@@WeToddEd-r3g Correct, no such crime exists called "accidental death," but "involuntary manslaughter" does exists, which is defined as the unintentional killing of another person. So yes, you can be punished for accidentally killing someone, but we call it involuntary manslaughter.
@ericward284 it actually can if negligence was involved. Baldwin could have checked to see if the gun was loaded when it was handed to him. As far as I know, that's gun safety 101.
@shawnbradford2243 What was negligent about it?? It's not a crime to not check to see if a gun is loaded. And we can sit here all day saying "he should've checked," but that's irrelevant. He pays someone to check that for him on the movie set. Only "negligence" involved was on the part of whoever loaded the gun. I've also heard conflicting stories on why he was pointing it in that direction. Some say he was just practicing like a scene or something, that would just make it accidental
Prop gun? I heard they were using this gun for target practice on set by stagehands then was supposed to load it with blanks, that's not a "prop" gun. Who's responsible for checking for the blanks? Who's responsible for not pointing a gun at someone's head before pulling the trigger? Is the court supposed to believe anything a defendant says when he says he didn't pull the trigger of a gun that blows the head off the person he is pointing it at?...The family of this poor lady deserves honest answers...
He probably drew the gun with his finger on the trigger. The armorer admitted that Alec hadnt practiced drawing from under arm like in the scene in question. You should draw a gun hundreds of times from concealment slowly before thinking about doing as fast as he could and well before putting a live round in the weapon. I bet the idiot armorer didnt check the gun after people had been firing it that weekend, or a disgruntled set crew (who walked off set that morning) planted a live round somewhere and it made it into the gun.
The producers, including Baldwin, chose to employ an inexperienced armourer and an AD with a somewhat sketchy reputation. There is a lot else that was wrong on this set and they did NOT correct many issues including red flag incidents with the ammunition. I know no one who would conduct any production in the lax and irresponsible way they did. It is almost unheard of that crew leave a production, but having voiced their concerns multiple times, several crew members felt obliged to leave the production over safety issues including the handling of guns and ammunition.
One thing I've heard about gun safety is that whenever you're handed a weapon is to check if it's loaded no matter who hands it to you and what they say. Idk if it is enough to convict, but that negligence led to a death.
Involuntary manslaughter is actually causing someone's death accidentally. Baldwin hiring an inexperienced armorer and giving her to many other responsibilities to distract her was definitely a direct cause for her distraction. Baldwin lied about pulling the trigger and didn't check all the blanks. Another shortcut! Baldwin pulled that trigger regardless and is the definition of unvoluntary manslaughter. He's guilty.
Rust is the poster child for irresponsible production, breaking many elements of production protocol. As one of the producers, he was irresponsible. Otherwise don't take a producer credit, it always comes at a price which is responsibility for the welfare of the entire unit.
It's very easy to accidentally put your finger on the trigger when drawing from under arm concealment. He should have practiced that draw slowly under supervision before trying to do it as fast as they asked him to. They cut corners in every aspect of this movie.
Look Alec is the boss on that TV set and that gun was in his hand when it went off and guess what he would be saying if it was his family member he would be trying to put that person in the same position in prison bet that
Baldwin argues that the armorer should be solely responsible, but as co-producer he is responsible for the hiring and competency of his staff. So, if he argues that the armorer was too inexperienced, it begs the question as to why the armorer was hired.

The day’s testimony was expected to focus largely on the collection of evidence and the revolver Baldwin used. Seated in two rows of eight each, jurors and alternate jurors scrawled notes as they listened to testimony. Jurors have their own close-up view of visual exhibits, with six monitors installed in the jury box. Poppell’s questioning by the prosecution a day earlier allowed them to see in person the revolver and the spent round that killed Hutchins. Spiro emphasized in his opening statement that Baldwin on the “Rust” set did what actors always do. The first witness to take the stand was Nicholas LeFleur, the first law enforcement officer to arrive at the movie set at Bonanza Creek Ranch after the shooting, and his lapel camera video gave jurors a glimpse of the chaotic scene: a grim view of an apparently unconscious Hutchins as LeFleur and others worked to revive her. Later in the video, LeFleur can be seen telling Baldwin not to speak to the other potential witnesses, but Baldwin repeatedly does.

That makes him criminally negligent for not controlling the direction his gun was pointing. My question is why did half the crew walk off the set that morning? so if you brought your car to a shop to have the brakes fixed and after you pick it up you drive down the street and at a busy intersection you see the light is red and you step on the brakes but there are none and you run some one down killing them is it your fault? the answer is yes, you can blame the shop but in the end you got in the car and drove it and will be convicted for vehicular homicide.

The last hands to touch the gun was Baldwin. He could have checked again before pointing the gun at the camera (a common/necessary step for people with experience in handling guns) ...
