  • What are the five requirements needed to make an enforceable contract? An intention to create legal relations is certainly one of them! That is why, in this video, that is all we shall talk about: what it means and the rules (rebuttable presumptions) pertaining to it. To start off, we elaborate upon these rebuttable presumptions, stating what they are: i) domestic and social agreements lack intentions to create legal relations (illustrated through Balfour v Balfour [1919]) and the limitation/exception to this rule (illustrated through Merritt v Merritt [1970]); ii) commerical agreements are intended to create a legal relationship (as illustrated through Esso Petroleum v Commissioners of Customs and Excise [1975]) and the limitation/exception to this rule (as illustrated by Kleinworth Benson v Malaysian Mining Corp [1989] and Rose & Frank Co. v Crompton Bros [1924]).
