    But, Emily, it is not only the chat that makes this the #1 channel for trials. It is you. I honestly thought it would be Baldwin's ego and arrogance to be the focus of his case, not Morrisey's to implode all the cases.

    • @shkrjam84
      @shkrjam84 2 місяці тому +2

      Right? We just took a major side quest 😳 And I hate it for Helyna’s family, but at the same time, if someone with such high powered attorneys on such a high profile case can’t get fairness, how can any of us?
      I also was not sure until more evidence was presented if it was even right to charge Baldwin as an actor. I could get on board more as a producer. But as an actor, he should be able to rely on the armorer and AD doing their jobs so that he was never in a position to cause harm. And I disagree with those shouting “cardinal rules of safety” when it comes to a movie set. Even if he was violating some safety rule imposed clearly on actors, which hadn’t been proven in court yet, the armorer was supposed to be there to supervise and stop the behavior. And again, my mind wasn’t made up yet on whether AB should have been held criminally liable. What I remember from HGR’s trial was that there aren’t very clear safety standards in the industry even around armorers, so I don’t recall any clear safety standards for actors to follow. IMO, Hannah and Halls were the two most culpable, and the state erred in giving Halls such a sweetheart deal so quickly. Of all the shenanigans, that deal with Halls makes me the most angry.

    • @marymaclaren9553
      @marymaclaren9553 2 місяці тому +1

      @@shkrjam84 Halls got the sweetheart deal because the original prosecutor was, in my opinion , had an agenda to get Baldwin because he is Alec Baldwin. An agenda that Morrissey unfairly got saddled with when she was appointed the special prosecutor. Morrissey most likely would have gone after Halls with the same energy as she did with HGR if there was no deal. I fully believed Morrissey charged Baldwin because she truly believed he was the last failed link in the safety chain. I'm still not convinced she had it out for ACTOR MAN, but I do think she had the win at all cost mentality. I have been saying all along, hubris and arrogance ended Halyna Hutchins and now hubris and arrogance ended this case.
      I believe Baldwin should have been charged as a producer as well, but then again I believe all the producers, specifically the one that hired HGR, should have been charged, but that didn't happen.
      And I don't think it is the duty of an actor to pull the blanks and check them, but they should be following the rules the armorer establishes to a T. Baldwin didn't even attend the safety meeting. I was hoping that in light of this case concrete, clear rules and regulations would be set for movie/TV productions.
      But as for Baldwin, what I think makes him responsible are his own words. I'm paraphrasing here but, he has all sorts of experience with onset weapo ns safety, knows not to point any at anyone and knows blanks are still fatally dangerous. And yet he ignored it all.
      I 100% agree that the judge did the right thing. I already respected her before, my respect for her now is just through the roof. And I really, really liked Morrissey, despite her second direct thinly disguised as a re-direct and her frustrated school teacher tone. She proved to be a huge, shady disappointment.

    • @shkrjam84
      @shkrjam84 2 місяці тому +1

      @@marymaclaren9553 totally agree! I think Morrisey believed in the case but got caught up in the win at all costs, and I think she would have definitely gone after Halls if it had been up to her. It’s really sad, I feel for the Hutchins’ family in all this.

    • @marymaclaren9553
      @marymaclaren9553 2 місяці тому +1

      @@shkrjam84 And this is me just having too much free time to live inside my head, but seeing Judge Sommer's demeanor, hearing her reasons while sentencing HGR, I think her anger was not only because of the corruption of Morrissey and LE conveniently forgetting (hiding) evidence, but she also believed in the case and now had to throw it all away. I hope for nothing but comfort for Hutchins’ family.

    I live in New Mexico and once waited over two years to see a specialist, the only one in the state. More common specialties have a 3-6 month wait list, but it took almost two years for me to get a six-month follow up to one, because the doc’s schedule would be full within an hour or so of the calendar opening each month. It felt like trying to get Taylor Swift tickets! The notion that a doctor in CA could do jury duty and just have someone cover for them is wild to me! Good for California. I hope it’ll be like that here someday!

