  • The plaintiff says his son attends Rutgers and rents a home from the defendant with six friends. He claims the defendant lied about spending money to clean the house and is taking advantage of the students. He’s suing to get their security deposit back. The defendant says he rents to college students and alleges they are messy. He claims the place was covered in garbage and beer cans, so he withheld money to cover the costs to clean it up.

      that struck me right up front. He said he rents to college kids all the time, and that they are always messy, so why rent to college kids. to me it says you no what will happen and you don't care.

      I think the Fraternity and the College are more to blame than the Young adults, and i agree every Landlord knowingly renting to people of this type will have damages. But it isn't the Landlords responsibility to own them up front, it is his/her job though to take pictures of the place before it is moved into and when it is vacated as hopefully a walkthrough with the tenant. And if the Landlord was gracious they could give he Tenant a copy of the walkthrough pictures and video, as well as a list of discrepancies and charges if any! Then if disputed by the Tenant, and not handled between them. Then we can go to court! I think also the Landlord should make an agreement with the College and Fraternity to be able to inspect the place periodically and have the Collège handle any costs of keeping the place like it was before it was ever rented, because this ongoing renting to the Fraternity there never appears to not be a tenant. One set moves in as one moves out from the same Fraternity at the same College!

    He kept all of that money from 7 tenants? Oh hell no… I do not blame that father for being pissed. He is definitely taking advantage of college students, shame on him.

    He was really reaching. 7K security deposit. Then going uninvited into the house, cleaning and then charging them for it. What a nerve. The plaintiff is lucky to have his Dad. I am so pleased that they won. If they don't want graffiti then the landlord should clear that up at his expense. If you already have graffiti don't be surprised if it gets added to.

    I never lived like a pig in college. I respected the apartments I lived in. Nothing like coming back to a clean apartment after a long day of classes 😮‍💨.

      The difference is that it was a fraternity group. Different members but same fraternity. They were renting the same apartment. Instead of it being a frat house it was turned into a frat apartment. This is what the dad was standing on when he says the things left there were permitted. Permitted by the plaintiffs frat brother. They still using the left items for future fraternity events. Why? Because it's the SAME FRATERNITY group just different guys. The landlord needs to be careful with this group.

    I think the landlord depends on the rental to be trashed giving him an excuse to keep the deposit. He puts very little cleaning back into the rental and waits on the next bunch of messy kids with deposit money which he will pocket again. It's a racket.

      There was graffiti spray-painted on the walls when they moved in! Then he wants them to pay to clean it up. He doesn't clean that up! I think you're right.

      Well when you look at it he collected $1000 per frat boy for the deposit....so he gets $7000. Then if he kept $560 per deposit for ‘cleaning’ he got nearly $4000 for cleaning up!! And there really wasn’t that much cleanup considering the new tenants were moving in as the old ones were moving out! He’s a shifty landlord making a killing off unsuspecting college kids!

      Exactly. I think a lot of commenters missed that part. I read some ppl feeling sorry for the landlord 🤦‍♀️ I'm sure this wasn't the first time he's withheld so much for that slum, but probably the first time one of the student's father was a lawyer. Out of more than $3900 he only had to "return" a small portion (really nothing since the show pays)... But he's banking off of that place and those students.

      Right? $3000 is an insane amount for a place that had graffiti when you walked in. His whole trick was to take advantage of college students, he just had no idea this one had a father as an attorney. He got new tenants in from the same frat house before they even moved out, insane.

And going forward, he may still get away with this unless the new college aged tenants have involved parents like the plaintiffs. Really scummy to do what he's been doing. And what gets me even more upset is by coming on the show, he hasn't paid for his illegal behavior since the show pays the judgements. I hope he is sued in an actual court where the money comes out of his pockets.

      Obviously the Defendant was trying to make the Plaintiff pay for his remodel, when the defendant had to paint over the graffiti before the tenants moved in, since they're young he also figured he'll blame the graffiti on them, Glad the Dad Helped his Son!

    So this landlord rented a house to 7 college students and charged them 1k each when it literally had graffiti in it?! Then had the audacity to keep half of each of their security deposits?! Not to mention he was going in the house without their permission. Super weird... In what universe should rent for that house be 7k? He was trying to massively take advantage of them. Absolutely ridiculous.

    This man did not rent to 7 frat boys; he rented to an entire fraternity group. 7 is a group but he rented to more than that because now there's another group of them there. He is all about the money and that's the bottom line. He better get ready to be sued more often.

