    I swear it's like this movie was destined to have a million controversies that people can use to fetishize the "darkness" of the behind the scenes process it had. Plagiarism is definitely an interesting topic. I think similarities in any media are inevitable and that something has to be truly drastic and obvious to be plagiarism.
    Lund's piece is definitely interesting and maybe somewhat eerie to listen to with this knowledge in mind. The bit at around the minute and a half mark is a bit haunting. With the context in mind and the utilization of minor key, it sounds a bit like a distorted or inverse version of Over the Rainbow. I agree that the similarities were probably not deliberate. Even if they had been, Over the Rainbow is clearly its own song that utilizes these keys in a different way. I think the Over the Rainbow-esque moments in the song are pretty brief. It's definitely a fascinating topic and yet another example of moral grayness in The Wizard of Oz.

      That's an aspect I didn't think about! Another stupid talking point on how "dark" Oz supposedly was in development... gosh am I so sick of hearing those videos! Every movie has crazy behind the scenes stories, how is _The Wizard of Oz_ any different?

    I listened to the Concert Etude 38 and can't deny that there is a similarity. I'm also guilty of thinking I've come up with an original name for a character, only to read or hear it later on and realize I got it from an external source, so I definitely can't throw stones.

    I just listened to it, it is a very small portion of the music, but it does sound almost the same, but Lund's has more trills with and a lighter tone. I'd chalk this up to either,what we call nowadays sampling, or coincidence for those notes are easy to play around with as you jam out. Even if it was deliberate like I said earlier it isn't the main bulk of the song or even the chorus (hook) portion of the song. It's not ok if it was delibrate, but everyone involved is dead now, so there's no way to truly know.

    I listened to the piece and it sounds like the issue is really maybe 3 notes. A lot of pieces have sequences of 3 notes in common. This sequence of notes is easily recognized only because it was used in Rainbow. You're never going to hear Opus whatever on "Name That Tune."

      It's certainly more than 3 notes, but it is possible that Arlen was subconsciously influenced by a distant memory of the etude without actually shamelessly ripping it off.

      I agree with both of you. Don't think this "Etude" will ever be as remembered or performed as "Over the Rainbow". Even if Arlen did plagiarize the song from Lund, I could never and WILL NEVER support an artist that supported the Nazis.

    Just focus on only the melody, which is the most important part; it’s the hook. It’s the part of the song that your brain first latches onto, recognizes, and then remembers, and it’s the part that you can hum. It’s identical.

    Over the Rainbow is based on the 1895 Intermezzo from Mascagni's Guglielmo Ratcliff.
