      Doctors have always been a soft target & have been used as a punching bag bu both govt & pubic just to vent out their anger or simply just for an act of show.
      Its high time doctors MUST PROTEST this nationwide. Otherwise such a law is bound to be misused & every dr will be forced to live in perpetual anxiety.

    Just imagine a scenario where
    An accident victim because of rash driving is brought in a serious condition.
    He will obviously die
    How can the DOCTOR be responsible.
    The person who gave licence
    The absence of street lights
    The potholes inthe road
    The government is responsible for his death and not the doctor alone

      @@senthilradha9104 The doctor should then get insist for indemnity bond from the patient and his relatives on a stamp paper of 200 Rs duly notorised before a notary public. He should apply to a court of law to exempt him from any criminal.liability if the patient dies during or prior to commencement of treatment

      You guys are confusing the issue. Don’t overlap things and make it into a kichidi. The talk about medical malpractice is different from knee jerk reactions or others rushing docs to get answers, or hurting doctors. The issues are linked but they are totally seperated legally. So STOP confusing the issue.

      Go and compare how much malpractice is happening and how much violence against doctors happen.. Less than 1% of doctors might be doing malpractice but take off sometime and go to a government hospital in rural setup.. Spend a day there with the doctors..
      U will see that violence is not only present at a physical level but also at a mental level from within and outside the system..
      This was a more burning issue and i was disappointed hence have all right to express my view..

    No issues. Most Doctors will not take risks, especially in smaller hospitals. Corporate hospitals will have field day in bills.

      Lawyers actually have two sides one is defense and other one is prosecution. The duty of prosecution is to make sure that whoever does the crime is actually punished by law. The duty of defense is to ensure that the person whoever you are defending is protected. Also if the criminal is not being punished means the lawyer has very good argumentative skill. Also in law there is something called appeal even if you fail in lower courts you can file in higher court and go to supreme court as well. This is not possible in case of doctors. Will you be able to retrieve a lost life? So please educate yourself before commenting

This is the principles of justice and many lawyers are unfortunately bound by this. To escape liability there is only one way is to document everything we do.

What if patient dies in the mean time?..Make no mistake, lawyer, judges have infinite time. They are least bothered about time. And you hold doctor responsible for every death? Doctors are also humans. They can also commit mistakes, errors of judgement. And they have to take quick decisions. Judges, lawyers differ decision making.

    We have the most overworked, underpaid health workers. Who already have the highest suicide rate and unnecessary bonds to pay , this all to keep our country with least %GDP invested in Heath care and even almost no one health Innsurance . Now govt has started to compensate that less GDP with our money (as if thr govt officials where not extorting bribes from hospitals already) now they have criminalised us too .

    This makes more safety to take by doctors not to take risk for patient…. Will definitely reffered the patient to higher center….severe patient may die during transport or by paying bills….

    Yes a doctor cannot save lives until he takes risk as required. The new BNS might be misused. Also Doctors come under CPA.
    The medical profession cannot be branded as a ‘business’ or ‘trade,’ just as the patient cannot be reduced to a ‘client’ or ‘consumer.’

      ​@@sadanandgote5544 You could have also done by word of mouth right? Why do you need advertisement? Seeing your advertisement only people come and pay bills. Do people negotiate for the bills except when you are running very small hospital..
      In case of lawyers we are not allowed to advertise we get clients only by word of mouth. If you do not have good network you cannot practice. Many people negotiate with lawyers for the fees even corporate companies. This is the reality of legal profession.
      Society will never do this with doctor in fact they are viewed as Gods and there is nothing wrong in consider doctors as God's. Because doctors have worked hard during pandemic.
      But on the other hand lawyers are viewed as money grabbers and equal to criminals.

    Shame..This will discourage good doctors to take up surgical and emergency fields..ppl with lower ranks will take up risky fields of medicine and surgery,most doctors would refuse to treat risky patients..health system will further worsen..

    Long gone are times when a hospital was run by doctors.
    if anyone has ever enterd a hospital nowadays, they'd know the reality of who actually runs the place, and in reality doc's have the minimum say in stuff happening there.
    firstly, if they are talking about bringing "strict regulations" for patient safety (which is absolute bull btw, they dont unerstand the consequences of this change of law) it should be talked about someone who has been in the field or atleast knows about it
    [on another note why is there no stricer regulations for doctor safety against patient violence, are'nt we humans of this country too? that deseve safe work place? ]
    and secondly why are doctors only talking the fall for others mistakes too.
    again hospital and patient management is a team work run by the perfect synchrony of multiple staffs like doctors, nurses, technicians, physician assistants, helpers, hospital administration etc.
    in my opnion of having 6 years of experience in this field of "nobel profession", everyone should be held responsible for their shortcomings in their respective jobs. anyone in the team, not just doctors.
    its human nature to feel like " anyway its going to be someone elses headache in the court, so why bother".... stricter laws focusing on allll and everyone in the field is more fair.
    i'm sure most of you are aware of the recent trial that went against a nurse in the US about giving wrong drug to the patient, resulting in the unfortunate demise... the respective staff was held for trial in court and got their punishment, not the doctor.

