      The ATF has been breaking the law for decades keeping records of private ownership way past their allowed period of 48 hrs.
      Not to mention they have been illegally taxing firearms and firearm parts for far too long.

    As long as people are paying for tax stamps the ATF can justify their existence . If their revenue dropped drastically for one year and people called their representative and promised to vote on this issue alone things would change. But we can hope for SBRS to be removed from the ATF .

Someone somewhere is counting the beans . Well to do people use full auto weapons suppressors and machine guns are a big business and an investment . I don't care who you are if you do business with them they're not going anywhere.

    I think the fact that they're suddenly jumping on these pistol braces equaling SBR means that someone is considering making another run at banning pistols.
    Remember, the whole SBR thing was added to the NFA because they were planning on banning pistols and wanted to prevent people from sawing down long guns to use as pistols.

      I doubt it they aren’t even talking about pistols besides magazine capacity. They want your rifles gone and that would be the best resistance against their tyranny compared to a pistol

      @@starxlord9856 The whole point of the Liberator was that you could use that one shot breech loader to shoot a German soldier in the back and take his rifle - any one of my pistols are more than capable of doing the same, with the added bonus that I could shoot several SS troops in the back.

      @STARxLORD never said a pistol was the optimal weapon, just that a pistol can be used to get optimal weapons.
      War is all about not letting the enemy choose the best time and place to fight so you wait till you are in or can create a situation we're your pistol can do the job which as I noted is a close range surprise attack.

      I don't think they will EVER remove SBR's from the NFA. Maybe I'm a pessimist, but seeing the type of socalled government we now have. All of the alphabet boys have been given a green light to do whatever they want so we're gonna suffer continued injustice.

    I do think this "rule" will be tossed out in court. I had planned to build a lower to Form 1 but, after this ATF move, I feel as if that would take forever. I think there is a chance that NFA & GCA might get thrown out with the brace ban. Then those fools can just focus on Alcohol & Tobacco.

      The last lower I eform1'd back in May 2022 took 8 days. I am seeing approvals (on the R/NFA megathread) of around 25-45 days currently. Have also seen a few eform1 pistol-sbr pop up approved there, those were from 1/15/2023, so they are getting them done pretty quick.

      @@FutureWarlordOfHomestead Maybe, I am still waiting on a can but, it is form 4 of course. It was certified in August of 22. A couple of cans before that only took 4 months total. So, according to my dealer they are getting in cans for April.

      No way the NFA gets tossed. Not in today’s political climate. The gun brace thing is any story. Courts could overturn that ruling like bump stocks.

      They'd still have to repeal the Hughes Amendment to make the price of machine guns come down. With the Hughes Amendment still intact machine guns would still be just as rare.

    In my opinion, the brace rule will be tossed out. In the short term, I can see SBR's, SBS's, AOW's, and Silencers being removed from the NFA. Machine Guns and Destructive Devices will be removed only if and when the ATF is abolished. That would be a good long-term goal.

    I highly doubt the nfa goes away. There’s always another battle being fought in order to focus on it getting repealed, like this brace issue. I do think the pistol brace war is winnable and will likely end in our favor.

    Well ,seeing as how the NFA has never actually been challenged to define whether or not it is Constitutionally validatable ,and the ATF seems to be pushing their authority beyond even what the NFA was purposed for...
    I'm going to believe the executive branch relentlessly attacking the rights of the citizenry will result in the possibility of repealing the NFA or at least a reduction in the scope of authority that has not been granted by congress for the ATF.

    I see 1 of 2 things happening: 1) the Supreme Court rules that they can't do this and everything goes back to normal or 2) they rule that the ATF CAN do this, but then point out that because these items are in common use, then all of the SBR portion of the NFA is unconstitutional. I'm hoping for the first just because of the precedent it would set that federal agencies have the ability to change law on a whim.

      Common use will never be an argument they will consider. Ar15's are common use, they want to ban them. Pistols are common use, they want to ban those. Standard capacity mags are common use, they want to ban those.

      @Smoking Crab it's a legal precedent that the Supreme Court has used as a ruling. Just because they want to ban them doesn't mean it will hold up in court.

    I live in Oregon and do armed private security. In Oregon we don't have CCW permits- we have CHL( concealed handgun license). Meaning if it's a gun and you're concealing it it can only legally be a handgun. So if one of us were to SBR one of our AR pistol builds we would no longer be able to conceal it because that would be changing the designation of the firearm.
    TLDR: in Oregon one cannot legally conceal SBR's, SBS's, AOW's or machine guns and I'm sad about it.

