    The man believed by the US to be a straw owner for two superyachts totalling over a billion dollars has himself been sanctioned today by the EU. Eduard Khutainatov was added to teh growing list of Russians sanctioned meaning that the vessel believed by most to be owned by Putin himself is surely destined to stay in Italy for a long period.

    Mr. Sysman's puzzlement at the news delivery is awesome. It's also why I for one love to hear his reporting. He enthusiastically AND objectively delivers the (actual) results of his research. I never planned to know anything about yachts, but at least I walk away from eSysman news feeling more confidently informed about something lol. Thank you Thank you.

      Ordinarily I would question the legality of the seizure of private property just because the owner's government is pursuing some kind of controversial military action.
      However, in the case of these Russian billionaires, it's well known that you cannot get rich in Russia unless you're TOTALLY in bed with Putin and his malignant little KGB friends.
      In that case, I say grab every Russian yacht you can! Then take them all out and sink them in deep water. Why pay for upkeep?

    Finally someone uses their brain... By placing sanctions directly on the SY... you force the owner to come forward and prove ownership and in turn that also allow the U.S. to ask for discovery.. that opens all records.. whalla.... Put the burden of proof on them... Brilliant.... I've wondered why this was not already being done..

    I'm so glad you are here to track down the answers to these questions since I am not finding useful info in the regular news. Maritime law and customs are a specialty. Most reporters probably don't know enough about the subject to fact check their own stories.

    It is very clear that to get any trustworthy news about superyachts you need to follow this channel, keep up the great work eSysman and the providers of information working to keep us all informed. As for the AIS, it seems that Russian owned/flagged tankers are also going dark, in breach of maritime law, but what penalty is there for this, other than being told you are being naughty.

    EXCELLENT commentary..I grew up on an island off the coast of New Jersey. I learned how to operate boats and did a lot of fishing. I miss the smells, the ocean, and the fishing, but I live in Kansas now and don't miss the hurricanes.     100% wrong on AIS's needing to go back to the manufacturer to alter the static data. Any knowledgeable marine electronics dealer knows how to do this on most brands. Furuno only requires certified people knowing how to enter the service menu with a specific password. Other manufacturers provide dealers with software or other means to change the static information. All of these vessels are compulsory AIS-A and there is no provision to make them receive only unless they are on a military vessel and even then, it takes specific documentation to do that. They are violating all sorts of regulations going dark so why aren't they being held accountable? I guess it will take a collision and casualty to make that happen...

    Great move just sanctioning the yachts. Let the real owners come forward (or not) and let them rust into nothing until the authorities get approached. Don't chase the owners, make the owners come to you.

      @@kristopherdetar4346 That's a very good point. I believe the arresting authorities also have a financial responsibility; maybe tow the vessels to government facilities, which I think in this case they are trying to do.

    What purpose does seizing the yachts serve? You can't sell them. Even if you could, how many people can afford to buy them? If you don't keep up with the required daily maintenance they deteriorate quickly and that maintenance is expensive.

    The “AIS unplug” command feels like it’s coming from someone who’s level of paranoia far exceeds their capacity to be receptive to sound advice.

      @Jody Owen AIS is supposed to be used under international maritime law for safe reasons of safe navigation. Years ago I worked a couple seasons on commercial fishing boats and it was a pretty common practice to unplug the the transmitting antenna side of the system especially in derby style fisheries or just broadcast the boat number. If I remember correctly from reading I did while on my wheel watch shifts the Coast Guard can give you some grief if they want to for turning off your AIS and your insurance company normally has clause’s about always keeping your AIS on and if you were in collision and it was proven you intentionally did not have it on they could deny your claim. All that said it is my understanding the international maritime law for always running your AIS doesn’t have much teeth but the vessels insurance company well that’s another story.

      @@Ron-zr6se This enables seafarers to be aware of other vessels long before visual contact is possible-and make time-sensitive decisions. The more expensive the boat, the more important this is. Your insurance company would also demand you have this system. Also if you didn't have an AIS system trying to get to a port to get fuel would be impossible. You wouldn't be allowed in.

