    If my child was known to throw his head back like that, he would have been wearing a helmet or head brace to daycare to prevent this.

      a boy who I used to take care did this too, that's why i always carried him on my back or put him in the baby carrier and never left him on the floor, my guess is that the girl didn't know better and she didn't prevent this, the boy keep hurting himself.

    You know what's sad? Other than the child dying; the parents knew this was going on and they could at any point go back to the court and say that their son did usually throw himself backward and hit his head, but they refuse to! Instead of accepting accountability for not getting their son the behavioral health he needed, they're pawning it off on someone with developmental disabilities. Sick, sick, sick people.
    Edit; and if you didn't understand what I'm saying I'm talking about everybody involved. This child was failed by far more than just by his parents and the daycare.

Where are these parents even? I don't even know what the parents said about the incident afterwards. It seems like they haven't been interviewed, at least not publicly or that I can find.

      Parents were obviously wrong but also no one with intellectual disabilities or disabilities that will negatively impact their ability to care for children in any way should be taking care of anyone else’s kids

    I agree with Dr. Grande. Shame on the police department. There should be laws against interrogating someone with a mental deficit without a lawyer and for extended periods of times.

      I agree. If you haven't heard of the West Memphis Three, look into how getting a false confession from a teenager with a low IQ got three boys sent to prison for life for a triple murder. Literally 100% false, completely made up confession led by police. Certain cognitive deficits should require legal representation from the start. She might be guilty but she might not! Didn't have much of a chance of getting through a 9 hour interrogation either way.

      Police would say they aren't required or qualified to make a decision about who is mentally deficient. Yet somehow, they seem to zero in on the person with low intelligence and interrogate them for hours until they're ready to say anything to make it stop. The same thing happened with Jessie Misskelley, which resulted in 3 innocent men going to jail and one of them on death row.

      Tiles are easier to clean but are dangerous after spills and during wet weather. Probably not the best flooring in a daycare.

      I agree 100%. Wrong use of Data can be easily regulated and avoided while priorizing Kids and workers safety through surveillance.

      She is white and from an upper middle class neighborhood in Cook County, Illinois. She satisfies a quota so police will railroad them to avoid having more black people in prison.

      A jury of her peers. The average person is an idiot and very susceptible to suggestion and influence from crafty lawyers. He touched on IQ in the video here and really the average is around 90-95 in the us. Too many damn dumb people out there. It’s like the movie idiocracy was a documentary.

    Why is nobody talking more about the fact that Nancy saw Ben throw himself backwards onto the floor and placed him into a bouncy chair while Melissa was in the restroom? It was only later, after Melissa came out of the bathroom that she noticed he was unresponsive and intervened, in order to help him.
    Law enforcement's eagerness to solve cases sometimes leads to scapegoating the easiest targets rather than finding the true culprit. Unfortunately, this can result in innocent individuals being wrongfully convicted. It doesn't seem likely that Melissa is guilty of first degree murder. It's not even convincing that she is guilty of anything.

      THIS!! Yes, Please! What did Nancy have to say? Melissa wasn't even in the room when the last tantrum occurred?WTF? I'm so confused! None of this makes any sense to me! Back up, back up. Melissa knows nothing except what she was told. She denied, denied, denied 70+ times (even as a "people-pleaser" with a low IQ) yet, the System was played out long enough to break her down into a false confession!?! NOT GUILTY! ... And MY child would have been fitted for a padded helmet after the 2nd "head-bounce tantrum" I knew about.

      A big part of the problem is the number of people that are under the impression that no innocent person would confess to a crime that they didn't do. More people need to be educated on the methods that interrogators can and do use in order to extract false confessions. Too many jurors take those confessions at face value without understanding that it is not the irrefutable evidence that they think it is.

      Exactly. I don't know any of the details regarding this case outside of what we just watched in this video, but it sounds to me that this was a case of a child died and they needed SOMEONE to point the finger at, since the death of a child always equals extreme emotional tension. They didn't need the truth so much as they needed a scapegoat to direct all those emotions toward. Any scapegoat will do.

    NEVER EVER talk to the police without an attorney. Why didn’t the parents seek help for Ben throwing himself backward on the floor? They could have had him fitted with a foam helmet.
    On a side note, It really is a tragedy that this country doesn’t value paid maternity leave. In some countries, women get a year of paid leave. I can’t imagine having to put a baby in daycare when only a few weeks old. I’m so thankful I didn’t have to put my babies in daycare until they were almost school age.

