Consumers sue Hermès over barriers to buying Birkin bags

- Birkin handbags are notoriously hard to get, which has made them a status symbol among the wealthy. But now the maker of the bags, French luxury designer brand Hermès, is facing a lawsuit over the scarcity of the bags. Shoppers in California allege the brand will only sell its coveted bag to customers with "a sufficient purchase history" and that it's violating an antitrust law by making the sale of a Birkin tied to other purchases. Susan Scafidi, founder and director of the Fashion Law Institute at Fordham Law School, joined CBS News to discuss the suit.

It’s a game and it’s fun for rich people. It’s not for normal folks. You can buy a birkin from a reseller and get exactly what you want or you can play the game. It’s a combo of being a loyal customer and being a customer that the brand wants a birkin on. If you don’t like the rules, don’t play.
I think people that want to purchase in store want that luxury experience no matter what that is. Plus some people are scared of super fakes. They want to go to the source.

Hermes owns crocodile farms and the cruelty involved to make bags means I would never buy anything from Hermes. The only reason women want these bags is to impress others. Actually, I think in this case, the ladies were conned. They have a purchase history and, after buying all of that and one Birkin, they want a second one. They legitimately thought they fit the store/brand spending profile. Then they have the rug pushed under their feet. A con.
It’s part of their “exclusivity “/ “You can’t sit with us” sales tactics. People who don’t have any self respect fall for this. Anyone who respects themselves won’t care for the bag… or the brand.

Audio quality is awful on the attorney for a major network; this is disgraceful. These coveted bags look no better than a Michael Kors bag. Who is worse Hermes for selling or the person suing to buy? Either way it's a spoiled brat problem.
This is huge because Hermès’ business strategy is what makes it rich, not the bags. If Hermès’ loses its privileges to make customers ask to be offered to buy the bags, their bags will lose their value.

Bravo! This action is overdue. Hermes has been making monkeys out of their customers by insisting that they make sufficient purchases on their other items to ‘qualify’ for a Birkin or Kelly. My suspicion is that it is a marketing strategy as their other merchandise aren’t moving well. This strategy is to shore up their overall sales.
Get used to it. If you're not part of the 1% Club, Hermes doesn't want you wearing it.

It's happening to alot other brands... You think you can walk into a Porsche dealer w/ no prior purchase history asking to buy a GT3? Good luck.... you walk into a Rolex AD w/ no / lack of purchase history wanting to buy a Daytona? You walk into Patek Philippe AD wanting to buy a Nautilus? Or even a Royal Oak Jumbo from Audemars Piguet? THere are many other similar instances too.... So these women wanted to buy the 'most demanded' hang bag w/ no / lack of prior purchase when these bags are also in demand by other VIPs? You need to be w/in the circle of friends first... if u aren't in you are out of luck... AND there are fancy 'nicer' restaurants and private clubs that requires customers / clients in special dress codes too - you think you can walk in in tank tops + flip flops + sweats?
Exactly. It should have always been this way. Democratization of consumerism has spun out of control and now everyone thinks they're entitled to exclusive services and products when they're not! No one should have to serve you at an upscale eatery if you're walking in like a slob wearing "high-end" sneakers and sweats from Balenciaga or an affordable LV wallet that one got used from Poshmark. Accordingly, no brand like Hermes should have to serve new money one-time shoppers with bad attitudes just because they think they can afford a Birkin.
Then, all those brands should all get prosecuted. Or the brands should have clarified those qualifications or made them transparent.
Look, I don't think you understand how Hermes works. They let you buy over 20k of non leather items before they offer you a bag. Great, other luxury brands pick and choose whoever they want to sell to but they don't require you to buy them a house or anything ridiculous before they sell you a car.

According to other sources like the purse forum, the plaintiffs do have a purchase history. They know how the game is played. That’s why they are upset. They spent all of their money on crappy stuff they didn’t want, with no Birkin at the end. Hermes didn’t hold up their end of the game.

Aside from that reason, they should be cancelled for animal cruelty. What a ridiculous brand.

Hermes has the prerogative to sale or not sale their products to whom ever it’s their company. Just like a restaurant or store can deny service to anyone , it’s their business. I purchased a few items from Hermes that I really wanted and then I was offer a chance to purchase a Birkin. I never had a problem with it it’s just how things are but it’s not worth suing for. People these days just want to sue for any reason when they don’t get their way.

That Hermès quality ... my mom just passed😢 and I inherited her silk scarf collection. Some from nearly 35 years ago and the colors and artwork on them are just exquisite. I get stopped wherever I go with one on. I am so thankful for such beautiful Hermès pieces.😢

It’s an untold rules. They can simply say they don’t have the items in stock but due to high level of customer service, their SA would show customers what available to purchase. They didn’t say you have to purchase them. As far as the sale records, it’s part of the service for any after sale warranty or return, etc.
All these brands look for ways to make extra money off consumers. Even Amazon won’t sell you a tablet unless you give them extra money so they won’t come with advertisements on the screen. I shouldn’t have to pay extra just to not have to deal with ads. When I’m buying a brand new product. They’re forcing you to pay extra and that should be illegal.

I bought a bag off an online only retailer about five years ago. It is well made and very, very sturdy. They sold like hotcakes. Suddenly, the bag disappeared off the site. I assumed they were sued by the big guy. I do not use it that much but am just as happy with it as I would be an authentic one. It is strictly a who I am bag and how much money I have anyways. It is just a daggone bag people not the end all be all of the world.

That is the whole point of the lawsuit, why should you have to go after something on the resale market, to buy it for triple when you should be able to go to a store not have to buy half to get the item in the first place. Rolex plays a similar game but a bit more covert. Rolex staff will size up a potential customer and if that individual doesn’t fit the Rolex aesthetic they claim the watch they are looking for is out of stock. They refuse to sell it to certain people.

Superior quality handmade bags are readily available at a fair price. When I observe individuals carrying inferior alternatives, it seems to me like they've made a poor financial choice. For me, i’ll head to the Florence Leather School shop instead.
