I am seeing that some physicians and hospitals are reluctant to produce records, ignoring HIPPA laws that patients are entitled to their records upon request.

Why are some doctor's offices so reluctant to fulfill a patient's records requests? It does not build confidence!
My mother wants to get a second opinion on her cancer diagnosis, but her original doctor is making it difficult to get copies of her diagnostic images & scans.

Because they know it's no real enforcement making them do it, and HIPAA is overwhelmed and it could take years for them to get involved, and if the healthcare provider don't feel there are damages to the patient then they likely won't release them in my opinion.

I had treatment with my dentist between 2004 - 2006. However to cut a long story short the treatment wasn’t completed due to the fact that the dentist was charging me an extortionate amount for unnecessary treatment. I made a complaint against him to the GDC in 2007 where he was given a written warning. In 2009 I proceeded to litigation single handedly where I was awarded £3900 which was all the money I had received where he overcharged me. Although I was entitled to a substantial amount However due to my emotional state and the fact that the dentist wasn’t willing to resolve the matter that’s how much I received. Fast forward 2020 I was currently planning treatment with my new dentist. However my dentist advised me that in order for me to complete treatment I would need my dental implant passport from my previous dentist. When I requested this he said that was 13 years ago. I then made another complaint to the GDC. This took 5 months where they concluded that the dentist had destroyed the records as they can do this after 11 years. My question is can he do this despite the fact that my treatment was incomplete through no fault of my own and not to mention the fact that the dental implant passport I requested contained a unique serial number , along with the brand name, serial number, size, diameter and angle. Now because of this I am stuck unable to receive any treatment. I would very much appreciate this if you could give me some advice on this. Thanks! 😃

Thank you so much. Your video was so helpful and answered a lot of my questions. I do have one question in regards to producing medical records. When an attorney request client records “Any and All” for a certain time frame, does that mean all documents irregardless of what the document is within the specified dates?
    Thank you.

Hi Sylvia......thank you so for the kind words. Our goal is to always give as much information as possible. As for your legal question, we are not lawyers, so I'm going to refer you to our Association of Liability Lawyers in Medical Defense. These are lawyers that we have partnered with so our insured's have somewhere to go to find answers to their legal questions: www.cunninghamgroupins.com/all-md/lawyer-directory-by-state/

I'm sorry, but we only work with physicians and healthcare facilities in the States, and thus wouldn't feel comfortable giving you an answer. I'm going to reach out to a few contacts at Lloyd's of London and see if they can provide an answer. If I hear back.....I'll post their response here.