It is crazy to think people still talk to the police after being offered a lawyer.     My son’s daycare has cameras in his classroom and on the playground, and it gives me so much peace of mind. Protects the workers too. A camera in this case would’ve given a definitive answer, one way or the other.

      i agree , its frustrating not knowing what really happened , i just dont believe she picked him up and threw him down , it does happen but my belief is that he threw his head back again and it affected the previous bump , had there been cameras we would know for sure , i feel a bit sorry for her , obviously if she did it , then she deserves everything she got and more , i just question the verdict tbh

    My daughter once slipped and fell backwards onto tile floor after getting out of the bathtub. She was only 14 months at the time. And, I felt so horrible about it 😢…still do!! She cried hard, but was Ok. This is just a sad story for everyone involved. RIP sweet baby.

    Did I hear 9 hours of questioning and 70 times stating that she was innocent before her story changed? Anybody would be exhausted and just want it to be over! 😢 Poor little baby, he was so cute with his 2 little front teeth!!!

      I get why people falsely confess but why oh why would one admit to actually doing something?
      All that does is dig yourself deeper into a hole, and make the case against you much easier.
      But for Ben, it is tragic how if he were still alive he’d be 16 years old right now :(

      @@RB01.10She was easily tricked because she is retarded, it's horrible they convicted her with not much else than a coerced "confession". She probably was confused and exhausted and just saying yes to whatever story they were making up that she did to him. Police do a guessing game in interviews where they present all sorts of possible scenarios for their suspect to say yes or no to.
      The kid was also likely special needs and maybe the parents wanted rid of him as well but it seems like they found a weak link with her and figured they would more likely get a "confession" from the daycare worker.

    Oh my goodness! One of my three grandchildren used to do this. Just threw himself backwards, even when you were holding him! It was nerve wracking. That poor woman was absolutely railroaded. It feels good to put someone in jail for child abuse, but this just doesn’t feel right.

    As a nurse, if my child had a head injury then developed swelling, fever, then vomiting I would have never left that hospital and pressed the doctors.

    No matter if you are not under arrest and they just want to "question" you, never speak without an attorney present. People think "well, I have nothing to hide", but all police want is a confession! Remember, you have the right to remain silent. Exercise that right.

      True. And recently I've found out the hard way that you also have to be very careful talking to the police as either a victim or as a witness. A police interview can quickly turn into an interrogation and you can go from being a victim or an informant to being a suspect without even knowing it.

    As a teen I had unlimited patience for other people's babies. I went and got all 3 CPR certifications, state certified as a registered babysitter, just to be taken seriously. Babies are a treasure, each one highly loved by the parents. I'd be terrified to make a mistake.
    By the time I had my own at 25, I was content to only raise and be responsible for my own, I'm old and tired now.

      @@waterenglish9501 parents have no other choice. they lack foresight and they're selfish. they get pregnant, because they want a baby, even though they cant afford to raise the child without sticking them in some sort of institution. They don't have children to raise children.... they have children so someone else can raise them while they're at work. Remember when that virus hit.... almost every parent in the country was crying "where will my kid get lunch and snacks if the schools are closed?!" (while they collect child tax benefit, child support, section 8 and food stamps)........
      you might consider them "precious children" but most parents just think of them as a right of passage that they can stick on a warehouse shelf while they live their lives. parents don't consider what sort of lives their children will have when they're planning to have them; that's insignificant to their entitled wants.
      they "dont want your input" but at the same time "it takes a village; where's my village"........
      everyone should just submit and give up their hard-earned tax dollars so these "parents" can stay home and parent their children..... we work hard, they sit on their cornihole.

    My 74 yr old husband is in a highly rated nursing home because he is paralyzed and I could no longer care for him at home. I visit daily.
    Using the iPad, my daughter connected my husband’s room so he and I could FaceTime.
    Staff, especially nurses or aides from agencies, know that my husband and I would talk late at night when he was anxious, and we’d often just listen to each other breathe until he’d fall asleep. So I accidentally had a nanny cam, and I won’t repeat the mis-treatment of my husband or how I saw 2 ‘aides’ rifling through his things at 1:00 AM. The reason I’m writing this is to give my opinion, based on 4 years experience, that my child or adult loved one will ALWAYS have a nanny cam in their room.

    Even as a teenager, I had enough insight to understand that fussy and screaming children were not a career choice. People love their own children, but should never expect others to love them as they do. Children require competent adults to care for them. Not other children, nor adults who aren’t operating as another adult would.