      @@CCB249 I can understand the reasons for AIS but just the other day, I encountered an unexpected 5 mile traffic back-up on the state highway I was traveling. Doubtless, most drivers phones were receiving ads for close-by businesses but no service detected the traffic jam. A 4 way traffic light was malfunctioning, flashing red, making 6 lanes a 4 way stop sign. Certainly a dangerous situation at any time but approaching rush hour made a bad accident almost inevitable. I couldn't believe no one was aware when I called it in. Monitoring our movements to serve advertisers instead of public safety shows me who these systems REALLY benefit. Public safety is just the selling point, not the reality!

    Can confirm. It is absolutely possible to force a plugged in AIS system to broadcast even if it’s set to receive only. Can’t go into details but western law enforcement has had that capability for at least a decade. Maybe more.

      @Grant UK I have worked with AIS for many years. Not possible. Plus, AIS is a ship to ship, anti collision system transmitted on marine vhf with an effective range of about 20 Nm. The reason we can all see this traffic is because, mostly volunteer land based stations are set up which upload data to the Internet. Many times when it's alluded to that they have switched the AIS off is simply the fact they are out of reach from shore stations. Its voluntary if the yacht/ship wishes to upload their position via satellite. However tracking systems for use by shore management mayne another story but not AIS. If big brother was so good, MH 370 wouldn't still be mystery.

      @Grant UK Sorry but an AIS unit is actually a very simple gps transponder and no way could it be activated remotely. It has very limited range as operating on VHF. As I mentioned, yachts can voluntarily broadcast their position vi's satellite but that's not a legal requirement.

    I know you’ve mentioned that yachts don’t just leave, they need permission etc. but surely in some of these cases the owners won’t be concerned with national or maritime law and might order their crew to proceed without the required authorization.

      In order to sail a vessel you would need a good amount of people from both the deck and engine teams to be willing to sail the vessel and possibly lose their professional tickets and therefore ability to work. Often vessels need pilots on board to navigate certain waters as well as tug boats to help them leave ports. There could also be port authorities or military that would be aware of the vessels movement and could act to physically stop it even once it was sailing within that counties water.

    Who regulates or polices AIS?
    I read a disturbing article today that suggested half of the affiliated fleet of Russian Oil Tankers had gone dark since the start of sanctions.
    Reports had suggested Oil Tankers may be transferring loads ship to ship out at sea to 'clean' cargo or avoid sanctions.
    If this is correct, a seriously accident is waiting to happen.
    Imagine a cruise ship hitting a super oil Tanker in the dark or fog?

    Perhaps if the State Department strongly suggest to Fiji's government their $85 Billion in foreign aid from the U.S. is in danger of disappearing, those "court ordered stays" might also disappear.

      Fiji do not get $85 Billion from the US. Last year it was around $US8 million. Australia gives around $A40 million In 2020 for cyclone emergency relief Australia gave an extra $A85 Million and USA gave an extra $US35 Million Facts matter.

    Just wondering how they handle the maintenance of a seized vessel. Who keeps paying for the marina fees, technical maintenance, the crew etc? We the tax payer? I see a lot of follow up questions arising here.

      Which is nothing new when it comes to US and international politics.
      Now, one can surely dream that on the long run there won't be consequences. Reality is, at one point it will be payback time, and it will hurt. Sanctions are already doing way more damage to the western economy than the Russian one.

      Dubai Creek has been described as a natural saltwater creek, tidal inlet, and watercourse or waterway in Dubai, United Arab Emirates. It extends about 9 miles inwards and forms a natural port that has traditionally been used for trade and transport.

    The word “creek” is also used in Jeddah to describe an inlet channel in the Red Sea just north of the city.

      I think it’s the Dubai Creek area, the old area of Dubai where the old market is et cetera. Best yacht I saw there in 1997 was a 140 foot or so, and it had wood paneling, looked cool- and I think it’s still there.

      I worked in Dubai and often took a ferry across to get to the market.
      Lots of boats sailing up and down.
      Ras el Kaimer is about a 30 minute drive from Dubai proper !

    Question: When a vessel turns off AIS, it's illegal, but who or rather which organization(s) or agency has jurisdiction to impose sanctions and what might those be? It seems like these yachts are doing it with impunity.

      No, it's not illegal to turn it off. There may be a variety of reasons why one would do it.

