  • All over Mumbai, there are protected tenants living in aged buildings desperately holding on to their rented properties, which are falling apart. These people should seriously consider letting the landlords buy back their properties in mutual interest. Holding on with a death-grip to their legal entitlements under Bombay Rent Act is not the right way forward.

    Pagree laws should be removed and old building should be made compulsory redevelopment in city. Save lives and livelihood

    This guy is the first urban naxal , who is favour of landlords and not poor tenants who had paid 2/3rd of the value of the property in 1980s.
    85k if adjusted to inflation is present day 1.7 crore rs.
    Tenants should be ready to leave the house for free, of they can pay the 2/3rd of sum paid in 1980 adjusted as per today's inflation.
    Krishnaraj Rao seems to be semiliterate on this matter.

    This guy is bogus and not calculating inflation and devalueation of Indian currency..bogus advice land loard has to redevelop the building and convert room from Pagdi to ownership flat.Land lord is chor

    Solutions ye hai ki owner building re develop kare aur additional FSI se uska fayda hoo aur Kutch less space in tenants ko dee new building me jis se dono ka problem solve ho jai

    Wonderful advice. Even a relative of mine owns a building in Dadar. It is very old but in decent condition. I don't know if it's pagdi system. They are too good to for thier own good and have never attempted to empty the building. One tenant who does not even live there anymore has kept one light on and keeps paying the bills as proof of occupancy. The rent is in 100s. Who would want to vacate such a flat in a good neighborhood. But they have to pay from their own pocket or request the teneants to contribute nominal amount for repairs etc. Fortunately, the tenants are not poor at all and they have good relations with the owner. So things are going okay. But, they (owners) are living a middle class life inspite of owning a whole building in Dadar.

      He doesn't own their house, he only owns the land , the tenants have purchased the property while the land is on rent , the landlords are a pain

    Advise is tell daughter to send some funds and reapair do up bldg. if the lady has to buy a flat in the same area it will cost nothing less 70LACS for same area. Where as once tennant leaves if bldg gets developed the owner will get more FSI and earn much more profit.
    This a very TRICKY CASE ESPECIALLY IN BOM thats y the owner shld give nothing less the 10% of market value. Cause ultimately owner will profit ALOT

    Sir ur advice is good bcoz there is no hope that pagdi chawl will go for redevelopment easily, it is better to sell these properties whatever price is negotiable and move forward. instead of waiting for 20 years or 30 years for redevelopment of pagdi chawl.

    The video is just to manipulate poors ask landlord to redevlop under mhada system if mhada iqnores write a letter to CMO Maharashtra and also bring on press and media and than all death responsibility should be on govt, bring laws to bring on solution to deadlock situation of poors

    After death of tenants ( both husband and wife ) ,six months later owner can file case of non use.
    If tenants dauter is abrod, owner will win .

    Although this is the best advice for given problem , that something better than nothing But Rao Sir, for 25 Lac interest rate for senior citizen is around 8 % which is about 2 lac per annum which is about 15 or 16 K per month , can that poor old lady get a house for rent for 16 K in city like Bombay ????

      The thing is she never bought it neither did the tenant even landlord buying it wouldn't be profitable since building it and even after he sells mhada flat he wouldn't earn more than 50 lakhs .. landlord is only the structure owner since his lease expired.

      Correct, so she will have to go far out of the city to find economical housing. But if she insists on living in this rented house, her life is in danger. At this age, a swift death would not be a problem. But what if she or her husband suffer crippling injury and long (and costly) hospitalization?

    I do not agree with u sir...u are completely in favour of the landlord..
    If the building is in bad state...it's landlords responsibility to take care of the reparing work. Cause he is the owner...if not then the owner should go for redevelopment and look into the better future of all those who have been staying there from years..
    In 25 lacks she won't be able to buy a single room even in thane or kalyan unless she goes to villages ...so sad...to hear this...