      College kids, generally, and sorry but it's usually the men, are messy. They're messy like my 7,9, and 10 year old. That's just a fact of life. He chose to rent to them. What did he expect? But then again, he didn't even paint the graffiti.

    As a landlord I gotta be on the tenant side come on you know darnwell you're renting to 5 college boys... Every night there's party's, pizza, beer, trash.
    That's why you always charge extra to college kids because you know darn well there's gonna be damage and and a mess to clean up when they leave.
    My unit at SFU usually rents for 1600 a month I charge 3200 a month for college kids..

    I've been doing delivery lately to pick up some extra cash and live in a college town. I have never, in my life, seen such squalor and garbage and trash and broken things in student housing in my life. And a lot of those places look pretty nice on the outside. But you get inside and trash chutes are overflowing, huge holes in walls, spilled liquor in elevators, etc. And a lot of nice housing has valet trash, and the are still crap all over the walls and floors, etc. Even when I was a college student, I never lived like that. Even in Greek life houses..... gross.

      @@denisheunjackson sometimes the learning experience for the kid is worth more than the $670 they won back. No problem with his dad advising him before hand, but it was the kid who lived in the house and signed the lease. It’s the landlord who needed a consult with an attorney.

      @@TK-ge2gh It's not helicopter parenting for a lawyer to help his son vocalize an honest case. Parents don't stop being there for their kids when they reach a certain age. If he was a helicopter parent, he would have been at the house every weekend cleaning up for his son, rather than letting him have his own life with his friends.

    Some landlords need to be smarter and more knowledgeable on landlord/tenant laws. The average person doesn't realize how difficult it can be to be a landlord. But, the landlords, especially seasoned ones, should be more selective with choosing tenants and be sure to know the laws in their state down to the T. Anyone who rents to college students, especially frat boys, doesn't really care about the quality of their property but instead the income it produces. So he got what he deserved unfortunately 🤷‍♀️

      this landlord knew exactly what he was doing, he neglected to know the father was a lawyer and expected them all to roll over and allow his fraud, but this time it came back to bite him. Hopefully he will learn a lesson and not try this again. He rents to college kids especially to rip them off like he did

    I used to be the housekeeper for a sorority, the frat house next door being "Pigma Sue" (you know what I mean.) Serious party frat. The head "dude" from back East got wind of how filthy the house was and he paid them a "friendly' visit. After he had all the cans and bottles taken care of, he had them on their knees with toothbrushes! They weren't kicked off campus,but put on "you are in so much ta-rubble!" It got really quiet over there for the rest of the year. YAY!

    bahaha "this doesn't say what you say" my word this woman is amazing. She was willing to hear what he was talking about even though she already knows he's wrong because she fucking does her research and her insight of the law is so precise and immediate. It's like beautiful to watch her practice of the law and her understanding of justice.

    I had an employee who was struggling with the job, and his father a renowned attorney got involved. He made the situation worse, and he ended up getting his son terminated.
    He even tried to Sue me, I was actually on the employee’s side and spoke up for him to corporate. Which was proven.
    Dad needs to let his son deal with his issues on his own.

      Most people see there a difference between parents involvement in their kids lives while at college, more often than not the students can't get in the institutions and sign leases without the backing of the parents.
      While I agree helicopter parenting is a problem - your experience being an example, as it highly likely its the dad's signature on the bottom of deposit cheque the landlord took, hence why the father has standing in law to sue him, this case isn't comparable to your experience over the employment dispute.       @@user-uy6uc5ey5q too many people try to take advantage of the kids hence why sometimes the parent's do need to step in. both my daughters worked at McDonald's and one was constantly not paid properly and she had spoken to them and was being ignored until I went up there and spoke to them. It is in how you do it. The other was discriminated against on grounds of disability, but it was a little more complex and so left it.

      @@lisaparrey1343 There's actually a really good middle ground between helicopter parenting and helping out young people just starting out in the workforce. Have labour laws and strong unions which enable new workers to stand up for themselves against employers plus learn to be independent from their parents. I'm not an American so when I started working one of my father's pieces of advice when started work was join a union.

    The landlord is greedy. He kept over $500 from each kid...he should have paid them some of the money back when they complained vs coming to court. The son is blessed to have such an intelligent and supportive father.

