No punishment for political negligence 😂
For people who dont understand what is happening- drs are not against a real negligent doctor being punished.
The issue is that " medical negligence " is difficult to investigate correctly and many drs have had to lose license and money in false accusations.
Many patient's family try to accuse hospital and doctors of negligence to avoid bill payments, out of denial etc.
Also i agree with the doctor who spoke of doctors needing to take risk to save patients. And that example of gynecologist is very good.

Ull know the reality when u become a doctor... whether to take in serious case or refer...to save ur skin, referral is the best

Agreed..
The problem is that to implement a law, you need judges and lawyers.
Now if someone files a false accusation against a doctor for personal gain, then the "right" vs "wrong" lies inthe hands of the lawyer, who is obviously working only for money. The one who gets the better lawyer wins. Truth may fail.
Responsibility of state to prove accused is guilty
@@anilraghu8687in criminal negligence, onus to prove innocence is on doctor. The doctor is already charged as guilty by the state. Just opposite of what you stated

Doctors should play safe. They should recommend referring the patients to specialized hospitals. Let the government open many specialized hospitals with all infrastructure, medicines, machines, etc. If any hospital does not have all infrastructure, medicines, equipment, machines, labs, etc, the doctors should raise the issue by email, to the promoters of the hospitals/ Dist. collector for government hospitals and shift the accountability.

Actually, the people of India are the ones who are going to pay money, not doctors.. in foreign countries, all hospitals and doctors have taken medical compensation insurance policies. It is the insurance companies that pays the compensation amount to the patient. And the extra cash needed to pay the premium of these policies is paid by the patients by adding it to their hospital bill. doctor or hospital is not paying the insurance premium from their own pocket. so, in foreign countries, this medical compensation only increases the cost of treatment for every patient. It does not affect the doctor or hospital in anyway because they are not paying money to anyone. only patients are actually giving money to insurance companies to pay for their own medical compensation. This is defining everything loosely. No doctor will take high risk cases. Out of 100 high risk cases, there is percentage mortality in every country. Ab kaun risk lega.
Now only first aid n refer. Ya branch change to less risky practice.
Already everyone i know, is thinking in this lines
Doctors must argue: " Jail sentence not required; cancellation of medical licence will do. But negligence law must be applied to judges also and it is they who must be sentenced to 5 years jail if a judgment is rash, negligent biassed and conflicts with judgements on similar cases and situations".
There must be a sop ( standard Operating procedure) for treating a patient in govt and private hospital. Violation of SOP is liable to punishment to medical professionals. Otherwise not.
There already is SOP for every disease. But high risk cases u can't predict who will respond to drugs given. Risk of mortality is always present. Fir eg Any obstetric case can go into DIC. it happens. Any surgery can have risk of pulmonary embolism. After year's of experience also we can't predict always.
Now no doctor will take risk of jail time by treating high risk cases. They will refer. I have right to refuse case. Only common people will suffer.
Medical treatment is not like advocacy when particular law works
Sop😂. Bull shit. Refer everyone to higher centres.Treatment will become so costly in future like us/uk. Only corporate hospital and people with insurance survives. Lets go to hell.
Yes there are protocols "SOPs" for treatment but if every doctor starts practicing strictly as per protocol then people without medical insurance will go bankrupt for sure....Making decisions for treatment require years of practice and clinical experience....for each symptom a patient presents with there can be atleast 100 differential diagnosis which an efficient doctor rules out and narrows down based on experience and some lab tests....this experience is not something you find in your SOPs, human body is not simple maths like 1+1=2....as per standard protocol there are multiple tests to rule out each differential diagnosis and if doctors start ordering tests for each and every suspicion you would go bankrupt without medical insurance....your argument is invalid for a resource limited and economically underdeveloped country like India....If you have a doubt you can ask any person living in any 1st world countries about how medical system works there and how much is the cost of treatment.....
This is why India is backward here educated people instead of taking higher responsibility they want a concession for doing crime.
Medical negligence is real and it need to criminalise if need can be done with more debate and discussion but it should be criminalised.
In India, when patients can't be saved , people simply blame it on doctors as negligence. People don't even wait for a detailed investigation by the medical board. Today everyone is a doctor graduated from an Internet university. Doctors will simply stop treating very sick patients, and will refer them to higher centers. It would become more problematic for patients.