    Any tax relating to 2A is gatekeeping weapons from the poor. Imagine if there was a $200 fee to mail-in your election ballot, or a $500 fee to not be censored on social media for saying certain key words/phrases. Pay-to-play with Constitutional rights should not be tolerated.

    When you do a form 1, they do ask for a picture of the serialized area of your weapon. Now it can be cropped and all you see is the serial number and model, the picture doesn't have to be of the whole firearm.

    Someone have rightfully pointed out that the bump stock case took 4 years to resolve.
    However, that was before Bruen. I am hopeful that this gets enjoined before the 120 days is up, but it will probably initially only apply to the 5th Circuit (TX, LA and MS).
    Other states will have to endure the new “law” in the meantime. This is particularly troubling for the states that ban SBR’s.
    The pro 2A lawyers who filed the first lawsuit are playing it safe and trying to use precedent in the 5th circuit (bump stocks, etc…) to establish precedent on braces. This is playing the long game in case other circuits (9th Circus) hear cases and perform their usual mental gymnastics to find that their buddies at the AFT have it right.
    Many think their will be differing opinions, which will ultimately lead to this being heard by the Supreme Court.
    I am not a lawyer I just read and watch UA-cam too much.

    I'm all for anyone owning whatever they want. I also realize that there's pros and cons to owning a SBR. My only issue with this tax forbearance registration or the other options is now the ATF is tell god knows how many people do this with your legally purchased items or possibly go to prison if the wrong person catches you. Personally I'm going to wait this out for a bit to see what court cases gain any grounds but have been looking at 13.7 and 14.5 complete upper receivers that are pen and welded just in case this stick's for a while I'll at least be legal lol. When I do decide to bite the bullet and register my lower receiver as an SBR I'm going to just pay the two hundred dollars regardless. I don't want nothing that is so called free from our worthless 3 letter agencies.

    I decided to do the "free" SBR registration on my AR pistol even though I believe the new restrictions will probably eventually be overruled. I use mine as a UTV rifle while hog hunting. I have to travel long distances around a huge ranch and the handy shortie is great for anything I happen to come across while driving my UTV. I also have to drive 400 miles each way to get to the place where I hunt so it wouldn't be wise to travel around like that with what could possibly end up being an illegal weapon according to the ATF. I did mine through Silencer Shop and the process was easy and pretty painless. It was approved in about 3 weeks and that was the end of it. The only picture required is of the markings on the lower including the serial number. I just did a close-up of the markings and no picture of anything else is needed. I guess if you never use yours or never leave the house with it the chances of any legal issues are slim to none but if you travel with it and actually use it the risk is much higher. I think the whole thing is bullshit but I also feel each person has to decide for themselves what is best for them.

    The inclusion of SBRs in the NFA is being specifically addressed in the most recent lawsuit that was filed Feb. 8th. There is a possibility that SBRs will no longer be a thing.

    The rule will be overturned, but it won’t undo the nfa is my prediction. The atf will state the change back before they let the nfa go down. They would be only about tobacco and booze if that happened.

    I clicked on this video to find out if the adjustable brace thing that's on the AR in the picture of this video is illegal. New gun owner here and im trying my best to keep up with the rules, so those "braces" that can extend ….. are those also illegal ? unless I skipped it in the video, i was really looking forward to him explaining if it is.

    In Texas, an SBR is a grand idea over the pistol AR's.
    This is because Texas law requires you to have a handgun in a holster to carry it. For that reason, my AR-15 pistol is relegated to being used just to repel zombie hoards.
    An SBR does not have that requirement, is easier to use as a short barrel tool, is more versatile due to no limits of foregrip use, and are generally easier to use, which makes them a great option.

    I ain't gonna lie. When I heard free SBR stamp I went right to the ATF website and brought up a form 1.... Luckily the site wasn't easy to use and all it did was bring up a PDF form that I couldn't type any text on so I changed my mind and didn't go through with it

    IMPO, I think we are lucky if we go back to the status quo prior to the brace rule. While SCOTUS has given us Bruen and are relatively right leaning, I dont see the court wanting to take on federal gun control laws and the brace rule will be enough to placate the pro 2A crowd for now. I dont think the NFA has any worries...

    I don't think the NFA will be repealed in my lifetime(38 currently), but, I do think the current "Brace-Pocalypse" might result in SBR's being removed from the ATF's purview. Currently have a eform1'd SBR, and have a second lower "submitted/in process." I figure the more SBR's there are, the more "common use" they will become. Never been much of a AR-pistol person, brace or not. Had one before the braces existed, meh. Also have a Dead Air Sandman S, so I'm on all their registry lists anyway.

