If the government can't provide a legal subpoena to these banks for believed criminal activity, the banks should be liable for damages for releasing peoples' private information. Any government agent that obtains this information without providing the proper legal documents to obtain this information should also be held liable for violating that citizen's rights. That citizen could end up with enough cash that they wouldn't need a corrupt bank providing their information illegally.
