This is a rare ticket to get, there has to be two police vehicles really, and the second officer really has to be looking for it. Which is what happened. So, yeah, he was probably going to get the ticket. But, getting aggressive with law enforcement is always a bad idea, you've got no hope if you do that. That's just basic math...

As a driver with almost 5 decades of experience, the one thing I can pass on to other drivers is that law enforcement officers have a lot of discretion during an encounter and a person's attitude and demeanor have a great deal of influence on the outcome of the encounter.
As showed in many fwf episodes when frank give warnings or only citation when he could give criminal ones. It depends, as frank himself in one episode said, as you also state on the behaviour and attitude of the stopped person what comes out of the encounter.
Just keep your hands on the wheel and do what the Deputies asks you to do in the order that he or she requests of you. Be respectful and listen to the explanation of what law you violated. You might learn something!
People fail to recognize that while they may ideally have a traffic stop only once every few years, LEOs have many per day, EVERY day! I doubt this guy knows traffic or case law better than Frank.
Someone's got to explain this to me, im a little slow. So the cop had someone pulled over, on the shoulder right? There are two lanes, and every car passing the cop in the right lane, has to move to the left lane? Or did the cop have the guy pulled over and was partially blocking the right lane?
@ - in some states, if you are able to safely you are required to give a one lane buffer. For example of a vehicle is pulled over on the shoulder, and it’s a 3 lane highway, you need to move over to the 2 left most lanes

After once having to change a tire on the side of a busy highway as a teenager I have ALWAYS moved over for any/all vehicles along the side of the highway. It's just a simple, easy, respectful thing to do not only for everyone else but for myself as well, as I don't want to have something terrible happen, that I could have prevented, on my conscious.
Yeah and that's exactly what he was doing--IMO when the cops are fishing for violators of SDMO laws, they should pull the worst offenders. I've seen cops in Georgia do the same fishing activity. IMO this one was a judgment call and if the guy hadn't popped off, he might have gotten a warning OR at least had some sway in court. At this point, he's probably got no way out of this one.
The deputy who stopped my mom for speeding years ago responded with this when she complained that she wasn't the only one speeding: Do you fish? (Mom: My husband does) Does he ever catch them all? (No). Neither do I.
Thank you Frank, As an LEO who had worked in the Traffic unit I have been hit on the by a driver, who was not paying attention. Unfortunately, yesterday, three of our deputies who were on the side of the road were hit by a motorist who was not paying attention. Two died and one is in critical condition. I would like to thank you for what you’re doing educating the public. To everyone please do not text and driver and move over when you see an emergency vehicles. These tragedies can be avoided. Thank you .

As a retired AZ State Trooper…. My condolences to the loss of those two Deputies and praying for the third deputy who was also injured in that horrible collision. I hope the driver that struck those deputies has a day in court for this reckless driving.

In Michigan, the SDMO law applies to any vehicle on the side of the road. You are required to move over a lane if available, if you are unable to change lanes, you are required to slow down at least 20 mph below the posted speed limit. He did neither.
12 states and counting require this. If nearly a quarter of the country requires it, it's going to expand. Drivers should start practicing immediately.
I was thinking, all the way up here in Canada, that if I wasn't comfortable changing lanes, I'd have slowed down and 'skooched' over a bit to the left without crossing the line to be well away from the traffic stop. He either wasn't paying attention or didn't care given that he was over the speed limit by a bit when he could have been significantly under to ensure care.