    I think the whole thing from the NFA as a whole to the SBR stuff should and will eventually come to an end. It’s ridiculous to pay $200 and fill out a bunch of paperwork to remove a few inches of barrel off a carbine, or just to add a stock.

    Maybe this is a stupid question since you kinda addressed this in the video but if I wanted to sbr my 223 lower for 11 inch barrel but also wanted to periodically throw on a 9 inch 300 black out could I do that if the paperwork was done correctly or would I need two lowers?

    I don't agree with any of what's going on and you should be able to have whatever barrel length you want but that being said if you normally would use a 12.5" or 11.5" pistol then migrating to a 13.7" pinned rifle is not too different in practical terms, STILL MEGA DUMB but its a nice option that exists

    The form 1 asks for photographs of any markings on the receiver. I’m not sure of they are required but it does ask for them.

    So if you register your firearm with a pistol brace on it and get the free stamp can you then treat it like a full sized rifle ie put a stock on it, vertical grip, etc once you get the stamp? Sorry if that's a stupid question, I'm new to firearms.

      Yep. It then an SBR and you do what you want. I sent form 1 for both of mine. Its free and they know what you have anyway unless you bought it from another private person and not an FFL.

      @@teewhy2602 That's not true, they don't know what you have. The NICS and the 4473 are only in the hands of the FFL that sold the weapon to you. During an audit the ATF can only "check" your books, they can't make copies and they can't take pictures of files. If you bought a gun on Wednesday and had a NICS and then on Thursday, you decided to purchase another gun you would be subject to another NICS. Why do people keep saying this? It's all untrue!

    Purely out of curiosity, is there a practical reason for hanging your rifles upside down or is it personal preference?

    It should go away but don’t hold your breath. If you want it and can get it “SBR and or suppressor” do it. The pistol brace costs more than the stamp. Form 1 your pistol in less than three months. Suppressors are like babies at 9 months, cheaper in the long run but worth the wait. Take them out and use them. Let people know they are no big deal. Make them common. The more common the harder they become to keep under the NFA.

    Eform 1s have required uploading pictures of the serial numbers and any other markings from the manufacturer.

      So all my Eform1s that didn’t have pictures… and the ATF’s own words say that it’s not required…. Means nothing I guess because there is a space. Hmmm my life is a lie.

      @@JamieFaux-qi6ip I paid 400.00 in taxes to make my DD 556 useful. Though, if you’re like me and want less noise, I highly recommend a bootleg BCG. I thought the full auto Colt SBR’s I had to qualify with stunk like ammonia. A non flow through can was much, much worse. Though the added benefit a 75 gr 556 sounds like a .22lr going off.

    I think there are 3 likely scenarios
    A.) This sticks. Whether people want to admit it or not, this has much more solid legal ground than the brace fiasco, and the ATF has a history of issuing amnesties that have held up.
    B.) This gets temporarily injuncted, but the actual court proceedings WILL take longer than the 120 days, so if the ATF wins in court, you will be past the compliance date.
    C.) This eventually (maybe within 5 years if we are lucky) makes it to a high enough court and is found unconstitutional again though, this takes longer than the 120 days, and you could still be arrested, tried and convicted before this happens, Maybe, maybe maybe the NFA gets thrown out.
    I think situation A and B are the most likely, if I had to give it odds id put it like 50/40/10.

    My pistol looks like an SBR. It has an arm brace and a 10.5" barrel, however it is not an SBR. It was manufactured as a pistol, sold as a pistol and bought as a pistol.

    The Supreme Court recently ruled that when it comes to gun laws....we must consider History and tradition. I would be willing to wager that in a museum somewhere, there's a rifle or shotgun from the colonial period that the original owner cut down to make it easier to use in a coach or buggy. 🤔

    I think by them trying to do this new rule, just gave proof that they are not that dangerous of an object that needs to be on the NFA. Having 10 to 40 million of them is quite a bit of proof that they’re not dangerous. I also don’t see an advantage for individuals that live in Ohio to have a SBR over a pistol. That is if you only have one or two.

    Let me start. I know and agree this is unconstitutional bs. Please understand, I'm aware, and it hurts my soul to ask this question.
    If someone has a pistol and wants to convert to an sbr, is there any benefit to going with the standard form 1 and paying the tax stamp over using the amnesty form since the form explicitly tells them that you have a pistol brace or at least they can infer that you do? Also should you undersize the overall length for safety or will that open you up to more issues?

    The Form 1 absolutely does want a photo. A photo of the serial number, not the whole firearm.
    I do not think the NFA is going anywhere. Entities like the GOA, who're supposedly on our side, would be out of a job. So why would they fight the NFA when they can make tons of money playing wack-a-mole with unconstitutional rules and laws like this?

