    Sir it's a pleasure to listen to your lectures. There are two legends in our profession who can speak endlessly without looking at a piece of paper one is Nani phalkivala sir and the other is justice rohington nariman sir. Two people whose lectures i would like to hear whenever I get an opportunity in present day are Harish salve sir and justice nariman sir.

    What a scholarly and eloquent discourse on what true freedom of speech should mean in a democracy. Why it is so crucial for preserving and fostering a genuine and tolerant republic. And also its historical evolution! Hope we have more such brilliant, upright and public-spirited leaders in not only our judiciary but all walks of public life! It may be too-long for many, in today’s ‘abbreviated’ world of Twitter, Instagram and Tik-Tok. But worth every minute you invest in listening!

    I really feel that Justice Rohinton Nariman should have been now on the Constitution Bench along with CJI.
    Justice Nariman is undoubtedly an exceptional intellectual and a genius.
    He is also a Parsi priest with entire Zorastrian scriptures on his fingertips.

    We as a residential society have filed a case against a developer who hasn't paid our rents for over 3 years and redevelopment project is at a halt for 4 years, case hearings on for more than 2 years now with judgment passed by Hon Mumbai High Court several months back, judges kept changing, we keep getting dates with our cases not being heard, I'm sure there are several cases like these, can our legal experts & channels like these focus on helping us timely justice rather than everyone discussing nonsensical issues?

    the first thing that comes to my mind everytime i watch him speak is the fact that he makes complex things so easy and palatable for common people to consume.it has always been a pleasure to watch this legend into action it was a super enriching session looking forward to many more.

      He himself is the descendant of those who had escaped persecution by Muslim brutes and fell at the feet of Hindus.
      And now he advises the hindus to tolerate the very same brutes.
      How it is possible?

And biggest hypocrisy is now Brahmins mur++derers r+×apist claims that their Pakhand Religion is the religion of tolerance and Peace Coexistence.
      You have stains of b×lood on ur hand of innocent millions of buddhist. Buddhist had been eliminated from the land of Buddha by foreign brahmins. Isnt it the time that brahmin religion should come out in public and seek humble apology from Buddhist all around the world

      "There can be no doubt that the fall of Buddhism in India was due
      to the invasions of the Musalmans. Islam came out as the enemy of the ‘But which is the Arabic corruption of Buddha.
      Islam destroyed Buddhism not only in India but wherever it went.
      Before Islam came into being Buddhism was the religion of Bactria, Parthia, Afghanistan,
      Gandhar and Chinese Turkestan, as it was of the whole of Asia.1 In all these countries Islam destroyed Buddhism.
      As Vicent Smith points out :
      “The furious massacre perpetrated in many places by Musalman invaders were more efficacious than Orthodox Hindu persecutions, and had a great deal to do with the disapperance of Buddhism in several provinces (of India)".
      Here 'More efficacious than Orthodox Hindu persecutions..." also explained by Dr Ambedkar.
      He says Muslims considered Brahmins as the original and the Buddhist monks as bald imitations and therefore killed them.
      Dr Ambedkar adds the decline is also because the monks did every work like carpentry to earn a living but Brahmins did nothing but religious duties such as priesthood or presiding over homas - never deviating from the Vedic duties.

    Very Good. FREEDOM OF SPEECH must be maintained, thoroughly protected and seen being enforced. Should not be allowed to be restricted by ANY Govt., ANY Institution, Any Platform, either operating in form of Electronic Media or otherwise and by self-serving rules and interpretation are violation of fundamental rights given in the constitution which must be kept in mind by anyone trying to restrict people's expression in any mode. "Public order" is NO blanket exception to restrict - Freedom of Speech - this must be kept in mind whoever wants to put restriction in any manner.

    In Judges profile on SUPREME COURT judges Justice Nariman proudly claimed 1st class in School. I was glad to learn about this brilliant judge with 1st class in school. Really proud to see a judge with 1st class.

    The intellectual clan of this land, which we named and are addressing as the Union of India (with 29 states as different and distinct entities!!), should start thinking actively and speaking boldly about the country as a Nation and its governance! Can we find any statesmanship in the national leadership and administration? I doubt and am curious to see the reactions of the middle aged citizens of this vast democracy, who only appear to be busy or, sare made busy with an instrument in pursuance of cash transfer transactions! !😊😄

    Also then Justice Nariman critised Nehru two to three time. He is advocating only the power of people and nothing else.

    Why is this idea of free speech not applicable to the judiciary!!! Judiciary sees itself as beyond reproach and accountability.
    It will be worthwhile if they spend this energy in finding ways to reduce pending cases.

      Just see number of cases a judge clears...
      Be an educated man..
      SC hears 60/70 cases daily.. let alone all the HCs..
      The Govt is the main litigant..
      What do you think? A law has been amended which has a chilling effect on freedom of speech.. and the Executive is catching all its opponent under this? Will you pendency then...
      In a case, ED caught a man and drove him to the SC for 200 Rs...
      Again, I say.. You are free to speak.. but in foing so.. don't be sensed that ypu lack knowledge

    What BBC presented was virtually against the ruling by the SC in the Gujrat riot case where Modi was exonerated after multiple inquiries. So I wonder if Justice Nariman agrees with BBC that the SC had given a wrong judgement.

