The job of enforcing the Federal laws on immigration falls unto the Administration. Currently the Administration does not have the legal authority to take the actions that Texas wants. If the President were to take action on its own, it would be the Texas Republicans the first that would sue him in Court for braking the law. Another part of the Federal Government is Congress who passes the laws. The President has asked Congress for the Authority to take those actions that Texas and others want and the Senate passed a bi-partisan bill but it was scuttled by the Speaker of the House of Representatives at the request of Mr. Trump for admittedly political gain. Another Part of the Federal Government is the Supreme Court as they interpret and validate the laws passed by Congress and the States. Seems clear that Congress is the part of Government that isn't doing their job and its pretty clear that the Republicans that control the House of Representatives are the ones placing their political agendas ahead of the solving the border immigration problems.

I wouldn't call protecting your border controversial, fellas. Any of you would if you lived by the border. All those complaining are pretty much exclusively not suffering any of the consequences. They don't live in border states and don't get affected by illegal immigration first hand. Others carry that burden for them, while they are free to virtue signal from the lofty heights of their safety.
This has nothing to do with the border problem. It has to do with invading the constitutionally delineated powers of the federal government. If you care about the border, call your reps and tell them to let the federal government help. You can't just pick and choose parts of the constitution to follow.

The reason the law is controversial is because if state police even “suspect” you’re illegal or crossed the border you can be detained. That “suspect” is way too broad. It’s like stop and frisk on steroids. They can hold you with that for the 48hrs and find something else to charge you with.
And the law worked! Crime was lower when that was active.

The border should be divided into fifty sections and every states national guards have a section to protect. Only the crossings should be managed by border guards. The national guards can guard the border plus field train their troops. National guards should be able to arrest crosses and turn them over to border controll.
This is good, actually. If Texas has resources to do this then the Federal Government can now move its own resources out of Texas and into other states where DHS doesn't have to fight with local law enforcement.

It is actually not illegal for a person to enter the Country outside of the authorized ports of entry. The law reads that people that do enter outside of the authorized places can be detained for " Improper Entry into the Country" but it is not a criminal offense. The remedies are the process to expel them back across the border or to allow them to stay and receive a hearing. Now for those that are detained entering for a 2nd or more times there are some sanctions preventing them from a future path to enter properly into the Country. It is this revolving door that needs to be addressed by our law makers.