      I'm not a lawyer but I think you would be fine here. If a cop looked at your rifle that fell within "standard legal configuration." they aren't going to consider asking for your stamp. If they asked for your stamp you also don't need to present it because they aren't the ATF. Might land you with an arrest till they get an ATF agent on site (if they really wanted to play that game.)
      If the ATF can say a person remanufactured something by putting it to their shoulder. you damn sure can say this is not an SBR in its current physical configuration... Because it is not. Sure you registerd that lower as an SBR. But thats an option the way I see it. Not a must, you are allowed to use that lower as an SBR, you aren't required.
      I wouldn't bring the SBR upper along for the ride for state crossing though if you are worried about the king.

    I don't care anything about laws or rules to be honest. I was kicked out of school because I wouldn't mind, my parents couldn't do anything with me, I was kind of a "bad" kid. That followed me through the years so now that I am 45 years old I don't particularly care what the ATF thinks or does. If I want an SBR I'll build one and not say anything about it. Just like when I smoked dope, I did it every day I just didn't do it in front of my parents or my teachers.

    I already have two registered SBRs so doing a third one for free won’t bother me. That being said, on the current “updated” e-form 1… there IS a section to upload pics of any engravings currently on the lower. I know this to be fact because of spent the last 4 fn days trying to complete the form one to no avail.. once you get all the way through to the “verify” section it will not let you finish until you’ve completed ALL the sections correctly and that photo section is one of them. It’s aggravating as all get out so if I’m missing something here please correct me :)…..not arguing with you…just stating my experience with the updated form 1 right now…also I listened to the ATF webinar TWICE and yes they did say photos aren’t required but evidently they neglected to tell the form 1 :)

    It will stick. They will use the reasoning that a "law" was not created, they just "clarified the rule". Nothing will come off of the NFA. it is like taxes, once its there, its not coming off.

    This whole debacle definitely opens the door to the entire NFA being seen as pointless and unconstitutional, however I have almost ZERO faith in ANY "elected" "representative" to actually do the right thing and get these stupid laws repealed. So who the hell knows. It sure does make you realize that the ATF's power mostly comes from the "law abiding" people out there trying their hardest to continue to be "law abiding" given the ATF has almost zero actual enforcement power unless you are breaking some other very serious law.
    Contact your sheriff and push them to make your county a 2nd amendment sanctuary! I've talked with mine and luckily live in an area where the sheriff has pledged to not help federal thugs enforce any of this crap.

    Half the ARs I own were purchased with braces. A couple AKs and and FAL, too.
    While I think this is a load of flaming bovine manure, it seems reasonable to register at least the few I'd actually like to be able to use as legal SBRs. Still kinda torn about it.
    There is no logical reason I can find for this ATF action, and no rational argument for SBRs to be NFA items to begin with. But hell, maybe it's just me.
    Thing is, I have several brace equipped lowers still sitting new in boxes that have never been opened. That's problematic and potentially expensive.
    Thinking it should be more an individual may or may not, like concealed carry, rather than register a damned thing.

    I am an attorney… do not hire one or consult one for the AFT pistol brace rule! According to National Bar rules and ethical cannons, ALL attorneys must advise you to follow the law. Attorneys cannot ethically tell you to not follow a current enforceable law, without subjecting and risking their career and professional license.
    Caveat… NON LEGAL ADVISE AND PERSONAL OPINION: the current aft rule is absolutely unconstitutional and should be struck down by a federal court… eventually. Remember folks, it took years for the bump stock case to be rendered. Same with the Bruen case. The brace rule will take years of litigation and even possibly an executive order after the 2024 presidential election (God willing).

    The machcine gun also include “readily convertible” as criteria.
    Why can’t I drill my AR a 3rd hole and keep my semi auto trigger?
    Oh ATF guy says it’s READY TO DROP THE AUTO TRIGGER IN.
    So wait what about lightning links? No receiver mod - all are readily convertible.
    The AK47 can be converted via SHOESTING according to these guys.
    Oh also, what do I need to do to make my regular ole carry Glock auto? Nothing at all to the frame? Change the back plate? All Glocks are machine guns.
    This means 3 of the 5 most common guns of today are machine guns by definition. It wouldn’t take much for a 10/22 or maybe a 3D printed anything.
    This proves machineguns are officially common use and protected. They can’t be a part of the NFA.

    Common use item. If they say it makes a pistol into a SBR then they shouldn't be taxed to begin with. Shall not be infringed. Cannot tax a right.