In farm country, I've seen drivers force on-coming drivers onto the shoulder countless times because people don't want to slow down even for a few seconds to pass a farm vehicle / horse buggy / truck pulled over / cyclist, choosing to whip around them at the exact speed they were doing when not exactly safe to do so. A little care, defensive driving, etc is sorely needed.
I’m all for holding people accountable, but it certainly looks like there was not enough time for him to move over but I’m not there so I can’t make the determination as a first responder. I fully support the move over law.
Most judges are weird about having cameras in the courtroom. Frank has said that they tried to film a case that went to trial but the judge would not allow it. So if this does go to court, it would need to go to a judge that isn’t weird about filming
Love ya Frank, but that one was questionable. To me, it didn't look like there was a large enough gap between the 2 left-lane cars for him at 65 mph. I too am interested in seeing outcome in court. Also, let's take a moment and applaud in the fact he had current registration and insurance! In Colorado, there is an unhealthy amount of expired tabs on the roads!
The other part of it is he didn't attempt to slow down either, slow down or move over law, and since he was the first car for awhile he could've put his blinker on, but unfortunately he has a BMW and they don't come with blinkers, Driver could've done more and then his argument with frank becomes, "i slowed down, I had my blinker on, and couldn't get over"
He didn't even try. When he saw the emergency vehicle on the side of the road he should have put his signal on at the very least. I drive a truck and could have made that. If people see flashing lights and see you trying to get over, they're very often accommodating. He didn't get over because he was trying to pass the guy in the hammer lane from the truck lane. When I was in Jr. High, my friend's State Patrol father was killed on a traffic stop, so this one really hit me. (He & my father were good friends.) I hope we get a follow-up on this, and this guy learns his lesson and starts obeying the law. It's not that hard - get out of the lane if you can, and slow down if you can't.

Looks to be about 2 painted dashes behind the first car and 3 in front of the second. Moving over would result in both tailgating one vehicle and cutting off another. Poor form.
Then don't move over. Slow down, your only other option, as required by Arizona law. All 50 states have a move over law per the NHTSA so it's astounding that so many people are ignorant to this.
As someone who does utility work in and along the road, in a state where the law also requires drivers to move over for us, I'm always glad to see stops like this. I can't tell you the number of close calls I've had/seen, including me being clipped in the back by a mirror once. People don't seem to realize or care that we're 1 bad decision on their part away from not going home tonight and act like they have a god given right to not spend even the tiniest bit of effort to make sure they don't kill someone. The entitlement I see is absolutely insane, and terrifying.
Frank blows a lot of hot air about court. There is a well-known video where the driver said he would take the citations to court and Frank said he hoped so because he would be there. Frank didn't show and the questionable citations were dropped.
@@pkd.81 There was more to it than that. The presiding court was a different county and they didn't get the paperwork because it was from pinal, or something, so the charges were dropped. They implemented a system as a result of that so it didn't happen again.

Maybe, but Frank said the driver had room to move over to the left lane. Watch the video, the driver would have had to make a potentially dangerous move to get between the two cars to the driver’s left.
Any half decent attorney will get this dismissed within a. Few minutes, dickhead or not the guys attorney will say he didn’t believe it was safe to change lanes and a judge will dismiss it.

@@phillipberk5767 in almost all states, you must slow down significantly if unable to change lanes. He did not. Not sure if the charge is generally not yielding or specific to not changing lanes, but it can often be amended in court if needed.
Frank I have to be honest, but from the angle on my keyboard it was pretty tight for him to move over at that rate of speed. By the time you check and then hesitate to think you if you can squeeze in at that speed, he was past you. Just saying.
Watching that video back, the guy didn't have THAT much room to get over. I honestly think it was safer for him to stay put. Usually I love FWF, but I can see why this driver was pissed.

If you stop the video, it looks like at least 5 car lengths in between, so he could have easily put his turn signal on and moved over. It isn't cutting anyone off if you are going the same speed limit. Even in heavy traffic people on the left lane are supposed to let you over in these situations, but here was plenty of room.