      @@chaz000006 That is incorrect, at least if you're a member of the UN. The International Maritime Organisation (an agency of the UN) would be the one responsible for regulation of AIS laws etc, but the individual UN countries/members are the ones who would carry out the "punishment". None of these large Russian yachts fly Russian flags, they are almost exclusively registered in UN countries, or elsewhere.

      @@chaz000006 of course it is illegal to turn off an AIS on a compulsory vessel. Try rolling into New York Harbor with your AIS off and watch how fast you have guns aimed at you! Last I knew, it was a $10,000 fine and up to five years in jail for incorrect AIS information in the US and the captain is responsible, not whoever may have programmed or shutoff the AIS.

      @@AB-tc8lx smaller vessels are typically non-compulsory AIS-B's and as such they are not required to TX, but this is a new one on me and I've never heard of any sailboat doing this. Don't believe any of that reality TV crap, it's all staged!

      @@GoodkatNW I've seen sailboats do it to avoid pirates from locating them, but it seems the size and type of vessel and it's mooring status can play a part: The regulation requires AIS to be fitted aboard all ships of 300 gross tonnage and upwards engaged on international voyages, cargo ships of 500 gross tonnage and upwards not engaged on international voyages and all passenger ships irrespective of size.

    With all these super yachts being taken it's going to be tough finding someone to buy these things even if sold cheap just because of the amount of upkeep and repairs they will need sitting around for so long not being looked after.

    As a novice please explain to me this. Who is going to buy these confiscated super yachts. You would only be able to sail them in America or the EU waters. Because as soon as they sail onto another jurisdiction the original owner would go to that court system and say they were illegally seized! American and EU courts are for American and EU. Not the rest of the world and not the open sea.

      If I'm not mistaken, if they remain in international waters, they are somewhat safe. If I was a yacht owner, I would be taking fuel and provisions in safe waters and never go to a hostile port til in home territory.

    I find it more than disturbing that the American Government who found that they had legal difficulties proving that the vessels they suspected of belonging to Russians, so the decided to change the rules and they can now apparently just arrest any vessel they like, without any apparent recourse in law for the unfortunate owners. Inc ones who might have nothing to do with Russia etc.
    The Laws are in place for a reason, however America seems to think if it does not like the laws then they can just change the rules to suit themselves.

      ROTFL They haven't had much problem with proof in Fiji or Italy. The video probably erred a bit in insinuating there was any change in rules. There hasn't been any. They need a court to approve the seizures and include evidence. They've been following the money and that begins to escalate what they've found. The Russian banks are sanctioned, they start seeing where all of the banks are sending money to pay for house repairs or yacht fuel. Don't matter who owns those places, they're paid for with sanctioned money. Exactly what happened with Imperial, they've been watching where Imperial money is coming from. When it came from sanctioned sources, now their sanctioned. That's not any change in rules, that's a change in the information they knew about it.

    Class A AIS units - Changing the TX name is possible.
    Just to clarify it is possible for the vessel to change the name by simply logging into the unit and pressing a few buttons on practically every AIS unit often through web browser and/ or some software.
    However
    returning the unit to the service provider is required when the AIS unit MMSI number is incorrect.
    Reprogramming the MMSI number or returning the unit to factory settings is carried out using software provided by the manufacturer that either the service provider will carry or the unit has to be returned to the manufacturer.

    The Military port is in the Ras Al Khaimah Creek. RAK followed the naming conventions of Creek and River while a protectorate of the British Crown. Technically rivers have to flow all year. So RAK on RAK creek. (Yes, there are other former colonies on "rivers" that are actually creeks.)

    I worked on a vessel that had 3 AIS transponders, One with the full data loaded, one with just ID numbers and the third was never used but was blank. They could be powered up and selected from the engine room. The switch was unlabelled but I discovered it while troubleshooting a problem with the AIS A forth AIS-B unit was installed but no wiring remained to it.

      @@1mezion Some units can be fed location data from an external source. I know of one clever guy who played back NMEA data from a previous voyage into his AIS and it showed him active when the vessel was actually on the grid getting scraped!

    I think I followed your suspicion about unplugging the AIS. These vessels are under amazing pressure from governments all over the world; pay is lagging; getting home is an issue. On some of these yachts it's possible that the professional crew has bailed and we are seeing actions from ad hoc replacements, perhaps even the owner's personal staff and body guards. (Some of us indulge here in a moment of malicious "serves 'em damn well right").
