    I am currently suing CPS in Federal court pro se. It is a lot to do! I couldn't find an attorney willing to represent me up here in VA. I haven't been able to find an attorney that I could talk to just to get some help when I need it while representing myself. As long as I don't screw up and get it dismissed on some technicality or something I have them dead to rights in the wrong. If I can get in front of a jury, I got em. Appreciate all of your videos they have helped tremendously!

      Wow! That is astonishing! Federal cases are difficult for well-seasoned attorneys, so the fact that you're representing yourself pro se is commendable.

    My grandson was removed by cps, texas because he was a breastfed twin and he wasnt gaining weight fast enough for them, He was taken to the hospital where they put a feeding tube in him and the parents were told that if he would take the formula any other way that he wouldnt have to have the feeding tube. He pulled his feeding tube out 4 times at the hospital and sure enough the first night he was home he pulled it out again, so his mom worked and worked with him and figured out how to get him to drink the special formula and he gained 2lbs8.4oz since his release from the hospital ,as documented from a Dr. The case worker got mad at my son because he illegally got the medical records without consent and without a court order and he called him out on it and told him he was going to report him and the very next day he returned with the cops to remove the baby just because he pulled his feeding tube out! And they were never given any paper work to even tell them why they were being investigated, These parents have 7 other children that are still in the home including this babies twin brother! And then when they went to the first court hearing they were never even told what the alligations were! Then they had services put in place thru 2ingage and that lady finally sent them the paperwork on the case and everything that this case worker said was a lie! Even tho they have a court appointed attorney the judge was never aloud to hear that everything that was in the case workers papers was a lie! They cant afford to get a private attorney and my son is just about to the point of giving up because he cant even work to support the rest of the kids because of all the demands that 2ingage has placed on them, no boss is going to put up with you taking off of work every other day to go do what they have to do! And the mother is a nervous wreck wondering when they are going to come and take her other kids away beause they are poor and dont have the means to even comply with everything that they have to do! PLEASE HELP!

      It’s and justice for those with money .I would highly suggest hocking everything that they possibly can to afford an attorney because no one will listen to someone unless they have money or power.

      Amen! Record everything at all times everywhere (so long as it is legal). Not all states permit recording without the consent of all parties, so check your local laws to see if you live in a 1-party consent state or not.

    How is it that CPS is allowed to take the children in the first place? Who grant them jurisdiction over their children? Could it be that " we are considered as wards of the court"?

      In my experience, Judges aren't necessarily in their pocket, but they do rule heavily in favor of CPS. They get complacent and rely on the Department to tell them the law and not enough parents know their rights well enough to stand up for them.
      This is why it is important for parents to assert their rights to the Trial Court to preserve error because the Appellate Courts are far more likely to follow the law more strictly.

      There are plenty of legitimate child abuse and neglect cases to ensure job security for the judges. There is no need for corruption to ensure that.
      Not saying there aren't other reasons corruption may exist, but "their job depends on taking children" isn't one of them.

      This attitude is exactly why they are still getting away with it... Why would they change anything if we just keep rolling over and letting them do it?! I appreciate that is how things have been going in the past, but this movement is growing very quickly as people wake up to the truth, so I would appreciate it if you could stop spreading the pessimism... Maybe consider offering positive thoughts while we continue to try!!!

    I'm all about limited government. At the same time, I'm not one of those people who would blame CPS for "not doing enough" the minute a kid is harmed or killed. Because many if not most of the same people armchair quartetbacking and talking so tough in the comments.. they'd be the first to place the blame if something bad happens. Where does the balance lie? Not an easy question to answer is it

    It's important to realize that we are mother's and father's with sons and daughters and not parent and children.
    Also important to realize that everything these cops agents are doing is under color of law.

      Well, yes they are acting under color of law, but I don't think that means what you think it means. If a police officer pulls you over for a traffic ticket in their police cruiser, then they are acting under the color of law.
      It is a crime for any person acting under color of law, statute, ordinance, regulation, or custom to willfully deprive or cause to be deprived from any person those rights, privileges, or immunities secured or protected by the Constitution and laws of the U.S.
      In essence, government agents always act under color of law in the execution of their duties, but the problem arises when they violate your rights while acting under the color of law.

