Recently had a "similar issue" (between quotes because they were unable to get in) a security guy I believe. Dressed in civilian clothes, open carrying a handgun. Tried to open my door, and then tried his key. I saw him through the peep whole. Saw the gun, asked him what he wanted. "Oh wrong apartment" and quickly moved to the third floor (his actual apartment). Idk how you would confuse your apartment in the third floor with mine in the second with a ring camera right next to the door whereas yours doesn't have one. Thankfully my paranoia of viciously locking every entrance to the house and barricading my windows stopped my neighbor from getting in. I look at this case and I wonder what would've happened if my door was unlocked.
There are six multi unit apartment buildings in our town and each on is built the sam, looks the same with the same layouts. The only difference on them is the numbers on the doors.

I think the prosecutor did a wonderful job in explaining how absurd using Castle Doctrine was against a homeowner is and the jury disregarded it. I was afraid the mistake of fact would come in to play but they disregarded that too, as well they should

One time I was in a rush and I walked into the the wrong apartment unit that was identical to mines and you know what I did, I just turned around and walked out. Yeah it’s that easy.
A few times I've approached the wrong vehicle; I thought it was mine. The first time it happened out in a random parking lot, I thought I had opened the doors using the keyless entry, and I lifted open the back hatch. When I opened the hatch, it only took 1/2 second to know with absolute certainty: this was not my car (and especially because someone was sitting inside it!!). I quickly apologized, closed the hatch, and looked for my car. Reflecting back, I knew this wasn't my car even before I touched the hatch to open it, even though by all accounts it was virtually identical to mine. It just didn't 'feel' like mine....the energy was different. The next time I approached the wrong car in yet a different parking lot, it took less time to realize my mistake. And I'm not a police officer. And these cars were in different parking lots in front of different stores, not like a home which doesn't move.

One time I was in a rush and I walked into the the wrong apartment unit that was identical to mines and you know what I did, I just turned around and walked out. Yeah it’s that easy.
A few times I've approached the wrong vehicle; I thought it was mine. The first time it happened out in a random parking lot, I thought I had opened the doors using the keyless entry, and I lifted open the back hatch.
When I opened the hatch, it only took 1/2 second to know with absolute certainty: this was not my car (and especially because someone was sitting inside it!!). I quickly apologized, closed the hatch, and looked for my car.
Reflecting back, I knew this wasn't my car even before I touched the hatch to open it, even though by all accounts it was virtually identical to mine. It just didn't 'feel' like mine....the energy was different. The next time I approached the wrong car in yet a different parking lot, it took less time to realize my mistake.
And I'm not a police officer. And these cars were in different parking lots in front of different stores, not like a home which doesn't move.

1)legally trespass on someone else's property just by claiming you thought it was your property.

The castle doctrine means that u can use deadly force when you are in your house. The reasonable force must be objective and subjective. It was subjective in this case, as she thought it was her apartment, but it wasn’t objective as it wasn’t her apartment.
You know when you walk into your own home and I don't believe for a second she really thought that was her apt after walking into it. She was trigger happy and didnt even try to save him. She deserves a guilty verdict and I hope she gets the book thrown at her. Police violence needs to stop.

The most lenient sentence available under Texas law?! Have you lost your mind? If the tables were turned that poor man would have already been on death row. That analysis was ridiculous.