    I believe she’s innocent, too. It’s possible he fell from her arms just by throwing himself backward. Everyone who’s held a little kid who’s tired and fussy knows how quickly they can fall if you’re not super attentive and if they’re prone to doing that. Poor little guy seems like he had some neurological problems already and looks like possibly a preemie. It’s hard to expect a special needs person to be able to care for a special needs child. It’s already exhausting to a person with full capabilities.
    Personally I think she got blamed when the daycare was responsible. First for exploiting the labor of a special needs woman, I doubt she was paid well, and second for not having at least three workers so that there were two present at all times. And she got blamed when the parents could have sued the center for lack of safety. Imo no little kids should have been around a hard tile floor, and this little guy in particular should have had a helmet on.

      9 hours interview , they used tactics like saying a expert disagreed with her explanation.
      Her lack of intellect probably got her confused , therefore the experts had to be right , which confused her into making a confession.
      The smoking gun is the fact he kept throwing his head back and already had a lump , suggesting he does it quite hard , there has to be correlation between that and his illness he had afterwards,, i think he did it again and it was the last straw his head could take.
      She probably didnt have the money for a good defence team , and i think the prosecution used everything against her and the defence didnt so a good enough job.
      How it was beyond a reasonable doubt frightens me , the fact he throws his head back puts a huge question mark and i couldnt give a guilty verdict , my conscience couldnt convict with the question of "What if" he threw his head back.

      I agree the child likely was going to grow up with disabilities, I'm shocked the parents didn't pick up on that and have a helmet for him. Maybe they were too poor to get him extra care, unfortunately insurance won't pick up the tab for any assistance until they reach a certain age and can be formally diagnosed autistic.

    When the state "loses" potentially exculpatory evidence like x-rays of the victim's fatal injury, and especially when an anonymous tip leads to their "rediscovery," that should be immediate grounds for a retrial and professional sanction against the DAs involved. Maybe it was entirely accidental, but that makes no difference, except maybe that it means the DAs don't need to be prosecuted for withholding and/or tampering with evidence.

      Very possible. It's likely the kid was disabled if he was prone to frequent tantrums and self injury. Kids who are difficult with special needs have a higher rate of being killed or severely injured by a caregiver, usually the parents. The hell of dealing with sometimes violent tantrums and frequent screaming leads some people to just snap.

    I have a toddler. When he's very tired or overstimulated, he throws his head back. Lots of toddlers do this.
    Honestly, this is the reason I will never trust a daycare. We struggle on a single income just so I can be sure my children are safe. Babies are so vulnerable, and some people just don't care.

      She was a lot bullied. She probably told the detectives what she thought would end the interview so she could go home and go to sleep. I don't know how a confession obtained like that could be introduced at trial and if it was how a jury could believe it.

    That's weird, many years ago my nephew about 4 or 5 years old, was "found" by daycare workers with a massive subdural hematoma and rushed to the ER. Once there, the doctors told the parents it looked like someone took a heavy metal pipe and smashed him on the head! He had surgery to reduce the swelling and had to wear a helmet like thing for several months until he skill bones fused beck. I wanted my cousins to sue the daycare. It just doesn't happen, and someone should have been watching him! They refused to sue and just wanted it to end. The kid turned out ok, but what a trauma he went through! It should not ever be that you take your kid to daycare and they end up with such a bad injury?

    Folks I am no doctor by far but I do have a child that I raised to adulthood without breaking her.
    He has a lump. He has a fever and he's throwing up. He has a serious skull fracture! For god sakes! And how in the hell 2 different doctors didn't catch it is beyond me. The two doctors that gave him a good bill of health afterwards should have their license suspended.

    I hate that police are allowed to lie to you in interrogation. I actually believe the girl is innocent and after being worn down by police in a 10 hour long interrogation, being lied to that they had doctors claiming this and that, she probably told the police what they wanted to hear. She has a lower IQ. No evidence that she's violent or impatient with children she's worked with in the past. This seems like the cops really wanted to make charges stick and the prosecution really wanted a conviction here. Given the baby would throw himself and hit his head on the floor enough to make golf ball size injuries to the back of his head, I just don't believe her confession was true. Very sad indeed. Poor little boy. My condolences to his family.

      I agree with you 100%!! Ten hours is practically torture, especially for a young woman like herself. I think many people don't know what happens during a ten hour interrogation. She was probably left alone for hours without access to her family or trusted friends. No doubt she was scared, upset, tired, and simply wanted to go home. SMH

    This poor baby should have stayed at home, in a safe environment with thick carpets and with his mother by his side 24/7. NOT TO MENTION this unusual behaviour of throwing himself back was probably a simptom of a neurological condition or another ilness and, his parents should've tried to get to the bottom of this instead of unloading him off at the daycare...

