The rule is that you have rights to the airspace that is necessary for the ordinary use and enjoyment of your land and buildings. This is often interpreted as the airspace up to a "reasonable height," which typically means the height needed for normal activities such as repairs, maintenance, or the operation of chimneys. I believe this is in common law and case history. Bernstein of Leigh v Skyviews & General Ltd (1978) was a legal case in which the plaintiff, Mr. Bernstein, sued Skyviews for taking an aerial photograph of his property without permission, claiming it was a trespass to his airspace. The court ruled in favour of Skyviews, establishing that a landowner's rights to airspace are limited to what is necessary for the ordinary use and enjoyment of the land and buildings. Any airspace above that reasonable height is public, and the landowner cannot claim trespass over it. This case set a key precedent in defining airspace ownership in English law.

Did that tractor and trailer have a number plate on a public bridleway ?
You can tell she's never been told NO before haha!
I know it makes a good video, the interaction and these people who have no idea what they're talking about, but if it was me I would have stood somewhere off their land flown around, used up three batteries and got in my car and went home, and the reason I would do that is because the girl saying I'll give you my email address. I wouldn't have the patience with someone like that
Its the people flexing their perceived powers that make it interesting, listen to them waffling through legislation they have no knowledge of expecting compliance.
Your sadly missing the point here Angus...( I say this without impacting on your neiboughs).
Without interaction there is not really a video.
LOLZ That's why you don't have 120,000 subscribers, pal.
🤣More hilarious glimpses of National Trust bonkersness - fantastic, thank you.
I want you to work with us….. as long as it’s all on our terms. 🤣🙈🙈🙈
It's amazing how minimum wage tourism jockeys, become the finest legal experts when a man turns up with a camera and a drone.
National Trust have the following incorrect statement on their website: 'even if you take off from private land you may not fly over public land without permission.'
From the car park, they can close the gates for `permissive access. So how then, do the public, gain access to the `public bridle way’ encompassed within the estate, when everything is closed.
I can see that you are going to single handedly force the NT to change their unenforceable drone rules.
Hopefully

I think what you’re doing is great, but are you actually right, because on multiple legal advice sites(I’m not going to advertise them)
They say this
The lower stratum
This is the airspace immediately above/around the land. Interference with this air space would affect the landowner’s reasonable enjoyment of the land and the structures upon it. You can prevent people from interfering with or intruding on this airspace.
The upper
This is the airspace which exists above the height which is reasonably acceptable and necessary for the ordinary use and enjoyment of the land by its owner - around 500 to 1000 feet above roof space level (Section 76 Civil Aviation Act 1982).
A drone limit is 400feet so you come under the lower stratum?
@@macsmith6216 absolute utter rubbish, if it interferes with the enjoyment of the land , yes correct , is that 500-1000 feet ? 😂 LOL ! Above roof height is fine.

Ok keep yer hair on, I’m only asking because it is what legal representation is quoting
JFC
The Law:
The general rule is that property owners typically have the right to control the airspace above their land. This principle is based on longstanding legal doctrine “cuius est solum eius est usque ad coelum et ad inferos”. This recognises that property rights extend to both above and below the surface. However, the extent of the airspace ownership may be limited to what is deemed to be a reasonable height above the land.

Read the statement before getting it wrong 500 to 1000 is not included that’s the upper level
It’s the lower lever up to this point 500 feet
For six years I flew a helicopter for the Forestry Commission monitoring Larch disease over the whole country which included many National trust properties. I never asked them for permission because they like everyone else do not own the airspace.
These people fail to appreciate LAND and SKY are two different things. Their ego's preclude checking up and realising theyre wrong
As a foreign drone-pilot,I always enjoy seeing videos like this. I just wish NT would adhere to the LAWS.
No policies can cross laws. I think NTs policy is actually a violation of law. Ask them if aircraft also needs permission from them.....that'll shut them up quick. Works like a charm here in Norway 🇳🇴 😊
3.54 "im here hello" brilliant just brilliant
Legend! Bloke in the van smashed it in seconds, told you that all was fine and the others were gobsmacked 😂.
new guy at 44 mins was coolest guy ever.
Lovely to see these videos of places that you would never know that existed. Brilliant work and that high boss woman was well rude
I fly drones as i'm disabled and unable to see these beautiful places. I agree that National trust and many other places need to change their minds over the drone policy. They didn't even buy the land! They have had it donated for the use and enjoyment of the public. They don't own it! Nobody owns land it was there before us and will be there after us.. Disgusting greedy country we live in.
Predictable exchange:
"You can't fly a drone over our land!"
DAN:"But it's allowed by law via the CAA."
"I'm not gonna argue about it", followed by some random BS"
They just can't admit they are wrong can they!!!
"I'm not gonna do anything you want or work with you but let's extrnd thus interaction as long as possible and you keep it smiles or I'm gonna act surprised and borderline offended😂"
You're the biggest troll on youtube ey Im here for ut
21:12 - she is correct, it feels like the conversation wasn’t going anywhere.
Do you have a pilots license for your drone 😂
Needs one so I can climb inside the cockpit! 🤣🤣🤣
I thoroughly enjoyed Mizz Grey Top's impersonation of the "I'm a little bit ooh, a little bit waay, I'm a dodgy geezer" character from The Fast Show, thinking she could "connect" with the working man.
To be fair that guys saying come early morning for flying when they were not open yet is pretty sound
Wouldn't you think they would give the staff a uniform that fits. The girl has either found that fleece or she has lost 10st.
