The mistake because of which we cannot sell our house in Thailand ( Rural Isaan )

  • We have a house in the province of Nakhon Ratchasima, which is also know as the gateway to Issan, or northeastern Thailand. We have a house in a village in which no is living for a while. But due to a mistake we cannot sell the house that was built 10 years ago. In this video we talk about that mistake, and tell about the things to know before buying a land to construct a house on in rural Thailand.

    Hi Sam people would want to buy the land only! As the house isn't to a standard to what people would want so would be getting pulled down and get rebuilt any way. So I'd only value the land the house is basically worth nothing. If I was thinking of buying the land I would want to buy for land value only as I would have to demolish the house and build another.

      Hi Frank. Right, the house was built by Ann’s stepfather himself. He is not known for building good looking houses anyway. Lol

    Seems the Banks owns this land due to debt not paid in full. Bank will arrive and enforce the people off the land if they buy this land. People in Thailand regularly sells property and land that does not belong to them with out legal papers.

      Right. Risky, but common for people to sell land without papers over here. It is a complicated situation. Only good thing is that the friend still pays the installments every year to the bank.

      That there are a lot of farmer land in North Thailand that are sold without chanote. They are not allowed to change the owners name.

    Did the fathers friend pay the loan off at the bank? If not then the land is owned by the bank and one day they will either ask you to leave or sell it to someone else? How about talking to the bank and asking the situation on the land? Oddly large parts of Thailand have no land titles and people use the tabian baan to prove "ownership"! It almost like a game; the government don't want to issue land documents and the people who have lived there for generations can only prove this via the tabian baan and other villagers knowing their neighbours land, etc! Hopefully things will improve.

      Right. The friend still pays the debt to the bank every year. I also come to know that many people do not have land titles over here in villages.
      Better for anyone wanting to buy a land or a house to get the documents checked properly.

    If you don't have documented proof of ownership of the land then you don't own it and don't have the right to sell it. That's why nobody will buy it. You would have to be a fool to buy it.

      Right, that's the reason why it cannot be sold.

      @@annandsaminthailand Just a thought have you seen a legal specialist about this? In many countries there is a law to account for these situations. There may be a legal case you could take to court where if you can prove that you have had possession and have maintained the property and paid taxes in the property for a specified number of years then the court may grant you ownership of the property and a legal title to the property will be issued by the court. It would be a long and probably expensive process but it would rectify the situation and once completed then you would have full legal rights over the property. My partners family are currently undergoing this kind of legal case in the Philippines. Her grandmother bought some land many years ago but did not process the change of title papers now her daughter is having to prove in court that the land belongs to her mother by showing the hand write contracts and that they have lived in the property, maintained it and paid the taxes for over 30 years because a descendant of the previous owner is trying to take the land back.

      @@Shattered65 So, yes. We do pay the taxes, and have house documents on Ann's mother's name. Right, I will try to get in touch with a lawyer regarding the case, and get the appropriate legal information.
      Right, people here also kind of used to buy the land without papers during the old times. The good thing in our case is that the previous owner does not want to take the land, as we have a small village, and everyone knows that Ann's father bought the land. It was a big thing in the village due to fight.
      The previous owner is still finishing off the debt by paying some amount every year, but for sure I will get in touch with him, and a lawyer to know more information.

    Good Luck,
    most hints like
    * contact Bank, what happen if someone pay dept, who gets/still has the ownership / chanod then
    * as of my knowledge (I am fa-rang) the dept guy seam still to be owner - as took credit on it,
    * and as of my experience he sure will keep it after dept is paid from another person and sell himself
    * so look for this 'tabian baan'
    * and keep your selling option down, as the owner might get the small of money and interact,
    and maybe update this data some day and get more hints from others.
    Funny, here at Hang Dong District, Chiang Mai it is difficult to sell land with 1 Rai as too expensive for most people, they want small plots like a 1/4 or 100 TWa. One Lai empty is already 4-6 Mio Baht. So only big companies build mubaan might by like 9 Lai at all haha

      Hi Thomas. Right, it is good to get advice from people who have been living over here for a long time period.
      Thank for telling about the prices in Hang Dong. For us, the land is way too cheap over here. Good agricultural land can be bought for around 300,000 baht, and when someone buys lets say 10 rai at once, then the price of 1 rai can easily go to 150,000 - 200,000 baht. There is a lot of farming land over here in the villages, and it does sell for a low price.

    "deeds" in Thai is "chanote".
    The FIRST question you ask a realtor when enquiring about purchasing land/house and land in Thailand is:
    "Does the property have a chanote".
    If the answer is "no", don't waste any more time on it.

    Buying any property without any proper documentation is very risky, even for a local. Might try to find someone to rent it

      Right. There were some people looking to rent, but mother turned it down as she would had to shift all the things, and would not get enough money to construct a new house on a different land
      The idea was to sell it, and construct a new house on a different land.

    Hi Sam. Before I watch, I want to give you a heads up because of junior:
    The wife’s 4 year old nephew just got out of a local government hospital after 4 weeks in Khao Wong, Kalasin.
    He’s a very lucky young man: Glanders and Melioidosis. I had never heard of it…very high mortality stats…inhalation of bacteria in soil, water or eating freshwater fish from bacteria infected water…swift diagnosis essential followed by the correct antimicrobial…he was on the relevant antibiotic in saline for 4 weeks now continued orally for 6 months to avoid bounce-back…it can even survive in distilled water…a second kid in the same school just came down with it…amazing how a local G hospital identified it…Dr’s said it was rare though no longer..leave you google it!

    Pay the debt at the bank if it’s not too much and get the paperwork then sell the land/house.

    Why own anything in Thailand? Just setting yourself up for misery. To each their own. Never pay for anything that isn't yours and in your name. Otherwise you are just an ATM. I would just leave the entire situation. Not worth the trouble and money.
