Regarding the stinger, it’s actually even dumber. The word she used was “subrogated.” But subrogation is the substitution of one party for another in a claim with transfer of all rights and duties that entails. **It’s an insurance thing.** That’s the thing that allows your auto insurance company to sue the guy who t-boned your car. Technically, without subrogation, they weren’t injured by the t-boner’s actions and wouldn’t have standing to sue. The subrogation clause in your insurance policy allows them to sue the guy, not on your behalf, but instead of you.
Her using subrogation in this context is completely incoherent, it’s just a vaguely legal term she remembered from law school and threw out to make herself sound smart.

The People are Sovereign. They retain ALL rights.
The Monarch is the symbol of the People’s Sovereignty.
The People select a government for the good governance and benefit of the People. Laws can be passed which codify the existing rights.
The Monarch must give assent to any law that is passed.
It’s a system that has evolved over the past thousand years.
America chose a different system, where rights are granted by government.
I prefer the Westminster system as it will acknowledges existing human rights, not grant them, which implies they do not exist naturally.

Someone who revokes your right to self-defense is someone who wants you six feet under.
The Constitutional Rights are there to make these sorts of things explicitly extralegal in a legal system. Simply don't let the legal system argue that point.

This bill is so badly worded that people inside and outside of New Mexico are suing. I think it also has something to do with abolishing qualified immunity.
People say that without really knowing what qualified immunity is.
Qualified immunity only protects officers from civil suites when their actions are within the US/state constitutions and department policy, which enforcing this order clearly would not be.
Police officers are refusing to enforce because violating someone’s second amendment even if they’re “upholding a state law” is gonna cost them a pretty penny which law enforcement can’t afford. That’s why it’s unenforceable.
That actually could have been a court argument (it’s not a meaningful law because it can’t be enforced so it’s okay to remain”) except the governor said she’ll send fines to the people who were at the rally so it is “being enforced” and only the governor could get sued for it personally.
It’s not a bill. It’s not even a law. It’s a unilateral decree by the Governor.
I believe that the abolishment of qualified immunity was extended to multiple government agencies and offices.

He's also assuming that the local ABQ courts (which I'm guessing are as blue as they come) are less ideological than Gov. Karen and that the NMSC is also half honest. If there's anything the last few years has shown us it's that State Courts will utterly ignore blackletter law in more shocking ways than most federal courts. I agree in principle with Razor, but in areas where you have a governor this bent, you're not likely to get resolution on the state level and are burning precious time (I'm betting she could have kept this thing tied up for 30 days in state court), money (something our side is always short on), and political capital trying to do so. Better to knock her metaphorical teeth in from the jump.

If she demands citizens give up their guns, then she needs to give up her armed security detail, her paycheck, benefits, and resources available to the office of the state governor, ie Governor’s Mansion, chauffeurs, vehicles, mobile phones, etc. And the constitutional rights are _inalienable rights_ NOT “privileges”.

The New Mexico Constitution only allows guns for sport and self-defense against crime. It specifically allows the State to ban concealed carry, and it doesn't recognize the right to resist government tyranny. Razor was wrong in this one. A lot of the newer States have neutered "right to arms" clauses.
@RexFuturi You should have watched the video then. If you had, you'd have seen the note that flashed on screen, explaining that the New Mexico supreme court SPECIFICALLY OVERTURNED the concealed carry provision of Article II in a landmark case in 2004.

Notice how emergencies are whenever they want them to be? My state is currently in a state of emergency from "severe storms." My power didn't even blip. I look out the window and I see just another breezy summer day. I have literally gone camping on a mountaintop in much worse weather. But I have to give my employees "hazard pay" until the governor deems otherwise. Might as well call being alive hazardous and set minimum wage to the hazard rate.

SCOTUS can state the state constitution and laws are invalid.
Unless a state is willing to leave the US, nullification (what Razor is actually implying) has been legally rejected multiple times, including by the SVOTUS.