They know clearly that not only will the doctors be affected badly by this but the patients will also be badly affected,I like to think the institution runners are somewhat literate, obviously they are not doing anything in the benefit of the people of india, just for the politicians...
What are the sections under which punishments for "negligence in drafting laws" & "biasness towards govt by media" defined ? This video will be taken as evidence for sure
In a corrupt society where police and Advocates are corrupt, it is difficult for doctors. Politicians get away with all sorts of negligence
IPC cancelled BNS comes, next comes Manusmriti, no democracy will exist, no constitution will exist, monarchial administration will begin. JAGO MODI BHAKTH JAGO🙄
im not bhakt but in our country accountability must be there in all sectors. from top to bottom in every walks of life.
If the medical negligence is proved the concerned doctor should be accountable.
The problem is.... people can be falsely accused of medical negligence and its very difficult to prove.
Why isn't legal and judicial negligence called criminal offence. The lawyers in our country openly take bribe and finish off the plaintiff s case even if he has the strongest case. There is no body that the lawyers seem to be answerable to. Even the bar council of India has a disciplinary board that is run by lawyers for the benefit of lawyers. Why? Why aren't the law officers held accountable. Even judges when found guilty, are asked to resign instead of being dishonourably discharged and they are still allowed to practice law!!?? Why? And why are lawyers allowed to join politics and still practice. Why make the bhakshak so Powerful that it is easier to be a victim without justice than to trying to get justice
Law should Specify difference between Gross Reckless MEDICAL Negligence And Failure of Treatment especially high risk procedures . Otherwise who will take up Sick CRITICAL cases ????? Government and BJP had promised to Exempt DOCTORS from purview of Section 304 a and 106 BUT opposite SEEMS HAPPENING ?!!!!!!!
Not following protocol like surgical safety checklist then wrong surgery etc is negligence
There is already a medical board to see for gross medical negligence. Board constituting of varities of super specialists. Doctors are convicted if there is gross negligence.
This is different. Now high risk cases will no longer be seen by doctors for fear of false cases.
Judge will decide if it's false case but until then doctor will remain in judicial custody for years
Out of 100 cases, atleast 5-10 are high risk case. Doctors want to save every life but not at DAILY risk of prison time
Didn't study 12 years for daily jail risk
@@ProcalcitoninC oh ok
But in India it's not possible to follow all the protocols and checklists mentioned in books