I think the guy can beat this ticket in court. The video shows just 2 seconds between the BMW and the car to the left. Switching lanes into a lane with a vehicle in it typically calls for at least a 3 second gap. And at 70mph, 2 seconds will likely be ruled not enough. That being said, with an unobstructed view, he should've seen Frank and party in plenty of time to at least slow down if he wasn't able to change lanes. So I think he'd still get a ticket, but likely not for failing to switch lanes. But I'm neither a cop, nor a lawyer, so there's that....
Great point. Not sure about AZ but here in WA if you can’t change lanes you have to slow down by reducing speed 10mph under the speed limit. I would think it’s the same there.
The problem with the pull over law is that police officers park unsafe a lot more then you would think (still on the road or just outside). It doesn't look like Frank is here.
As a commercial truck driver do you know how many times we turn on our signals to move into the left lane and left laners (cars)don't slow down for big rigs,we are probley the ones most aware of this law because for 27 years of driving i always move over for anyone,but nowadays left laners don't care,there needs to be more eyes on this problem stay safe and God bless
Yes, arguing with a traffic officer is a sure fire way of getting out of a ticket. Telling the office "why don't you go after other people" is definitely going to win the officer over to giving you a warning instead of a citation.
Literally! I bet if the guy had just said "I'm so sorry officer! I know I'm supposed to move over, but I didn't feel like I had quite enough room to make a safe lane change without the person behind me having to put on their brakes. I'll be more diligent about it next time." Frank would have probably given him a break and a reminder instead of a ticket.

im a local truck driver that delivers to residential areas. i have to park on the side of the road 90% of the time to make deliveries and the amount of idiots that fly by me and dont move over when im on the side of the road is astounding. so im glad to see people getting ticketed for it (no matter whos on the side of the road)
When I was in the US some years ago I accidently passed a stopped police car without lowering my speed. I got stopped and he looked at my license and told me about what I did wrong. Since then I always slow down or try to change lane if a police has stopped someone.

I have to agree with this. There is no way I would have tried to pull over into that spot. Not enough space given the speed of the traffic - I too would argue this one in court. That said, I would have slowed down or moved over earlier, assuming they were visible earlier.
Deputy Sloup, you are an amazing officer. You are very professional, firm, and fair. If I was a judge on the case with the stop of the blue BMW, I would find that the State of Arizona would not win this one. Why? Because the space between the two vehicles in the left lane, at least at the speed of the traffic, would have created another dangerous 'following too close' situation. Impossibility of compliance with the law is (typically) a legal defense - I am sure it is in Arizona although I am not barred to practice there. I am 100% for the Move Over law, I support the police, but I would do the same as that man and would take this ticket to court to raise impossibility as a defense. The two vehicles were just too close. Thank you for the work you do to keep the motoring public safe.
If you are really 100% for the Move Over law then you would know that if you can't safely move over, you must slow to a safe passing speed. Also, on a long, flat road like the one in the video, the driver would have had lots of time to move over after seeing the emergency lights ahead.

That is so funny. I believe that is the case as I have never seen a BMW owner drive the speed limit and they think they own the road. More so than Mercedes owners.
The driver should have explained to Frank that as a BMW has no working turn signals, especially the blue ones. It would have been too dangerous to change lanes. 😮

I got pulled over in Columbus Ohio for this. I slowed as much as possible and could not move into the left lane. Total bullshit, and the cop knew it. Went to court, cop didn't show prosecutor threw it out.
For questionable tickets it is always worth a try to go to court since there is always a chance the officer won't show resulting in an automatic dismissal. However, just because the officer doesn't show doesn't mean they thought they would lose. They could be sick, injured, covering a shift for another officer who is sick or injured, or involved in an incident requiring a large response.
Yeah this one would’ve probably not been a ticket had he slowed down or just not been aggressive. I’ve learned to speak very calmly when pulled over even if I think I’m correct. Sometimes it’s more dangerous to try to change lanes because a lot of people aren’t slowing down at all

