Uber should offer some form of settlement to the couple involved in the accident. I understand the agreement on the terms of service. But, the couples’ injuries weren’t caused by negligence on their part. If the passengers caused the accident, I’d stand by the company in that its hands were clean. But, their circumstances were brought on by the driver hired and approved by Uber.
Uber provides commercial taxi insurance to the drivers, that's why they take a percentage. If you don't want to use their arbitration, don't use the service. If you were allowed to sue the driver you would have frivolous lawsuits by grifters against the drivers constantly.

Why go after the platform? For more money. Georgia, as a fellow practicing attorney you are wasting the courts time and utilizing an Am Law 50 in hopes for a cash cow. If your damages are seriously still effecting you to this extent, dismantle your BAR certification and stop practicing law.

Ride share programs have auto insurance, drivers are (as we are constantly reminded) independent contractors. The drivers involved and whatever bodily injury coverage was available is the only thing that should be at play here. The specifics were not discussed and who knows the financial total of the treatment if they have health insurance (their home suggests they do), but the only reasonable reason Uber should even be named is if this is a question of a driver having access to the platform and they had an awful driving record. Lyft driver hit me head on totaling my van. Two broken vertebra in neck and two in lower back. The lyft driver was in Hertz rental car with bare bones minimum insurance. I got paid for van, few medical bills and tiny amount of cash. Government has no oversight in this area and is letting these companies get away with murder.
I agree but in the eyes of the law it's a binding contract, I joined a gym few years ago and out in their front lawn it says month to month payment, there were 10 white signs that had a blue print on them saying that when I saw the contract it didn't state month to month but the manager told me it was month to month I signed it and it wasn't I stopped going because I was getting busy with school and work so I tried to cancel my next month they told me I couldn't and that I signed a contract for 2 years I went to see a lawyer and he told me there was nothing I could do so I had to pay a total of $600 to terminate early

TOS = CYA for corporations. I've always known agreeing to those terms has pretty much thrown out all of our rights when it comes to being legally binding, which is why they make it so long most people don't even read through it, but if you do you will see you're agreeing to signing your life away basically. Seems like both parties would suffer consequences. Rider wouldn’t be compensated for injuries due to accepting an illegal ride. Drivers would be left with a wrecked vehicle with nobody to support them. Once the other driver and police notice that the phantom driver had a passenger (s), it’s immediately deemed that phantom driver’s fault, no matter the circumstances. It’s almost the same as driving without a license. For example, “You knew you had no license, but yet you’re still driving”….. “You knew you were doing an off-app ride and still accepted cash and picked up a passenger. It’s an undocumented ride and many bad things happen during undocumented rides. Did I mention a lot of drivers carry a gun, too?

OMG Disneyland's just did a similar court case like this. If you have the Disney app or watch a movie on the Disney platform ever in your life you essentially are not allowed to sue Disney if someone is harmed at Disneyland. This couple is at fault. Numerous times I tell Uber passengers to wear their seatbelt and they REFUSE...This is what happens when you don't WEAR YOUR SEATBELT
@chiapets2594 If they weren't wearing a seat belt, they would likely be found partially at fault in a contributory negligence state like New Jersey, where this happened. Regardless of someone's skill level in driving, sometimes emergency stops are required. By not wearing a seat belt, you are putting yourself and other people in the car in danger.

Arbitration hardly gives out any money. It’s kind of sad. There are some people that are truly hurt and have lifelong pain from accidents that deserve pain and suffering money.
I'm really having a tough time seeing how this really has anything to do with Uber itself. I would hope they would at least verify that the driver is legal, and has insurance before assigning rides. As long as that checks out what else is Uber supposed to do? Ultimately it was the driver's fault and so it should be on the driver's insurance to take care of things. The easiest way to prevent this is to drive yourself then you are the only person to blame.

When you sue someone you sue the insurance company and the person that's driving these people just want a ton of money from Uber because they know Uber has a lot of money in the person probably has nothing. That's what happens in an accident sorry people. Uber drivers are independent contractors they work for Uber independently. So you sue them.
That's not the point. The driver was insured. And whatever damages are not covered, you can sue the driver. In most of these cases, the costs would be paid by the driver's insurance, the owner, driver, or combination of.