      I think they would find out that if they are due any deposit back, it would have to come out of the $670 awarded here. They all paid one security deposit totaling $1000 not $1000 each

      @@danmiller8223 no I am pretty sure each had a separate lease and individual deposits. Sounds like a lot but that is how it works in larger college towns. Each kid might have been paying as much $750 a month.

    I'm not a lawyer, and I know that the landlord can't just go into the tenant's house anytime he feels like it. I also know that he can't decide that they have to pay × dollars for something unless they've previously agreed to it, unless it's part of the law (luke damages).

      You can't really feel sorry for him. He knew what he was getting into. He was "smart" enough to have spreadsheets and paperwork for some things, so he's not a complete dummy. Plus renting to college students is a slippery slope for any landlord, especially 7 frat boys. He's income driven and that's ok, but this is probably the first time one of the tenant's Daddy is a lawyer, so he probably usually gets away with charging up for a bunch of things. Think about it, $560 X 7. Yeah, he didn't make out too bad if this is the only one out of the 7 who sued.

    The plaintiff is so lucky to have a dad as a an attorney. The defendant has to put everything in the lease including going into the apartment during the lease and cleaning. That's what hurt his case. Both the plaintiff's and defendant's seemed like good people.

    Interesting that it was never mentioned whether or not the portion of the deposit returned was within the 30 days with a detailed list of damages and amounts. If not within that 30 day window the entire amount is considered wrongfully withheld and can be doubled.

    She worked that 2000 dollar lawyers lawsuit down to 670, that was awesome, My question is did they actually vacate when they left their furniture there for 2 weeks the other tenants moved in and gave them permission when like the sign the landlord didn't want it there, so if you gave the landlord leeway on the sign and pipes wouldn't you have to agree the furniture was not allowed to be there, however my next question is could the landlord sue the new tenants for the incident to recuperate his loss because they against his wishes allowed the former tenants to store things the landlord didn't allow there! One more thing, can the Landlord sue the Fraternity, or the College!

      First off, there wasn't any real leeway on the sign/pipes - JM just told the college students to remove them as they still live in the town. That's the landlords compensation, the removal.
      As the landlord didn't do a walk through with anyone on the old lease and looks to in fact not been onsite till 2 weeks after they were out and the new tenants in, (who he also didn't have a walk through with it appears) it's difficult for him to start arguing "his wishes' have been violated in regards to the property as he's not following the processes for accessing if the old tenants has vacated and the state of the property prior to the new tenancy. As the furniture was removed by the sound of it in short order with the new tenants living there paying rent and they don't seemed to have minded he's got no leg to stand on arguing he 'suffered a loss' with legal standing.
      As the last question, he couldn't sue them over the lease as neither the Fraternity nor the College were parties to the lease. I don't know if you picked this up, but he had individual leases with each of the 7 boys (and their respective guarantors- ie parents- hence why the Dad has standing to sue). In the same way say if a bunch of work mates rented a place together which they organized themselves, the landlord can't sue their employer due issues he has with his tenants.

    This landlord always rents to college kids and doesn’t care because he knows there will be some damage or filth and so he takes advantage of them and the situation. It gives him an opportunity to keep 7 young people’s deposits at $560 or $1000 whichever it was. He is getting a nice bag💰 Even if they painted on the walls. He doesn’t really care he has buckets of paint. This guy is also too hands on. He shouldn’t be removing anything from the house.

      It’s goes to the college towns for landlord tenant ordinances that allow renting to more than four adults for a single property. Some towns are smart to limit the number of adult renters and also follow up on enforcement.

    I have in my leases that tenant's responsibility to pay for cleaning service, if ordered of the landlords, who deems it necessary due to tenants uncleanness tjat may be causing bad odor, vermin, no more than twice a year, and not to exceed $1000 in a given year. Amd if fumigation is required, the landlord will pay only 1x a year. Any additional need to fumigate, the tenant will be responsible for.

    Both sides messed up. Take pictures when you leave! Take pictures as soon as they say they vacated not 2 weeks later. One of you will have the pics as proof.
    Insane that he wanted to charge mid year cleaning costs.

      Absolutely. All tenants and landlords should take time stamped photos move in and move out day. That landlord is just really greedy. I'm sure he makes a ton off that place and tries to squeeze out whatever he can. Most times, the students or their parents probably just let it go...but not an attorney's son😂

      to start with he is breaching law going in without permission and notice, secondly he is not giving them an opportunity. They could say, we clean up every afternoon after class, but he came in before we had a chance. He then also as was said, can't charge for that without a prior agreement being made.