Arizona motor vehicle laws says a number of things that a motorist should do for a safe lane change. 1. Use your turn signal to indicate a lane change 2. Check mirrors and blind spots 3. Don't exceed speed limit when changing lanes 4. Don't follow too closely; leave enough room between you and the car in front of you. 5. Drivers must not follow too closely; use the two second rule between you and the vehicle in front of you. 6. If you see a vehicle with flashing lights pulled over to the side of the road, you should move over one lane or slow down if it's not safe to change lanes.
I don't think that stands in court. In my opinion, the space for the vehicle is too tight to move over safely. That doesn't mean the driver can't or shouldn't move over, it’s just on the edge. Given the circumstances, the driver can reasonably decide either to proceed or to refrain from moving over. If there were 10 more yards of space, the case would be much clearer.
To everyone saying he didn’t have much room to get over, yes that looks to be a possible case. But he was also the lead car in his lane and saw the lights a great distance ahead before passing them. There is no excuse to why he couldn’t have slowed down or gotten into the other lane way before he passed Frank and the DPS trooper.
In Australia you have to reduce speed to 40khp. There was a horrible incident where a couple highway offices were killed not too long ago, so they made a 40kph law.
As a not australian this sounds a good idea, and i hope it will be marked in a eye catching manner for foreigners who will visit australia and look what (different) vehicle laws/ rules you have to follow that are different from them in your homecountry.
In most places you have to at least slow significantly down if you cannot move over. I see traffic violations every day (i'm just as guilty as everyone else) but the idea is to strive for perfection and at the worst you'll end up is "very good"
I’m a truck driver that drives from California to Arizona and I can tell you that the state troopers are really strict on speed and very big on moving over for emergency vehicles, 65 means 65, only depends on the cop if they will allow you to exceed 5mph over.

In Michigan, the SDMO law applies to any vehicle on the side of the road. You are required to move over a lane if available, if you are unable to change lanes, you are required to slow down at least 20 mph below the posted speed limit. He did neither.

12 states and counting require this. If nearly a quarter of the country requires it, it's going to expand. Drivers should start practicing immediately.
I was thinking, all the way up here in Canada, that if I wasn't comfortable changing lanes, I'd have slowed down and 'skooched' over a bit to the left without crossing the line to be well away from the traffic stop. He either wasn't paying attention or didn't care given that he was over the speed limit by a bit when he could have been significantly under to ensure care.

In farm country, I've seen drivers force on-coming drivers onto the shoulder countless times because people don't want to slow down even for a few seconds to pass a farm vehicle / horse buggy / truck pulled over / cyclist, choosing to whip around them at the exact speed they were doing when not exactly safe to do so. A little care, defensive driving, etc is sorely needed.

I’m all for holding people accountable, but it certainly looks like there was not enough time for him to move over but I’m not there so I can’t make the determination as a first responder. I fully support the move over law.

Most judges are weird about having cameras in the courtroom. Frank has said that they tried to film a case that went to trial but the judge would not allow it. So if this does go to court, it would need to go to a judge that isn’t weird about filming

The other part of it is he didn't attempt to slow down either, slow down or move over law, and since he was the first car for awhile he could've put his blinker on, but unfortunately he has a BMW and they don't come with blinkers,
Driver could've done more and then his argument with frank becomes, "i slowed down, I had my blinker on, and couldn't get over"
He didn't even try. When he saw the emergency vehicle on the side of the road he should have put his signal on at the very least. I drive a truck and could have made that. If people see flashing lights and see you trying to get over, they're very often accommodating. He didn't get over because he was trying to pass the guy in the hammer lane from the truck lane. Watch the video again.
Big fan of Frank, but the gap was too small. A discussion with the driver to remind him of the law would have been sufficient in this case.

Yeah, as much as we all would love to think he would learn his lesson with this stop, as Frank stated, he is “not nice a human”, and his arrogance will always prevail with the attitude he has shown here.
When I was in Jr. High, my friend's State Patrol father was killed on a traffic stop, so this one really hit me. (He & my father were good friends.) I hope we get a follow-up on this, and this guy learns his lesson and starts obeying the law. It's not that hard - get out of the lane if you can, and slow down if you can't.

