The arrest can’t later be changed either, there was a recent court case where the defendant was acquitted because the judge said that swearing is not an offence, even if it can be heard by bystanders, certainly it is not an offence to swear at the police!

If there is no complaint there is no crime. This was made clear by Judge Bean in the appeals court in London when he granted an appeal for just this very situation.