    I have to say this regardless of the hate I receive. For me, there are many sad things about this case apart from Ben's death. For me, the saddest thing is that for all but the first 9 WEEKS of his short life, he lived more of his time in daycare than at home or with his parents. When my oldest son was 17 months old, and he'll be 42 bext week, the whole out of home care system was just starting and the "Early Childhood Centres" had many of us young mums thinking that this was better than our kids staying home with Grandma or other family centred care. The thing I still remember is him standing at the door while I walked away, leaving him calling out "Mummy, MUMMY" while I turned my back and walked away. He eventually didn't cry anymore just like a beat up dog with no fight left in it, but I was to make the same mistake again a few years later, the same BS from a society that endeavoured to create places where kids would NOT be raised by parents but by businesses or the state. My middle son was turning 2 that very day and I dumped him in a place he knew no one, and he ran about in a panic, looking for ways out so he could find his mother! I KNOW this because the staff, so thoughtfully, took photos of him screaming in terror while he ran everywhere, searching and yelling for me. Eventually, he fell asleep, broken, and I thought that it was a great idea to dump him on people who could NEVER provide the love and care that his grandparents did or myself or my husband so he couldspendsometimewithhis"new friend"! ! I had 5 kids, I went to Uni to get a degree, I worked nights to study, I got an academic scholarship, I went overseas to open a store in the Asia Pacific region for a large global food chain, changed careers and became an RN, I loved my work but as an almost 60 year old Grandma who is now disabled and hasn't been able to work for several years, there is only one wish I have now and that's more time with my children. It's all true just how quickly time passes and I am left with memories very like the ones I just shared and if I could go through life again I'd treasure my role, and the privilege, of being a stay home mum! I don't know if this young woman, who is my eldest daughter's age, intentionally threw the little baby to the ground and killed him. But I do know he wasn't happy or thriving where he was because, nice as they might have been, nobody there loved him and thats THE most important thing for a baby! Thanks for reading.

    Not looking for justice- just looking for a confession. So how do we stop people with that mindset from becoming police and prosecutors? Melissa had a long history of working with others, and many years in childcare. The description of her temperament makes it hard for me to believe she suddenly became violent with this toddler. I hope she gets a new trial!

    I remember this , i remember seeing parts of the interview , imo the police bullied her and she made a false confession , she obviously isnt too bright , she was interviewed for hours and hours , they kept coming back with fake experts to deny what she was saying , she was then coerced into confessing imo , The poor lad obviously had a habit of throwing his head back and had already been ill , had he thrown his head back on that day i believe it was the last straw , his skull couldnt take anymore.
    I dont believe there is proof beyond a reasonable doubt that she threw him on the floor, you dont just do it , there would have been evidence of her getting frustrated with children long before this and it would have built up to something like this.
    There is a slight case for her suddenly snapping and doing it , but based on the evidence , her confession should have been looked at , taking into consideration her lack of intellect and the amount of time the police kept her there, its been proven before that people have given false confessions in these situations ,, for me the fact he had a habit of throwing his head back , enough to give a huge lump on the back of his head trumps anything the prosecution can give as evidence , her defence probably didnt do enough.
    Classic case of Police bullying to get a confession, and a weak defence against a prosecution intent on winning , and imo its a huge problem in justice, Defence and Prosecution arent interested in truth or justice , they are only interested in winning , and will often use "experts" and arguments to win.
    im 70% she is innocent.

    The problem is many cannot afford to have a lawyer present and often public defenders seem to be working for the state. 20 years ago, I was arrested for a misdemeanor which I was completely innocent of. Despite a public defender actually believing me, she pushed me into signing a plea deal with the threat that if I didn’t, I could spend up to a year in jail, waiting for trial. I’m ashamed to say I took the deal because I was younger and scared. Today I never would. The only solution I can think of is to make the state pay for an outside lawyer of the defendants own choosing.

    ..especially among Infants and Toddlers… and even in the Pre-School side/area… Daycare staff
    MUST be extra careful and observant!!! The kids are THAT
    super active and in a mere second
    … boom! accidents occur…
    Ratio of kids must be 1 staff per 8
    kids… Cameras are a must

    Both my younger brothers were headbangers. The oldest would take a running start when he was frustrated amd slam.ed n8s head ...jead butted the stucco wall in our very long living room. How on earth he sirvived thatt Ill never know. He did this to HIMSELF we had a maid busy dping the housework no adult around I would see him as I was coming down the stairs...many times. Then my youngest brother banged his head into the headboard of his crib...I guess frustrated he was in there.
    I would pick him up amd cary him around. I have since read that head banging behavior is more common in boys.

I saw a one-act play years ago that depicted just this sort of thing, where the cops bullied a victim and repeated the same questions until the suspect was mentally broken down. whether he signed the confession isn't depicted. It was obviously a statement against police abuse. Still happening