Looks to be about 2 painted dashes behind the first car and 3 in front of the second. Moving over would result in both tailgating one vehicle and cutting off another. Poor form.
Then don't move over. Slow down, your only other option, as required by Arizona law. All 50 states have a move over law per the NHTSA so it's astounding that so many people are ignorant to this.

As someone who does utility work in and along the road, in a state where the law also requires drivers to move over for us, I'm always glad to see stops like this. I can't tell you the number of close calls I've had/seen, including me being clipped in the back by a mirror once. People don't seem to realize or care that we're 1 bad decision on their part away from not going home tonight and act like they have a god given right to not spend even the tiniest bit of effort to make sure they don't kill someone. The entitlement I see is absolutely insane, and terrifying.

Frank blows a lot of hot air about court. There is a well-known video where the driver said he would take the citations to court and Frank said he hoped so because he would be there. Frank didn't show and the questionable citations were dropped.
@@pkd.81 There was more to it than that. The presiding court was a different county and they didn't get the paperwork because it was from pinal, or something, so the charges were dropped. They implemented a system as a result of that so it didn't happen again.

Any half decent attorney will get this dismissed within a. Few minutes, dickhead or not the guys attorney will say he didn’t believe it was safe to change lanes and a judge will dismiss it.

@@phillipberk5767 in almost all states, you must slow down significantly if unable to change lanes. He did not. Not sure if the charge is generally not yielding or specific to not changing lanes, but it can often be amended in court if needed.

Frank I have to be honest, but from the angle on my keyboard it was pretty tight for him to move over at that rate of speed. By the time you check and then hesitate to think you if you can squeeze in at that speed, he was past you. Just saying.
The law says to slow down or move over, if he felt he was going to cut somebody off he should’ve slowed down.

I think the law is “move over or slow down”. He didn’t do either.
If you stop the video, it looks like at least 5 car lengths in between, so he could have easily put his turn signal on and moved over. It isn't cutting anyone off if you are going the same speed limit. Even in heavy traffic people on the left lane are supposed to let you over in these situations, but here was plenty of room.

I think the guy can beat this ticket in court. The video shows just 2 seconds between the BMW and the car to the left. Switching lanes into a lane with a vehicle in it typically calls for at least a 3 second gap. And at 70mph, 2 seconds will likely be ruled not enough. That being said, with an unobstructed view, he should've seen Frank and party in plenty of time to at least slow down if he wasn't able to change lanes. So I think he'd still get a ticket, but likely not for failing to switch lanes. But I'm neither a cop, nor a lawyer, so there's that....

As a commercial truck driver do you know how many times we turn on our signals to move into the left lane and left laners (cars)don't slow down for big rigs,we are probley the ones most aware of this law because for 27 years of driving i always move over for anyone,but nowadays left laners don't care,there needs to be more eyes on this problem stay safe and God bless

Yes, arguing with a traffic officer is a sure fire way of getting out of a ticket. Telling the office "why don't you go after other people" is definitely going to win the officer over to giving you a warning instead of a citation.
Literally! I bet if the guy had just said "I'm so sorry officer! I know I'm supposed to move over, but I didn't feel like I had quite enough room to make a safe lane change without the person behind me having to put on their brakes. I'll be more diligent about it next time." Frank would have probably given him a break and a reminder instead of a ticket.

im a local truck driver that delivers to residential areas. i have to park on the side of the road 90% of the time to make deliveries and the amount of idiots that fly by me and dont move over when im on the side of the road is astounding. so im glad to see people getting ticketed for it (no matter whos on the side of the road)

When I was in the US some years ago I accidently passed a stopped police car without lowering my speed. I got stopped and he looked at my license and told me about what I did wrong. Since then I always slow down or try to change lane if a police has stopped someone.

watching the video of the BMW, and the amount of room he had to move left, I think, if it were me, I would’ve not tried. From that angle it just seemed like it would be too close, especially at that speed. Should be interesting to watch the courts review.