    As a doctor. I don't take any risks 🤣. Laws like this is the reason why we take 1 look at a patient and tell them to go to medical colleges. Why should I take un necessary responsibility , hire a lawyer and take leave to go to court, when I can just refer the patient to a medical College . Defensive medicine is the only safe way to practice in India.

    These laws are made in such a way that it appear Great in front of public, but indirectly acting against the will of Commons. When these kind of laws comes into practice the Doctors in small hospitals won't take any risk and will refer the patients in critical conditions to either govt medical colleges or big corporate multi speciality hospitals. Everyone knows the conditions in government hospitals, so the public will be FORCED to go to Big Corporate Hospital business centres like apollo,aster,narayana,sagar,birla,reliance ..... So are these laws really in favor of public interest ?? Think 😊

    Doctors should learn something atleast now... limit number of patients intake to optimize care... less patients... more time to spend with each patients... since doctors who face highest occupational hazards, no need to work overtime or extra hours... Once the bell ring, pack your bag and go home... have a good sleep... work stress exhaustion can make to you take wrong decisions... doctors can charge for breaking bad news to patients and grief participation.... and charge highest compensation and insurance claim from patients... since patients have right to choose... and doctors have right to make patients not to choose you...😂

      Taking in less patients , means we'll have to charge 4 to 5 times more per patient to run a clinic. Clinics need to pay Rent, Electricity bills , Salary of nurses, pharmacist, lab technician, cleaning staff and Security. You think that is possible if we take few patients??? The government is not providing us with free land and free building, we have to pay taxes and bills. Then why would we limit our patient intake??

    In Kerala, medical negligence is happening now a days but none of those doctors were punished. A doctor forgot to take the scissors from the stomach of a lady, she lives with that scissors for more than a year, at last it has been found after MRI scan. Another doctor had done surgery in mouth instead of hand, and he also didn't received any punishment, also he tried to escape by saying that the kid has also an issue in mouth, where is their ethics? Medical college Vandanam Medical College in Kerala is known for medical negligence among pregnant ladies. So many pregnant ladies lost their babies because of this medical College. Once a patient has been found slept with maggots and the government suspended the superintendent of that medical College, that time all the doctors leave their jobs and gone for strike then on the next day, suspension has been cancelled. This is the situation, government has given so many previllages to doctors, but they're misusing this previllages.

      In Kerala, the state government has made some ammendments to give previlages to doctors. As per that ammendment, a doctor can file a complaint even if the patient questioned them against the service. So many doctors were misused this previlage. A lady doctor of one of the medical college from Kerala filed a complaint against the bystanders, she said that she's been beaten by them. But in the next day, she withdraw that complaint because the police checked the cctv visuals and found it was a fake case. Some arguments occured between the doctor and the bystander, it's regarding the poor service provided by the doctors. This was one case, like this so many incidents were happened. Doctors statement were enough inorder to remand a patient. One of the MLA, KB Ganesh Kumar (Now he's the minister of transportation in Kerala) from the ruling party also mentioned about the misuse of these previlages by the doctors

      The fact that you are telling scissors in abdomen were found during MRI proves it’s a cooked up story MRI magnets are so powerful the scissors would have ruptured all internal organs in the abdomen and it will be pulled out by magnets in MRI the patient could have been dead of the story were real and no patient would have survived for 1 year with no symptoms with a foreign body in their abdomen and if scissors were found why would any surgeon will not remove and levave it in situ so you are saying literally every doctor in kerela was negligent and did not remove that scissors

      Stop spreading misinformation if patient had scissors in abdomen and taken to MRI the magnets in MRI will pull the scissors out and damage all the abdominal organs and will also damage the MRI machine the fact that scissors found in abdomen in your story by MRI says it’s a fake story and don’t dare to delete this comment too like you did to my previous comment people like you should be severely punished by law for spreading such misinformation
      Just don’t spread hatred bcoz of your personal agenda might be you are one of those students who was not able to crack NEET and you hate doctor community or one of those blind believers who trust every story shared on WhatsApp and UA-cam without verifying it