    Justice Rohinton Nariman is totally disconnected with the Socio-economic-politico conditions of different strata of Indian society which also differs in different parts of the India. Quoting US court judgements is good academic & intellectual discourse but impractical in actual jurisprudence.
    Free speech is what has got the US to its present abysmal state. Expecting maturity & discipline from an uneducated section of the populace to safe guard free speech is like scattering pearls before swine. The Justices of Indian jurispridence hv fAILED to dispense justice TIMELY & the contents of judgements in most cases are ludicrous since judges are divorced from reality. Naxal Violence, as an example, is the end result & reaction to a situation that has become intolerable & justice is evaporated. Same holds good in politics of caste divide & religious divide, ideals of liberty & fraternity not withstanding. ⚓️⚔️🇮🇳

    We are fed up with these panegyric statements . What was the contribution of the Honble Judge to India or its democracy? He might have been a jurist par excellence, but what had he done to the people or to improve their livelihood? People have lost faith in judiciary which doesn't rise to the occasion when the country is in cricis of democracy &&the voting procedure. The recent SCI, s concurrence with the EC &its blatant validation of much suspected EVMS indicates that it has anti people& democracy , without a sound democraticy how can a judge deliver justice??? There were instances that the renowned judge often safeguarded criminals & corrupted politicians!!!

    Is there a dissonance between the ideals enshrined in our constitution and the ideals/values practiced by the current crop of politicians, especially those in the treasury benches?
    Ambedkar had warned of this possibility in his final speech to the Constituent Assembly. His fears seem to have come true.

    Ons side story...could have mentioned about Sar Tan Se Juda slogans in open.. Always religious minority being harassed.. In our country, every year 1 lakhs very high value vehicles r purchased, 3 lakhs r going on foreign tour including lower cort, high court, supreme court judges n lawyers bt tax payers r very very minimum amongst them..Doctors, engineers r also on same page, only middle class r paying taxes honestly... If u r living luxary life n not paying taxes, u have to face IT Dept, EDs...Don't worry, everything will b alright...Kanoon ka dar hona chahiye...waise judges r immune to all such things...left mind will always have problem with nationalist govt

    You have been given excellently elucidated regarding freedom of speech means since long back meant since first prime minister india jawahar lal nehru during period of his gouverned had had curb downed that during nehru period efforfully achieved made people as literated/ saksharatha just upto 37 percent up to the year 1964 October then j nehru died.
    But please please just see the awesomeness facing by the people of india since 2014 our prime minister of India Modiji one by one draconians made from demonetised keeping bin the mind falsely charges made against opposition party particularly on Indian national congress party rehetorically in his each and every speeches does not have consciousness of very basically our Indian constitution of india democratically it well structured and position given as so called shadow government as intact same j nehru while no opposition party strength but he created though in non strength in opposition party leader for parliament of India. But now though majority in opposition party inc but Modiji don't care master. Even dynasties period of time there was system mantri through or he directly went to listened people's praja concerns . But vice versa . Sir I can not say you in one para,one page whole but now now truth are several several our government of India and almost states government utterly failured decelerated giving minimum growth people's performance index, unemployment 10 folds compared with previous manmohan singh government good to the people of india.

    The judges are intolerant towards contempt, but feel freedom of speech villifying other dignitaries., expressing different stories based on their own imagination even on court adjudicated matter is OK and falls under freedom of speech ??

    How come we the general public don’t hear hate speech against the minority he mentioned. Unless talking openly for the majority community which was absent earlier is misunderstood as talking against the particular minority community. We’ll, enlightened minds can make mistakes too unless they are used to an India before 2014 where if a Hindu said he was a Hindu was considered communal only Muslims or Christians or Sikhs could proudly say who they were. Hindus had only one option of calling themselves secular.

    Noted that most of the arguments were based on precedents...and sometimes hinged on to the constitution...which is how laywers argue a case..very technical in nature....But we often over look the fact the constitution and laws are man made..in keeping with certain realities in the past..which could change overtime...example..same sex marriages are allowed in certain countries today, there are US states that has banned/restricted abortions ...based on value changes..and pressure groups....As such, we should not over emphasis the moral basis ..of any legal arguments...whether it for free speech...or sending someone to the gallows for murder or drug trafficking...

    I would have appreciated Mr.Nariman, if he had spoken about freedom of Speech of Nupur Sharma. He is only interested in politics and not freedom of speech.

    Dikra, just to take you back to the landing of Parsee refugees on the soil of Bharath n your acceptance by the king, when your leaders said you'll live like milk, water n sugar combined. You have prospered very well, you must not forget that you are in Bharath, the most kind nation.
    The stranglehold on our judiciary is contemptuous of the values of Bharath. The elected leaders are held in highest esteem n we donot like imbeciles bending rules for personal favours.

    I am unable to unserstand why incitement or provocative words (free speech) [which do not fall iinto the 8 pigeonholes of exclusion], is considered [in law] to be an offense and therefore amenable to censure. Every adult of sane mind [or groups] has to bear the responsibility of self-discipline and self-control and so NOT get antagonized to such an extent that public order gets disrupted through violence etc.. If he is unable to control himself & gets "incited" or "provoked" - whose fault is that? Who committed the crime? Who broke the law? The first party has only spoken their mind [which is of no consequence whatsover, so far as reality is concerned] whereas the second party has resorted to violence and caused hurt and diusrupted public order! So, while the cause of the ruckus was the free speech by the first party, the second party ought to have exhibited more self-control and resorted with only words or arguements and NOT violence!

      Its like saying that - if provoked, I acquire the legal right to take the law into my own hands & deal with the instigator, and that such action would be justifiable in law just because I was provoked!

      @@sasikumarn5786 That's exactly the point! If someone says something, I can choose to ignore it & not get provoked. [If I'm mature & tolerant, thats exactly what I'll do] Hwr, law punishes the speaker & not the provoked person who actually broke the law by say, causing hurt.

    His very knowledgable judge but his views on present govt is onesided. What is necessity for BBC to bring the decided matter in the highest court which may incite violance. It is degrading our govt. The BJP govt is not creating problems to minorities. In india minorities enjoy more freedom.His various references on freedom of speech etc are admirable.