I have to agree with this. There is no way I would have tried to pull over into that spot. Not enough space given the speed of the traffic - I too would argue this one in court. That said, I would have slowed down or moved over earlier, assuming they were visible earlier.
Deputy Sloup, you are an amazing officer. You are very professional, firm, and fair. If I was a judge on the case with the stop of the blue BMW, I would find that the State of Arizona would not win this one. Why? Because the space between the two vehicles in the left lane, at least at the speed of the traffic, would have created another dangerous 'following too close' situation. Impossibility of compliance with the law is (typically) a legal defense - I am sure it is in Arizona although I am not barred to practice there.
I am 100% for the Move Over law, I support the police, but I would do the same as that man and would take this ticket to court to raise impossibility as a defense. The two vehicles were just too close. Thank you for the work you do to keep the motoring public safe.
If you are really 100% for the Move Over law then you would know that if you can't safely move over, you must slow to a safe passing speed. Also, on a long, flat road like the one in the video, the driver would have had lots of time to move over after seeing the emergency lights ahead.

I got pulled over in Columbus Ohio for this. I slowed as much as possible and could not move into the left lane. Total bullshit, and the cop knew it. Went to court, cop didn't show prosecutor threw it out.
That's what you do, take the ticket and fight it in court. There are no judges on roadside traffic stops.
He didn't even attempt to slow or move over tho, you did what AZ law requires that you move over or reduce your speed to safely pass
For questionable tickets it is always worth a try to go to court since there is always a chance the officer won't show resulting in an automatic dismissal. However, just because the officer doesn't show doesn't mean they thought they would lose. They could be sick, injured, covering a shift for another officer who is sick or injured, or involved in an incident requiring a large response.
Yeah this one would’ve probably not been a ticket had he slowed down or just not been aggressive. I’ve learned to speak very calmly when pulled over even if I think I’m correct. Sometimes it’s more dangerous to try to change lanes because a lot of people aren’t slowing down at all

Arizona motor vehicle laws says a number of things that a motorist should do for a safe lane change.
1. Use your turn signal to indicate a lane change
2. Check mirrors and blind spots
3. Don't exceed speed limit when changing lanes
4. Don't follow too closely; leave enough room between you and the car in front of you.
5. Drivers must not follow too closely; use the two second rule between you and the vehicle in front of you.
6. If you see a vehicle with flashing lights pulled over to the side of the road, you should move over one lane or slow down if it's not safe to change lanes.

I don't think that stands in court. In my opinion, the space for the vehicle is too tight to move over safely. That doesn't mean the driver can't or shouldn't move over, it’s just on the edge. Given the circumstances, the driver can reasonably decide either to proceed or to refrain from moving over. If there were 10 more yards of space, the case would be much clearer.

To everyone saying he didn’t have much room to get over, yes that looks to be a possible case. But he was also the lead car in his lane and saw the lights a great distance ahead before passing them. There is no excuse to why he couldn’t have slowed down or gotten into the other lane way before he passed Frank and the DPS trooper.

In Australia you have to reduce speed to 40khp. There was a horrible incident where a couple highway offices were killed not too long ago, so they made a 40kph law.
As a not australian this sounds a good idea, and i hope it will be marked in a eye catching manner for foreigners who will visit australia and look what (different) vehicle laws/ rules you have to follow that are different from them in your homecountry.

In most places you have to at least slow significantly down if you cannot move over. I see traffic violations every day (i'm just as guilty as everyone else) but the idea is to strive for perfection and at the worst you'll end up is "very good"

I’m a truck driver that drives from California to Arizona and I can tell you that the state troopers are really strict on speed and very big on moving over for emergency vehicles, 65 means 65, only depends on the cop if they will allow you to exceed 5mph over.
By driving past so close, he set the precedent for others behind him to also stay in that lane 😡
