  • In a Preliminary Hearing court appearance held by Shelby Municipal Court Judge Sheree Studer, several issues were raised that suggest possible misconduct and disregard for legal procedures. The court's clerk, Shannon Small, held a Probable Cause hearing and issued a warrant, even though she lacks the judicial authority to make such determinations. This raises questions about the legality of the arrest and detention of the individual, who was identified as the defendant in the case.
    During the court proceedings, the defendant's mother was asked to leave the courtroom due to her service animal, which is a violation of the Americans with Disabilities Act (ADA). The service animal was not causing any disturbance and was quietly sitting on the mother's lap.
    The defendant's public defender, Dale M. Musilli, pointed out that he was never provided with the affidavit, which is a Brady violation. The prosecutor is required to share evidence with the defense, but withholding this information prevented the defendant from receiving effective counsel.
    The police report from the Willard Police Department, filed on January 1, 2017, states that the defendant's spouse had been beaten up by her boyfriend. However, the report later contradicts this statement, claiming that the spouse had fought back and was made to leave the residence. This discrepancy raises questions about the credibility of the report and the investigation.
    In the Shelby PD report, filed by Officer Sean Nolen, it is stated that the defendant's spouse arrived at the station, claiming that her husband had been beating her for an hour. This contradicts the Willard Police Department's report, further obscuring the facts of the case.
    Additionally, only drug paraphernalia belonging to the defendant's spouse was found and she was charged with disorderly conduct. However, the only person who failed a drug test was the defendant's spouse, who tested positive for THC.
    The prosecutor thanked the officer for preventing the defendant from being hurt, but the officer had been informed of the defendant's spouse's history of domestic violence. Despite this, the officer allowed her to possess and sell multiple assault rifles, handguns, and 700 rounds of ammunition.
    The Shelby Municipal Court only provides audio recordings of their proceedings and does not record visual evidence. The Chief of Police, Combs, claimed that storing video evidence would be too expensive, but the court live-streams their city council meetings on UA-cam.
    The defendant's request to speak during the proceedings was denied, and the prosecutor objected to any mention of prior incidents involving the defendant's spouse. The defendant's spouse had previously threatened to harm the defendant and had been hospitalized for mental health issues. She had also assaulted the defendant's 65-year-old mother.
    The defendant holds a black belt in self-defense, which may have been the reason for the officer's caution in handling the situation. However, the fact that the officer allowed the defendant's spouse to continue her illegal behavior despite knowing about her violent history raises concerns about the officer's judgment and adherence to the law.

      She must have lied for the X she claimed beat her up on January 1st 2017 too right? I guess you will have to see the other videos and then you may have something different to say. I'll get to them, I have to file paperwork though, so I've been busy.