    Just got an open case here in Missouri. My daughter is making false allegations on my husband physically abusing her. Which is not true what so ever! She had stated that she cuts on herself which again isn't true. They have taken her to a forensic investagator to check for any past and present injuries. They know that it all came back negative. But still haven't seen or talk to her since April 11th. I also have a son that is still in my home. Why is it ok for them to keep her if she is at risk but my son isn't.?

      All I know CPS took my kids from my tweaker baby momma and gave them right back to her and her boyfriend the social worker told me to get over it but one year later the CPS social worker son died now I hit her up every year to remind her that her son is dead and my kids are still alive August 16 the death day 😂😂😂God is good

      Oh no! In Texas, if CPS files a case seeking conservatorship or termination of parental rights, then you're entitled to a court appointed attorney if you are indigent.       @@windymcgee6833 I can't speak for every Court Appointed Attorney, but here in our County the Attorneys appointed are all in private practice and not a part of CPS or the County. I know our Court Appointed Attorneys to actually fight hard for parents.

      Beg, borrow, steal, sell your car, sell your home and get an apartment.... do whatever you gotta do but get an attorney!!! Getting an attorney to represent you in a CPS case is like paying for a life saving operation. Your child's life and future is at stake. Look for a Pro Bono attorney, they can be hard to find but they are out there! There are some programs that help families pay for attorney fees. Try to get your case some publicity, if you can get your story on the news do it! Post your story on social media, an attorney might reach out to you if they see your case on the news or read about it on social media. Go fund me or other crowd fundraising websites. If you do the work, you can find a way to pay for an attorney!!! preventing CPS from taking your child or having your child returned to you after CPS has already taken them... likely won't happen without an attorney to represent you.

      I'm currently dealing with DCS in Tennessee. They removed my 17th month old daughter because I was arrested for interfering with a 911 call and child endangeent because my daughter was in the room when I was arguing with the police. I was granted therapeutic visits April 29th but haven't gotten anything. My public defender don't answer for me. I'm completely in the dark. I have letters from my daughter doctor who she's been with from birth and a couple people who know us. I don't know what to do.

    I am past child baring years but have fostered in the past. Adopted two. The question I like to ask is if parents can hire an attorney to be with the child during investigations and questions by CPS? Sounds crazy but the child rights to be raised by his parents who is only being accused of abuse should have protection to be raised by parents. So, there is a person on behalf of the child and making sure child is not pressured to reply to questions in a way that would benefit the department of children and families. It is now contracted out and not ran by the state. Should go back to being paid for and ran by the state in my opinion, and prisons too. N one should profit off these things period. Peace!

      Typically, the CPS investigator will make an initial meeting with the child, and if the child makes an outcry of abuse, then the child gets referred to the Child Advocacy Center (CAC) where they are asked questions in a non-leading manner and the interview is recorded.
      Under some new laws on the verge of being passed, even the initial interview with the child will have to be audio and video recorded. If the investigator is asking leading questions, then that would be subject to cross-examination at trial.

    Cps didn’t meet with me. She didn’t show up to our scheduled meeting. She lied and said I didn’t keep appointments and cancelled meetings. They took my daughter and gave her to the father who is emotionally abusing her and isolating her. I have proof that she lied and I really need help.

      @@MatthewHarrisLawPLLC I have a court appointed lawyer he's not very social with me the removal says because I didnt comply with their services for my boys dec 30 2020 and the removal of my daughter jan 7 2021 because substance abuse she came back negative on all drugs and that I didnt comply with CPS with my boys. I had an adversary hearing on the 19th n they wanted me to do a plan but that's digging a bigger hole. We didnt agree so they rescheduled another hearing what can I do to stop all these hearings and get my babies back. Allegations are far from true drugs mental n physical abuse for my boys. They are upto date on dr appointment shots my drug test came back negative my hair follicles was 3.1 low count. N mental dr said i didnt need services

      @@atakeonus9912 Attorneys respond well to written requests. If your Attorney won't provide you with a plan of action, then send him a written request asking him to outline the plan of action and the steps necessary for your children to return to your home in writing for your records.
      Do it in a respectful and professional manner, and we bet you'll see results.