    I think Morrissey did know the rounds were visually similar. She may not have ever looked at them, but I think Hancock told her they had a probelm with those rounds and thats why they purposefully buried them in a different case file.
    She claims they would have been "the best evidence" against HG, but they also would have been a defense of sabotage by Kinny. Defense could have raked them on why they were so friendly with Kinny and it could have tainted SZ testimony too.
    And thats only AFTER defense informed the Judge of this late discovery and how LE and prosecutor knew these rounds were out there but never tried to get them. It would have been a mess right at the end of HG's trial so Morissey buried it

      Quite possibly. But there's a saying called Hanlon's Razor: "Never attribute to malice that which is adequately explained by stupidity." Either way, it looks bad, and calls the actions of Hancock and Morrissey into question.
      When I watched Seth Kenney's police interview, I thought he was awfully quick to throw Gutierrez-Reed under the bus. And the detective seemed to be awfully...what's the word I want...deferential to him. It looked weird. Now I'm thinking he was trying very hard to avoid responsiblity.

    I feel bad for the jurors but the court caused some of those fears by letting witnesses lie under oath about their harassment cases that haven't been determined yet. The journalist has the right to not be slandered too.

    As to your question to chat about Hannah, I personally believe that G. Pickle has culpability in the death of Mrs. Hutchins. She told Hannah she had to help Sarah with props, not her job! She was not hired as Props Assistant, she was the Armorer. Pickle forced Hannah into a dangerous position to save money. It is her fault that Hannah was rushed consistently in her very important position as Armorer. Hannah was reprimanded for not " helping with props" and her Armorer hours cut, by G. Pickle.

    nuanced question here! the argument everyone is getting into over the Ariana lawsuit is regarding the law wording - to my understanding the word "distribute" implies, by definition, third party recipients. many are arguing that the mere sending of the video constitutes "distribution". assuming for this example that Rachel has no evidence & that Ariana did not send the video to any third party and ONLY sent it to Rachel - doesn't that *not* meet the criteria for revenge p? invasion of privacy, yes. but revenge p? I just don't see how they can make the argument of rp if the only recipient from Ariana was the subject of the video herself. there's so many heated arguments on this point - would love and deeply appreciate your expert opinion, both on this case, and the rp law interpretation itself. thank you so much in advance!! been here since 30k & I LOVE seeing creators I respect & enjoy growing to this level. you deserve it!!!

    Runkle brought this up during his coverage: some of this stuff came out in April, but we're just hearing about it now in July. The only thing he put in Hannah's appeal is the thing about the Jury instruction.
    Runkle's take is that there's an argument for Ineffective Assistance of Counsel, but it likely doesn't rise to that level. What do you think? How bad would it have to be to rise to that level?

    Could Ariana be liable if Rachel didn't know the FaceTime was recorded? FaceTime' tells you if someone is recording or takes a screenshot so (if Ariana was even thinking at the time and I don't blame her for not thinking in that moment) isn't it fair to assume on Ariana's end that the recording was consensual?

    Reply crew: Answering the question would it impact Hannahs conviction. I feel like the whole crew that were involved should be jailed e.g Alec, Hannah etc. However its only fair for Hannah to have all evidence. Shes not the only person who failed in their aspect on their job. I feel like she was used as a scape goat. To give benefit of the doubt she was stretched so far and if I remember her evidence she was giving out about not being given enough time to do her armory job. Like its a crappy situation everybody was at fault....however its not hannahs fault a person died. Its the production team as a whole. Alec got off....Hannah should get a chance to retrial. You never know what evidence would sway a jury. Could be the smallest of things.

    The consent talks started when our boys were about 6 & 3, but our oldest son knew about my SA, we told the youngest a few years later. Our boys know they can always come to us and they do.... our rules for them has always and will always be *Happy, Healthy, Safe, Legal, and Always Consent On Both Sides* .
    I always thought I would never make it through jury duty because I have the serious flaw of needing to have all scientific, how, whys, wheres, whats. I have no patience, unfortunately.
    I know it sounds stupid, but I learned long ago when someone feels like A is the *only correct way to think, feel, believe* someone that holds B will inevitably be dogpiled and many other things that can get real hairy, real fast. It's bananas!!!!

    My concern with the Karen Reid situation is what happens when this swings the other way.
    What happens when the next Kerry Morrissey loses a trial to a hung jury and then comes back with jurors saying "well we wanted to convict on two charges, but the instructions weren't clear that we could" or comes up with something like "we'll the jurors wanted to convict but were scared of the backlash so they cause a hung jury instead."
    I would rather be tried until I died than get convicted because some win at all costs prosecutor started messing with the results of a hung trial after the fact.

    • @Xershade
      @Xershade 2 місяці тому

      Also, if the defense is so worried about the institutions not being clear now, why didn't they bring that up beforehand. They threw a tantrum about the verdict form for charge two. Why didn't they bring up issues with the judges' instructions about filling out any partial verdicts.