    Now mhada is giving notice to landlord of such buildings, and if they dont appoint builder within specified time. Then the rights of choosing the builder goes to the tenants. Once the building is redeveloped the pagdi is not there, the tenant become the owners, if you go to sell a 320sqft in dadar u get around 1cr and you have to pay pagdi of around 33-47% which is very wrong as per rule you only should pay 33%. So you get around 60lakhs approximately, but if the property is redeveloped then the tenant will get around 2.5-2.8 crores. Thats the reason everyone is waiting for redevelopment which is good for both landlord and tenants also

    When one is a protected tenant nothing to worry the tenant will still survive after the building collapses to attend to the landlord's funeral & hopefully construct a new building in memory of the late landlord.

    Is Pagdi system now because I am being harassed by this landlord kind of thing the person who doesn't have registered documents how he can call himself landlord and what are the procedure if there is somthing like house 🏘️ tax can I directly pay to court because the pavti what ever he was giving is illegal kindly help us

      My landlord also doesn't have any papers that he owns land, and now he is not interested in redevelopment. I want to know if they don't have papers of land, that mean land given to them was on leadz. They are not owner of the land.than, how they are raising rent and huge water bill from us.

    Mr Rao mainly landlords are new landlords who have bought building structure at a cheap price.2ndly as u are mumbaiker u must be knowing there were hardly ownership properties in original mumbai which is from colaba to mahim in western side rest was lately developed & known as suburb which brought the concept of ownership in the eyes of masses .people at that time in town didn't knew the concept of ownership & they bought property thinking this is the original price of the house.so mumbai town pagdi properties shouldn't be taken as rest of india.lastly sir due to this dilapidated structure issue goverment came up with a rule 33/7,due to benefit of this scheme builders buy such structure and as we all know the structure before this scheme didn't had much monetary value now sells in crores of rupees + they have been charging pagdi which is always 30% of the property value.
    although I agree that maintaince part should be separated from this so call rent so that the property can be maintained.
    I am just property enthusiastic & love your videos & you are doing a great job by sharing your knowledge with fellow citizens.

    Tenancy rights are always reserved.Why not they go for redevelopment under section 33(7)a.

    Through Krishna sirs channel I would like to share experience if someone is about to take a flat under sra policy in mahalakshmi or any other place then don't go for it I will tell you why
    1)they tell the price of flats about 40 lakhs(which in Bombay like city is near to impossible) when you will visit the flats they are about 3-2 bhk with huge area which I think it will cost around 2 crore .
    2)no builder comes in front to give you the flat possession guarantee the deal is done by agents which we don't know whether they are agents of builder or not
    3)they demand full cash together and after 6months they will provide flat possession still without any proof of payment
    3)the tenants who firstly had their chawls there are not given rents till date but when you will inquire about it to agent they will show you that they are giving rents but reality is different i am saying this because tell me who will leave a 2 bhk flat with huge space in Mumbai but the tenants there wants to sell their property and go away reason being that they also know that rent is not been issued till now and their are no chances of flat possession.
    4)they clearly state before that there will be a.lottery system most imp point pls read carefully when you visit the sample flat they show you the 2 bhk flat at 40 lakh but no one will tell you or guarantee you how much bhk or area you will get in lottery this point was neglected by me but suddenly after discussion this point came to be known by me
    Conclusion : pls don't opt for such a property Krishna sir has saved me from this trap orelse my 40lakhs were fully wasted although we didn't invest a rupee in this project so all thanks to Krishna sir be safe take care🙏🙏🙏

    If the logic of the specialist is wrong because if the return on investment is so low then why are people still buying the old buildings? It's for the transfer fee on sale of tenancy right that the landlord gets for effecting the transfer..

    Her children should fund the renovation instead of misguiding her that landlord is responsible for it and see asking her to call people like you.
    The landlords family is living in the building then the building should be OK but might require internal renovation instead of starting a new life in 20-25l its better to renovate if it costs 5-10l. Now a days children want their parents to leave properties for them but they don't want to invest in their betterment while they are alive.

      @@harmeshpanchal the landlord has to create a new agreement with the children. Landlord has to agree to that. If not, it ends there! That’s why maybe he suggested that better sell and get away with whatever money you can.

      If landlord agrees to transfer than he will charge new pagdi which can be upto 30% or else he would ask the legal heirs to sell it to him in a lesser prices.