      What if court didn’t get involved until after they take the kids that happened too me and they took a drug test and it came out positive but I don’t do drugs so I was never offered to take any drug classes did they have a right to take my kids from me? And how can I fight them back

      @@baby_family_82 I don't know your state, but many times they will take the kids and test you, if you fail then they keep the kids and you need to have a case plan or some type of agreement on how to proceed in order to have the kid(s) returned to you. In the case you tested a false positive please see the paperwork you received from the court about appeals and find a local professional drug testing place (they have them in most large cities) and schedule and pay for your own drug testing. I would go more than once if possible to show that there are no drugs in your system and get the professional results showing this documented. They do it down to very tiny measurements an average test does not do and are incredibly accurate.
      If they ask you to take random drug tests and you don't do drugs then it should not be a big deal. Stand up for yourself and prove them wrong and appeal.

    I believe that CPS violated our 1st Amendment rights by removing us from church right in the middle of our lesson. Also my parents were removed from teaching the children's church. Could have done it prior to church or afterwards, but 30 minutes in? Just wondering. 😢

      In the legal system an adversarial hearing just means the two parties are at odds against each other.
      Other hearings are not always this way such as an update hearing where the judge may hear a parent has completed drug tests, found stable employment, been to therapy, etc. and the judge may return the child. That would not be adversarial in nature, but changes in rights require a judge to sign off.

      Unfortunately we do not. It's not that we're not willing, but the cost for us to travel there for all of the CPS hearings is more than most people are able to pay for these types of cases. Just for 1 afternoon hearing, it would cost around $4,500 when you factor in airfare and the time spent traveling at the attorney's hourly rate. I really wish it were cheaper.

    It's not about panicking if you haven't seen your kids for 12 months over lies and you have the facts documented and the judge is not hearing it you're going to be a little on the edge. Did judge should understand some people really love their kids and judges make mistakes all the time. Instead they look at your passion as you being a angry parent never mind the fact that you can't see your kids off of a lie.

    they took my kids, they did not care, they lied and said things that weren’t true and said that they wanted to help me but wanted to have the kids even my almost 18 daughter and they did not spare her

      So sorry to hear that. I had my kid taken off me and unlawfully. The allegations I read may as well have been someone on drugs. People said cooperate but that did not help either. As such I have complained to several regulators. I have no idea how far I will get but... I was told the way it goes is CPS just pick on some parents who are trying their damned hardest and don't give a flying flamingo about kids who are genuinely neglected and abused.

      That’s a very unfair statement as there are plenty of abusive social workers as well, that do not inform parents properly of their rights. If following the law is abusive, then I’d make the point that ripping kids out of homes that don’t necessarily warrant that action are far worse.

    Im biasee as i was HRSn or DCF, or CPS, is just human trafficking, not in all, but a lot of situations. Guilty before proven innocent though..... So basically, if you bring it to court, you have burden, or plaintiff.... Ok im just a listener learning my kids sre grown

    Having worked for CPS in several states this is good information.
    The reality is, if the kids are unsafe, then absolutely a plan needs to be created to keep them safe.
    And if the CPS is unable to prove that a concern existed to warrant a removal by taking custody, then the kids should absolutely be returned home.
    This information is 100% applicable to anyone who was wronged by their CPS caseworker. Parents should have the best legal information (and representation) they can, especially if the children were wrongly taken.

      Respectfully, I disagree. Would you open your house, cabinets, and body for search by police who received an "anonymous tip?" That's essentially what you're asking parents to do, except the consequence could lead to permanent termination of your parental rights.

      I was taken away from my family from baseless accusations and have only recently aged out of the terrible system. You clearly never had any interaction with these people. They do not care about families or the kids. They will lie and do anything in their power to make it hard for families. It's impossible to just have a conversation like adults with these corrupt pigs.

    How is it that CPS is allowed to take the children in the first place? Who grant them jurisdiction over their children? Could it be that " we are considered as wards of the court"?

      No, I don't think we are considered wards of the court. The Court exercises jurisdiction only to the extent permitted by state law. If you want to effect change, speak with your local Representative.

      What state law grants the court jurisdiction of people? I thought God was the supreme ruler & had jurisdiction of the people. What's legal is not lawful. Statues, codes, are not lawful but legal. I think most people forgot about common law. We are dealing with corruption, trafficking at it's finest with these entities.
