food on the floor, cement thrown down the toilet, graffiti, rancid food left in the fridge, cat shit smeared on the floor etc etc. This here are white walls with marks on them because the walls weren't primed when they were painted (any all white apt is an automatic zero deposit at the end of the lease ALWAYS), marks on the carpet, and some stickers on a fridge that the guy was too lazy to peel off., These landlords were already inside the place previously and said zip, they only brought it up after they were sued. This is textbook for when the landlord no longer has the security deposit to give back, they spent it, they conjure up "damages" so that they don't have to return it or don't have to return as much. Very old tactic in the rental world. Others will be the plaintiff and sue for "damages" so that they don't have to pay for the basic cleaning & updates between tenants. Oldest trick in the book, older than me and I'm decrepit.
Honestly my husband would be happy about the way these tenant left the place. Trust me.. that IS pristine compared to how our places are left every single time! No one ever gets their security deposit back because it’s so bad.. I wish my husband would just sell the apartments. It’s a lot of work and he does 90% of it himself... people just don’t care. We have had people leave just about everything they own, we had people leave their dog.. ( we don’t allow dogs but they didn’t care) , clothing, furniture, trash.. always trash inside and out.. it goes on and on. Scuff marks on the wall would be amazing!! 😝
Before buying, last house I rented, renters before me literally trashed the house, cigarette burns in carpet, they even had to replace bathtub due to tenants cleaning his tools from his concrete job in tub! I put deposit to hold , moved in when carpets were removed, holes in walls patched and used extra shower in basement till bathroom was repaired including new tub. I felt so bad for this elderly couple. When I moved out they were in tears because I made sure to clean and leave place sparkling. Said they have never had the house left in great condition 😂 I guess if you don’t destroy others property, clean , it’s not hard 😂😂😂😂
I had someone leave their cat one time… poor thing came to my door hungry scared so I let him in and when I tried to put him into a cat carrier he scratched my lip which left me a scar 🙃 then they refused to pick him up until I said I was going to bring him to the shelter pound. People suck.
She should'nt get hell for not cleaning since he locked her out two weeks before she was supposed to be out. I think she would've cleaned if they gave her the time to
I think the plaintiff should have gotten the whole month back in rent because, essentially, they locked her out when they put the lock box on the door.
on the 19th they put on the lock box. You don't get to live in a place for more than half a month for free. In previous cases, if ppl moved out on Nov 1st, they had to pay rent for the whole month. Keep an eye on your state....they're all different. Cheers!

Landlord's generally will keep it because they count on you not fighting for it. They are extremely dishonest. Not all for the slow of intellect.
Judge, Goo Be Gone does not work on really stong adhesives. I tried three different products before being able to remove a tape adhesive that was wrapped on a frying pan for shipping. It was a nightmare. The only product that worked was 3M.
I'm a housekeeper and I've found a product that works great for things like that. If you get a can of spray orange degreaser and let it set for about 10 mins the adhesive will get gooey and you should be able to scrape it off with a putty knife. The degreaser smell is pretty strong but it eats thru just about anything if u get the right kind 😃

Because they had already paid for the whole month and were denied access to what they paid for when he put the lockbox on. They were allowed access until the end of Nov
In Canada there is no security deposit. When you move in it's first and last months rent. If there are any damages the Landlord has to go to file a case in court.
If they locked them out early, they absolutely should not be able to charge the security deposit for anything they had not had a chance to clean. Saucy goose, saucy gander.
That judge was horrible did not take seriously the tenant being locked out and the stress that can cause she needed to get her things and whos to say she did dirty up that rotten carpet where was the check in inventory that judge sucks she awarded nearly all the money to the landlord
Harvey needs new questions to ask about apartment owners/renters. Maybe ask if the audience has experience/lack there of of taking pix of videos of apartments when they move in and move out. Something like that.
I don't think that was a fair judgement. Since plaintiff was illegally LOCKED out for the last two weeks, there is no way to know how she would have left the apartment. AND if a renter stays ONE day into a new month (or even leaves stuff there), that person owes for the entire month. So.....why on earth did the plaintiff not get back the entire month's rent?
