      Dear Ma'am,. We have purchased resale flat and submitted transfer fee along with necessary documents in the month of February, 2021 ,. 2 reminders sent but not yet transferred share certificate.. Saying After AGM meeting it will be done... In this case what should I do? Housing loan bank asking for share certificate

    In our society Mrs A, sole owner has nominated Mr B her husband on her death in 2016, the nominee was accepted as member. Is this nominee eligible to give his further nomination without any title change. Last six years no title transfer was done , it is still in the name of Mrs A. Mr B has passed away in 2021. Can the son be taken accepted as member. And what procedures do we follow.

    Madam I have one query. If flat is owned jointly by two or more members , is it necessary to fill nomination forms by all joint owners ? In the form format there is space for only one owner.
    Please explain it.

    Hi Ma'am, you explained about the list of documents to be submitted by transferre to transfer the share certificate on his name Or to get membership in the society. But, will the Secretary of the society should only put the name of new member at the backside of share certificate or do this sets of documents needs to submitted to registrar and he will issue a fresh share certificate in the name of new owner.

    Good informative.
    Please inform if share certificate has 2 nominees & one son is overseas. The will mentions transfer in the name of resident son post demise. Should society have issue in giving No Objection certificate for transfer of property

    I own a house jointly with my wife in a CHS in Mumbai.
    My wife expired in Nov 2016. Death certificate issued my Municipal Corpn.
    She had made a WILL in Oct 2015 witnessed by two, but neither registered nor probated.
    There was no nomination filed.
    I have three married children, one of them has been staying with me.
    My married daughter is in other city.
    My younger son stays abroad.
    When I approached the society secretary for deleting her name and transfer her share to me thus makin me exclusive owner of the property as per the WILL.
    I have been asked to prepare certain documents like indemnity, affidavit etc which are in process.
    But, except one don, other two children are unable to sign the document which I am preparing, instead all three of my children have written an NOC independently on stamp paper duly notorised ( one from abroad) affirming that they don't have any objection to their mother's share being transferred to their father i.e. myself.
    I am appending these three NOCs with the documents (being notorised)+ an application+ some fee, all advised by the secretary.
    Shoul there be any problem now in transmission of her share to me? Thanks and regards.

    NICE VIDEO...very informative....my father had made nomination of 25% each to mother, myself ,brother and sister. He died last year. I applied to society to include names of all in share certificate. But society denied and said that only mother's name will be in share certificate and you 3 siblings will be nominee only. Pl guide.

    Can any one transfer share certificate without owning a flat or without attaching the property? In one of the cases in Gujarat we have come across a case where one person has transferred his share certificate to another without having a property.. Neither transferor nor transferee owns a flat? Can it be considered legal?

    In case I have purchased flat and agreement date is before the formation of cooperating housing society .....and the share certificate is made in the name of first owner, is it correct or share certificate has to be made in the name second owner ?
    Where can I find law or section to refer this ?

    One can find all this information in the bye-laws which is adopted by the housing society every member of the society is entitled to ask the certifyde copy of the bye-laws from society

    Hello, I have nominated two individuals each with 50% under rule 25 of Maharashtra co-op rule 1961. Say example 1. ABC 2. XYX
    Now under section 30 should be transferred to both individual or can I mention 2.XYZ. or it will go default to 1.ABC

      There is a separate line in Nomination form. which asks to fill the name in blank space which you want to be there in share certificate.
      If you read the form you will find it.

    One flat owner purchased flat from other person 4 years ago, still he has not paid 25600/- Rs to society even after notices given to him. We also donno how bank gave them loan without taking share certificate. He has also rented that flat.
    Other members who paid Transfer chages to society are now angree and telling society to either legally recover money from him or to cut of their facililties like water or give money back to people who have already paid transfer charges.
    What legal action can be taken?
    Can society lavy 21% per annum interest of their pending money?
    Can society cut of their boaring water supply, not Drinking water supply?

    Good morning madam,
    I our society Builder to Girkar paid stambduty and register that's why issue the share certificate ti Mrs Girkar But girkar sold the flat to Mr.shingre that's time they do not paid stam duty and Not register .
    One month back he had paid stam duty Not Register the document because Mrs.Girkar Is Not found last 10 years .And Mr.shungre demand the society please transfer the share certificate .He paid only stam duty not Register property what can do for these case

    1) If Flat is on name of "A" and he has added his wife "B" as Joint member. In the event of death of "A". Will "B" be automatically be owner of flat in the event of death of "A". 2) What is the procedure of adding joint member after the flat is bought by "A"?

    Good evening madam , I have a query . My father in law is having a flat in Mumbai he was deceased 16 months before . My wife is only child to them and at the time of he was deceased my wife and mother in law is at Kerala and my wife was pregnant so couldn't travel for doing the necessary documentation to take place to transfer father flat to my mother in law's name .once my wife come to normal and planned to travel for doing this Corona lockdown started and till now we couldn't complete the share certificate transfer to my mother in law's name. Now almost 16 month completed and flat is on locked situation. So I approach society secretary for solution , he ask to send the request letter along with original share certificate to society address . On secretaries words we arranged all required documents to change the share certificate to my mother in laws name without going to Mumbai from Kerala due to lockdown continuing along with original share certificate by speed post. After arranging I informed to my uncle. My uncle fired me and said original share certificate couldn't arrange to anyone which can be misuse . Is it possible as original agreement is with us in Kerala. My WhatsApp no is 9946269032.

    I have purchased a resale flat and have obtained coveyance deed and registration, have also got noc from chs secretary. But chs is refusing to transfer the share certificate in my name because the seller had not obtained share certificate transffered in his name, the share certificate exists in the name of his previous owner and is in the pocession of chs, how can the matter be solved?

    Madam how much percentage of India's population in 2021 can read English and how much can understand English since 1950.why constitution was written in English when in 2021 how many schools can teach better English. Why there is bankruptcy common sense. When people in large number died because of scarcity of Oxygen. Law failed to bring law and order.

    Hi ! My name is Mark, In our society the provisional committee has expired in Sep 2018 but still manage to run the society, they have been cheating our society for the past 11 years by misusing the funds & their powers. Since I have exposed them of all their illegal activities they now refuse to transfer the flat in m name inspite of me completing all formalities & even paid the the transfer fees, membership forms etc. Kindly advise.