What are the guidelines that are not negligence
Medical negligence is real problem in india thankfully legislature is ready to deal with it. It will be first time in india where doctors will be held accountable for their professional inability or misconduct. We are tired of negligent doctors. Why doctors should be untouched from criminal liability when they negligent? Long years of study can not be answer to this question like doctors are trying put up in discussion.
With that kind of law no doctor would ever touch a serious case or a dying person who is in a casw of emergency.
Make special criminal section solely for amit shah.. And his team.. Shameless
May be the new NEET examination quality might be the motive behind the law😮
Too much corruption in the medical field will lead to this...from the medical practitioners to medical entrance exams...nothing is taken seriously..
But instead section should be inserted that all cases of accusations of criminal negligence must be dealt by committee comprising of doctors from state medical council along with ips officers and retd judges.
Great work!
Welcome to the world where doctors will no longer take on serious cases and just refer them.
No one wants to be jailed wrongly for trying to save a life.
I can guarantee that many people will die due to this and it won't be the doctor's fault.
In INDIAN clinics & many small & medium scale hospitals you have unqualified paramedics.
cancel their license. human life is priceless
Why is Modiji making New Laws without implementing the excellent Existing Laws against continuous Killings going on in the Country??????
Excellent existing laws? Made by British to prosecute innocent Indians whom they used to consider gulams.
The government of India should start constructing Jail that can House 1 lakhs minimum as there’s more chance of being caught than sleeping.
Medical negligence is real. It is done to all patients who are 60 and above.
Cost of treatment will go up like in US.
They want that. More GST and income tax from doctors, more income from LIC.
@@kiransankarpati Half docs owing clinics in India do't pay tax, Do you know that?
How does it even related to this law? Means Doc's in India indulge in malpractice
@@ramm6258 they don’t pay taxes on that part of money which they use as expenses, still to some extent they must pay taxes , otherwise whole property would become black money. Hospital fee will be costlier too. Corporates don’t like to handle black money either.
@@kiransankarpati brother, when collecting cash for which people gets no bills in clinics are no joke!!
How about some laws against the police department ? Wouldn't that be comforting for the whole country.
How about hundereds of thousands of cases of corrupt or negligent doctors where people suffer every day and have no one to complaint to. Why are laws very strict in the west but any strictness against authorities in India, Doctors, Police and IAS resist with full power.
It's a good move . Doctors should be responsible for the negligence..Thanks to Amit Shah..
doctor writing brand name and geting commision from Pharma company's should be ban and jailed
The most important point.. Mate...
Feel free to buy generic no one stopping you
Those who are arguing for Doctors & hospitals with this new law saying "Doctor should not be punished" is agreed.
The point is not to argue with this law but Doctors who are honest to serve and common people should wake up and ask government to reduce treament money drastically having this law in place. Only an experienced doctor should be working on critical cases. We cannot simply blame all the doctors.
What do you mean by comparing a doctor to LEVEL of politicians??!.....we doctors go through immense amount of studies..we invest immense amount of our money and time to acquire the knowledge.. during the journey of becoming a doctor every single one of us has faces the unimaginable amount of stress, anxiety and depression at certain points....this profession is called an NOBEL profession for a reason!......and on the other hand to become a political all you need to do is gather votes..which are not even gathered by being loyal to those voters...they lie, they pay money for the votes, they distribute free alcohol for the votes, they make false promises..and most of them are even uneducated if you're comparing to a doctor!.....we doctors work for the greater good of our patients..and those politicians work only to win votes again in next term....i guess this should state who is selfless and who is selfish!
No one should have blanket immunity from the law of the Land btw Doctors attitude in India is beyond tolerable
Ever you seen Judges in court ?
majority of them dont know how to treat patients.
Have you ever seen a local contractor 😂, yuva neta
Out of every 100 patients treated, atleast 5 to 10 are high risk cases who can die. Immunity is not needed. There was already a medical board to decide if there was gross medical negligence.
No doctor wants to do gross negligence. We are also humans. But now no doctor will do high risk cases.
Only patients will NOW suffer as they will be referred.
Doctors hain to save lives. But not at risk of jail. Whether it's true or false case, court will decide...till then doctor will be in judicial custody. Samjhe ap?

Fine. If you are that low confident then don’t become a doctor. Beside, to become a doctor, only a dream is not enough. If you don’t have potential then you should stay away.

Very difficult to practice as a doctor , multiple factors involve late presentation , less manpower , acceptance of reality by relatives , death due to complications can happen in very high risk Pts . This is a joint effort .
This law is totally disastrous for doctor community . Even there will be a time when there won’t be any doctors in our country who would treat a pt or do a surgery .
This law was required to be implemented a long back.
This is actually a masterstroke that should be appreciated.
🤡🤡🤡🤡 no doctor will take serious cases and now they will order lot of test to confirm the diagnosis, so good luck with that.
@@astlinj that is actually good.
I am fine with spending extra money on diagnosis but there should be no negligence in the treatment.
Finally, there is accountability for them and they can't run away from their responsibility.
Finally, some government showed the guts. Otherwise a general person can’t even do a single thing against them. Many doctors don’t even explain to patients party what treatment they are doing… anyone in a painful condition lying in hospital is not romancing. Why are they so scared? It’s not that they will be jailed without investigations. Why do these people even become doctors if they can’t even have minimal guts to take responsibility. You love it when people give you all the respect and money but you don’t like the part where you will have to take responsibility.
Bro u r unware Drs deals with life n death every day not less than 50 critical patients no profession is so close to death like drs. they r more vulnerable to get negligence case every day how will they treat patients with such fear..They will stop taking critical cases so that they will be safe n advise every investigation to confirm the diagnosis which will ultimately burden patients pocket..even after all the medical knowledge sometimes patient can not saved every living being will die jst because family lost their loved ones they can't blame Drs for everything..yes their should b a medical board to decide medical negligence neither patient, police, lawyers r not qualified to understand the technicalities of complications..
Taking responsibility for false accusations? You probably are bitter because you couldn't get a seat in a medical college.
If it is negligence, surely the person responsible should be punished . What is wrong with that?