With as much of the driver earnings (50% plus) that rideshare companies Lyft & Uber keep, they really should be held jointly liable.
The driver doesn't make 50%. You have no idea what you're talking about. They get the tip and $2.75 depending on distance.

Any lawyer worth their salt will get those TOS clauses thrown out. Remember, TOS cannot legally cover negligence on behalf of the company.

She refused to opt out of arbitration and because she is not intelligent enough to read contract before signing, she wants laws to protect her. We do have that already, it's called "due diligence". If she did that she would not be in this mess.

They should take it to Federal Court. Uber is in every state, therefore there would be standing.
The logical person to sue is the driver, but I understand they know the driver is probably broke so they threw a Hail Mary.

Every ToS you agree to protects the company in every way. It's disgusting in my opinion because it allows them to get away with anything they want since you agreed to it.
It was because of this that Uber had to change their EULA if they wanted to operate inside the EU.
They tried to pass it here, but since in EU, corps, multinationals, etc ARE responsible for their clients while using their services, the EULA that they use in countries like the USA was refused and Uber told that if they wanted to operate here, it had to be changed

OMG Disneyland's just did a similar court case like this. If you have the Disney app or watch a movie on the Disney platform ever in your life you essentially are not allowed to sue Disney if someone is harmed at Disneyland. These laws are insane and I cannot believe Uber is doing this as well that must mean that all these corporations are bringing out similar legal terms of service.

This couple is at fault. Numerous times I tell Uber passengers to wear their seatbelt and they REFUSE...This is what happens when you don't WEAR YOUR SEATBELT

@chiapets2594 If they weren't wearing a seat belt, they would likely be found partially at fault in a contributory negligence state like New Jersey, where this happened.
Regardless of someone's skill level in driving, sometimes emergency stops are required. By not wearing a seat belt, you are putting yourself and other people in the car in danger.
@Juann-t5u Wearing seat belt is the law for safety, they contributed to their own injuries thru their own negligence if they did not wear it. This doesn't mean they can't collect damages, just that it will be a reduced amount.

That was their 1st mistake then not wearing their seat belt was when thus case should have been thrown out. I wonder if they would have sued a taxi cab company like they did Uber knowing Uber is a big company and cab drivers work for themselves.
Arbitration hardly gives out any money. It’s kind of sad. There are some people that are truly hurt and have lifelong pain from accidents that deserve pain and suffering money.

I'm really having a tough time seeing how this really has anything to do with Uber itself. I would hope they would at least verify that the driver is legal, and has insurance before assigning rides. As long as that checks out what else is Uber supposed to do? Ultimately it was the driver's fault and so it should be on the driver's insurance to take care of things. The easiest way to prevent this is to drive yourself then you are the only person to blame.
Wow, I've used Uber once but I doubt I will again. I went through arbitration once. The arbitrator was coaching the other side. I hope this is resolved for them soon.

Something needs to be done about ALL these Terms of Service changing every 5 seconds. I think Samsung changes theirs weekly.... The most egregious examples are those where you purchase an item, you pay for it and you own it. You do so with an understanding on what it's capabilities are and such... then they change the Terms of Service, which many times go against what you understood to be buying. How can they get away with essentially changing something that belongs to someone else....

You can’t even get all the food you order most times. Either driver or restaurant takes/doesn’t pick it up. They give you like 2 minutes to make a dispute. UBER should be dismantled. Also I’m going to say this now Diddy didn’t hurt himself.

I just closed my Uber account. This is unacceptable. Arbitration should be banned for bodily injuries or any case over a fixed amount, say $10k.

When you sue someone you sue the insurance company and the person that's driving these people just want a ton of money from Uber because they know Uber has a lot of money in the person probably has nothing. That's what happens in an accident sorry people. Uber drivers are independent contractors they work for Uber independently. So you sue them.
