    The main thing to be careful of, when creating either graphic art or advertising design, is to make sure that the finished work for your client is protected and can be copyrighted. Otherwise, various elements…or perhaps the entire design…will not be protected and will become the equivalent of public domain work. That means that anyone could then take that same design, or portions of it, and use it for their own product or service and you would have no legal recourse.
    This situation has come to a head here in the US with the introduction of the various AI generative art sites. The graphics produced on those sites, using only text prompts to cause the site to generate an image, means that the image that was produced was entirely “machine” made and not human made. And because of that, current copyright law forbids copyright protection for that work.
    The first court case regarding this situation occurred back in February of 2023 when the US Copyright Office (USCO) ruled that portions of a graphic novel….which included graphics that had been generated on the Midjourney site….could NOT be copyrighted since the graphics were not human-made.
    Since then, there have been a few other cases and all of them ended up affirming what the USCO had ruled earlier…..graphics from AI generative art sites cannot be copyrighted due to lack of human-based work. I also saw a report that a court in Britain also rejected copyright protection for work generated by an AI site.
    Because of this, I will avoid using AI sites for generative art since I want any work that I produce to have protection.
    If you want to check out some stories about the situation with copyright and AI generative art sites, just do a search on Google and it will dredge up various articles for you to check out. I recently did a search with the following terms “generative ai art not copyrighted” (no quotes) and got a decent representative sample of articles to read.
    Sure, AI generative art sites are fun to play with and some of them produce very interesting images, but I won’t be using those sites for graphic elements that I put in client graphic designs because it would just end up as unprotected, non-copyrightable work.

      Thanks for the input. Yes, we need to inform our clients when it comes to AI generated images. I would say that the can/product is the main hero and the biggest part (work) of the image so I will claim that the whole image is created by me, my copyright.

      ​@@botvidsson I agree that you created the image of the can, so that part certainly belongs to you copyright-wise. But the background was created in Midjourney, so that portion would likely be considered un-copyrightable and in public domain since that was not human-made.
      You can claim copyright all you want over the entire image, but that doesn’t mean that you actually do have copyright protection over everything.
      Your best bet would be to seek counsel from a copyright expert or lawyer and see how they read the law. Who knows? You may indeed have some protection for the whole image, but as things stand right now I would not bet on it. Better to be safe than sorry.
      In any event, thanks for the video …especially the part about how you photographed the can. That’s a good setup and process that you have there.

    You should spray varnish on the can before adding water droplets. Then water droplets would become more rounded instead of flat

    Thanks Martin. I am wondering how clients approach ai generated backgrounds? Do they accept it as the quality can be off sometimes or do some also reject it?

      Have not sold any backgrounds yet so I can't really tell. However, I have sold AI generated small images for website use and clients are happy.

      Well, now when I think about it I HAVE sold a photo with AI generated background, the client loved it. As long as the client get what they want they don't care how the image is made.

    Hello sir, love your videos. Plan on getting into product photography. Was wondering what the color is of your backdrops on your back wall. It appears you have 4, starting from the bottom is a dark blue, then a light blue, etc. Would like to know the exact color and who makes it so I could order them. Thanks.

    Tack grymt bra! Btw.. kommer midjurney gå att köra utan discots snart tror du, får lite panik av discord.. kör idag en del ai i Adobe men firefly verkar lite tråkigare.. alt är det jag som inte kan promphta bra, grymt att be ai att analysera fram promphts av en referensbild. 👍👍👍👊👊
